RESOLUTION NUMBER ~86
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, A CHARTERED CITY,
ESTABLISHING A COMPENSATION PLAN, INCLUDING
SALARY AND BENEFITS, FOR MANAGEMENT,
CONFIDENTIAL, AND NON-REPRESENTED EMPLOYEES
AND REPEALING, ON THE EFFECTIVE DATES
SPECIFIED, ALL RESOLUTIONS IN CONFLICT
THEREWITH
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
I
SECTION 1. SALARIES
The salary schedule as shown in Appendix A attached hereto and
made a part hereof for each salary range and/or hourly rate of
pay shall constitute the basic compensation and pay plan for
manaqement, confidential and non-represented personnel. Schedule
A. II. shall become effective January 2, 1991.
SECTION 2. LEAVE TIME
A. All full-time employees who have at least one year of
continuous service as a full-time permanent employee shall
earn leave hours in accordance with paragraph E below.
B. Leave hours may be used for, but not limited to, the
following purposes: vacation, siCk leave, bereavement,
personal leave. All leaves, other than sick and bereavement
leaves, must be approved in advance by the employee's
department head.
C. The department head may require employee's to present proof
of illness and clearance to return to work for siCk leaves
in excess of twenty-four (24) hours (3 working days).

Employees who are on authorized leaves of absence, without
pay, shall not accrue leave hours during said leaves of
absence.

An employee shall not accrue leave hours in excess of the
maximum accrual schedule, unless otherwise provided for in
this section. Hours in excess of the maximum accrual
schedule shall be forfeited. In no case shall the hours
earned exceed 288 hours per year.
F. Incumbents in Executive Management, Direct Staff Assistant
or Line Assistant positions are exempt from the maximum
accrual provisions of this section.

G. Existing sick leave balances which have remained intact and
have not been converted to leave time, may be utilized by
the employee for sick leave purposes only.
H. Upon termination of employment with the city, all leave
hours will be paid to the employee at the employee's base
rate of pay. Existing sick leave balances, which,have
remained intact and have not been converted to leave time,
will be paid to the employee upon termination at one-quarter
(25%) of the employee's base rate of pay.
SECTION 3. INSURANCE PROGRAMS
A. Health and Dental
1. The city shall provide for full-time employees and
eligible retired employees a group hospital, medical
and dental insurance plan,
2. The city shall contribute to the cost of each
medical/dental plan for each eligible employee and
their dependents, up to the following amounts:
Effective January 1, 1991:
-For single employees . . . . . . . . ,

Employees enrolled in the plan are required to pay any
premium amounts in excess of the above city
contribution. Such amounts will be deducted from the
affected employee's payroll check on the first two pay
periods for each month.
Part-time, seasonal, provisional and/or hourly
employees shall not be eligible for participation in
this program.
4. No person who is eligible to receive Worker's
Compensation benefits is eligible to receive benefits
from the City's group medical insurance,

5. Full-time employees of the City who have completed
thirty (30) days of uninterrupted service shall be
enrolled in this insurance program on the first day of
the next succeeding month.
6. Employees who change classification from full-time to
part-time provisional, hourly or seasonal shall not be
eligible for this benefit.
7. City shall not pay premiums for any employee on leave
of absence without pay, who is absent from regular
duties without authorization during the month and/or
for any employee who has terminated from City
employment fo~ any reason. City shall pay premiums for
employees rec~iving temporary payments from Wo~ker's
Compensation Insurance.
B.
Life Insurance
All employees incumbent in position classifications listed
in Appendix A shall receive a $50,000 life insurance policy
paid by the city, Said insurance shall become effective
after the employee has completed thirty (30) days of
unintercupted service with said employee to be enrolled in
the program on the first day of the next succeeding month.

