RESOLUTION NO. ~ A RESOLUTION OF THE CITY OF SEAL BEACH, CALIFORNIA SETTING FORTH THE LOCAL CONDITIONS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT MODIFICATIONS TO THE NATIONAL ELECTRICAL CODE, 1990 EDI'l'ION, ARE REASONABLY REQUIRED BY LOCAL CONDI'l'IONS WITHIN THE CITY OF SEAL BEACH THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Health and Safety Code Section 17922 requires the City of Seal Beach to adopt the most current edition of the National Electrical Code; and WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council to make changes or modifications in the most current edition of the National Electrical Code as may be reasonably necessary because of certain local conditions, and WHEREAS, the Building Official of the city of Seal Beach has determined and recommended that, based upon certain local conditions within the city of Seal Beachr the modifications to the 1990 Edition of the National Electrical Code as contained in Ordinance No. 1441 are reasonably required to be adopted by the City of Seal Beach, and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications to the most recent edition of the National Electrical Code; and WHEREAS, it is appropriate to describe the specific local conditions upon Which each said modification is based. NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Seal Beach that the amendments and modifications to the 1990 National Electrical Code contained in Ordinance No. 1441 are hereby found to be reasonably necessary because of the following local climatic, geological or topographical conditions: A. The local climate in the area which includes the city of Seal Beach is characterized by hot, dry summers, followed by strong Santa Ana winds. The undeveloped portions of the city, including the Hellman Ranch, consist of grasslands which can become critically dry and generate or fuel fires which can be difficult to control and which threaten surrounding, developed properties. Thus the City is 'vulnerable to rapidly spreading, wind-driven fires. Other portions of the City are quite densely populated, with narrow or non-existent sideyards. These factors greatly enhance the risk of fires which spread to a number of properties. Amendments to state electrical standards are neces- sary to regulate construction practices to reduce fire hazards to a manageable level. Therefore, the City council of the City of Seal Beach finds that the changes made by Ordinance No. 1441 to the following provisions of the National Electric Code are reasonably necessary because of local climactic, geological, and topographical conditions: Sections 210.23(a), 220.4(e), 230.42(b)(1), 230.42;0)(2), 230.24, 250.112, 310.14, 310.16, 336.3, 336.4(a), and 370.4(a). i B. The soils of the City of Seal Beach are markedly corrosive. Accordingly, the safe and ~ffective functioning of electrical components which come into contact with the soil can be assured only by amendments to certain provisions of the National Electrical Code. Therefore, the City council of the Resolution Number 4D 1/ City of Seal Beach finds that the changes made by Ordinance No. 1441 to the following provisions of the National Electric Code are reasonably necessary because of local climactic, geological, and topographical conditions: sections 230.42(b)(1), 230.42(b) (2), 250.81(c), 250.81(e), 250.112, and 300.6(b). C. certain changes to administrative provisions of the Uniform Administrative Code are necessary to allow the uniform administration of the building codes, including the electrical code, by procedures suited to the size and nature of the City's staff and administrative agencies and by means suited to the City's experience with local climactic, geological, and topographical conditions and to provide sufficient staff support for the time-consuming insp~ctions and analyzes required by the fire safety hazards outlined above and by the geological hazards posed in a city which is traversed by or adjacent to numerous active faults and which contains historic wetlands areas comprised of potentially unstable soils. Therefore, the City council of the City of Seal Beach finds that the changes made by Ordinance No. 1441 to the following provisions of the National Electric Code are reasonably necessary because of local climactic, geological, and topographical conditions: Sections 303(a), 303(d), 304(a), 304(b), 304(d) (2), and 305(e).