C, Income Continuation
All employees incumbent in position classifications listed
in Appendix A shall receive an income continuation policy to
provide for income continuation of Sixty-Six and Two-Thirds
Percent (66.67%) of the employee's monthly salary, up to a
maximum of Five Thousand Dollars ($5,000) per month,
whichever is lesser. Said insurance shall become effective
after the employee has completed thirty (30) days of
uninterrupted service with said employee to be enrolled in I
the program on the first day of the next succeeding month.
said income continuation shall commence on the thirty-first
(31st) day of sickness or other bona fide absence or upon
expiration of sick leave, whichever occurs later, and
continuing thereafter while the employee is absent from work
for a period of up to age 65.
Section 4.
Retired Health Plan
All employees incumbent in position classifications listed in
Appendix A shall have the option upon retirement to continue
participation in the City's health insurance program at the
employee's expense.
Executive Management employees with 20 or more years of
continuous employment with the city, and all other employees
incumbent in position classifications listed in Appendix A with
30 or more years of continuous employment with the City, shall
upon retirement be provided with individual and eligible
dependent health insurance coverage at no. cost to the retiree.
All employees, other than Executive Management, with 20 years or
more of continuous employment with the city, but not 30 years or
more, shall upon retirement be provided with ihdividual health I
insurance coverage at no cost to the retiree.
Sworn police personnel identified in Appendix A shall be subject
to the retired health plan contained in the Memorandum of
Understanding with the Seal Beach Police Officer's Association.
In the event an eligible retired employee resides in an area were
the health plans provided by the city are not in effect, that
retired employee shall be entitled to receive in cash each month
an amount equal to the monthly contribution the city would
otherwise have contributed to that retired employee toward health
and dental insurance premiums.
SECTION 5. BEREAVEMENT LEAVE
The city agrees to provide three working days bereavement leave
with pay for death in the immediate family. The bereavement
leave shall not be chargeable to or accumulate as sick time or
leave time. "Immediate family" is defined as spouse, father,
mother, son, daughter, brother, sister, grandparent, grandchild,
step-mother, step-father, or dependent relative living with the
employee.
SECTION 6. HOLIDAYS

All employees incumbent in position classifications listed in
Appendix A shall be granted the following holidays with pay:
New Year's Day (January 1)
Martin Luther King Day (3rd Monday in January)
Washington's Birthday (Third Monday in February)
Memorial Day (Last Monday in May)
Independence Day (July 4)
Labor Day (First Monday in September)
Veteran's Day (November 11)

A total of 10 holidays annually.
SECTION 7, RETIREMENT SYSTEM
The retirement program provided by the'City shall consist of a
depooled Public Employee's Retirement System (PERS) plan which
includes the following provisions:
A. section 20024.2
B. section 20862.9
C, section 20930.0
One Year Final Compensation
Credit of Unused sick Leave
Military service Credit
The city shall pay that portion of the affected employee's
retirement contribution that is equal to seven percent (7%) of
the affected employees' base salary.
All employees incumbent in Police and Lifeguard position
classifications listed in Appendix A shall participate in the 2%
at 50 formula plan for Local Safety Members.
SECTION 8. OVERTIME AND CALL OUT PAY
A. Only employees incumbent in position classifications listed
in Appendix A as Confidential, Supervisory, or Professional
and Technical are eligible for overtime or call-out pay.
B. Callout and overtime pay shall be paid at the rate of time
and one-half the hourly rate. Minimum "callout" time shall
be two (2) hours,
C.
Overtime will be computed by dividing the empl~~gulBr monthly
salary by 173.3 to arrive at an hourly wage. Paid overtime
for the month is to be submitted and computed with the
regular payroll for the last payroll of the'month.
D. Notwithstanding any provision of this section, the employee
shall be entitled to select either compensated overtime or
compensatory time off subject to budget limitations and
departmental rules and regulations.
SECTION 9. UNIFORM ALLOWANCE
Employees incumbent in Sworn Police position classifications
listed in Appendix A shall receive an annual uniform allowance of
$500. Each non-sworn employee of the Police Department required
by the Chief of Police to wear a uniform as a condition of
employment shall receive a sum of thirty-five dollars ($35) per
month to be paid on a semi-annual basis.
SECTION 10. MOVE-UP PAY
The City agrees that employees assigned, in an acting capacity,
to a higher classification than the employees' present
classification for a period of not less than 120 consecutive
working hours shall be entitled to move-up pay. In addition,
employees who are assigned by the department director in writing
to regularly scheduled acting assignments of less than 120 hours
shall also be entitled to move-up pay for those hours worked in
the higher classification. Move-up pay will be retroactive to
the first hour served in the higher classification and shall be
paid at a rate equal to the range of the higher classification.
Minimum move-up pay shall be 5%.
SECTION 11. SENIORITY ~ONUS
Employees who have achieved ten years of uninterrupted employment
with the City shall receive a five percent (5%) increase in base
salary effective on the 10th anniversary of their employment.
Sworn police personnel are exempt from this section.

SECTION 12. AUTOMOBILES AND MILEAGE
A. Officers and employees of the city, utilizing their
privately-owned automobiles for City business on a non-
regular basis, shall be entitled to reimbursement for costs
incurred at the rate of 25 cents per mile.
B.
Incumbents in the following positions will receive a monthly
automobile allowance of $150 in lieu of the above-stated
mileage reimbursement: Assistant city Manager, Assistant to
city Manager, Director of Public Works/City Engineer,
Director of Finance, city Clerk, Director of Parks and
Recreation, Lifeguard chief and Director of Development
Services.

c. If the city does not provide a city vehicle, then the
incumbents in the position classification of Building
Inspector shall be reimbursed at the rate of Four Hundred
Dollars ($400) per month for the use of their privately-
owned automobiles for the execution of their job duties on a
regular basis. Building Inspectors who utilize private
vehicles for city business may utilize, to a maximum of once
per week, the City-assigned car wash for the purpose of
washing their vehicles used for City business.
SECTION 13. EXPERIENCE PAY (SWORN POLICE)
Effective December 1, 1986, all employees incumbent in Sworn
Police position classification listed in Appendix A with a
minimum of ten (10) years of full-time service as a sworn police
officer with a municipal, county or State police agency meeting
California police Officer's Standards and Training Commissions
standards or their equivalent, shall be eligible to receive, upon
receipt of an overall satisfactory performance appraisal, signed I
by the Chief of POlice, his designate, or an individual acting in
his capacity, or the city Manager, a five percent (5%) increase
in their base salary. Effective January 1, 1988, eligible
employees with twenty (20) years of full-time service shall
receive a ten percent (10%) increase above their base salary.
New hires shall not become eligible to receive experience pay
until after satisfactory completion of their probationary period.
SECTION 14. ADMINISTRATIVE LEAVE
A. All incumbents in Executive Management and Management
position classifications shall be entitled to three (3) days
of administrative leave during the twelve month period from
July 1, 1991 through June 30, 1992.
B. All incumbents in Confidential, Supervisory, and
Professional and Technical position classifications shall be
entitled to one (1) day of administrative leave during the
twelve month period from July 1, 1991 through June 30, 1992.
C, Administrative leave days may not be carried forward to
succeeding years nor may they be turned in for cash value.
section 15, Limitations
A.
Part-time, hourly, seasonal and/or provisional employees,
contract employees, reserve police personnel and any City
employee who is not employed on a continuous full-time basis
shall not be eligible for benefits stated in this
resolution.

B. No employee who is eligible to receive workman's
compensation is eligible to receive overlapping benefits
(except life insurance) stated in this resolution.

C. City shall not make any monthly payments for premiums for
any insurance benefit listed in this resolution, or uniform
allowance, supplemental pay of any type and/or. type o~ bonus
on behalf of or to any employee who has been absent w~thout
authorization during said month or for any employee who has
terminated for any reasons whatsoever or who is on leave of
absence without pay of who is suspended from duties without
pay.
SECTION 16. DEFERRED COMPENSATION
A. The city shall contribute the amount of $45.00 per payroll
period into a deferred compensation program for each
incumbent in an Executive Management and Management position
classification.
B. The City shall contribute the amount of $10.00 per payroll
period into a deferred compensation program for each
incumbent in the Confidential, Supervisory, or Professional
and Technical position classifications.
SECTION 17. EMPLOYEE RECOGNITION FUND
There is hereby established an Employee Recognition Fupd of $2000
to be utilized by the City Manager for the purpose of employee
recognition,
SECTION 18. BONUS FUND
There is hereby established a Bonus Fund of $5000 to be used by
the City Manager to recognize outstanding employee performance.
SECTION 19. PAGER COMP~~t~TION
The incumbents in the icllowing classifications are considered on
standby and subject to ~ecall to duty 24-hours each day of the
year and must carry with them an electronic paging device for
that purpose. Therefore, they shall rec~ive compensation each
month as follows:

SECTION 20. BILINGUAL COMPENSATION
A. Upon the recommendation of a department director, the city
Manager may award a bilingual compensation bonus of $34.61
per payroll period to those employees in positions
determined to require bilingual skills.
B. The Personnel Director shall administer the taking of
competency tests to certify the employee as eligible for
bilingual compensation based on the employee's proficiency
in speaking the language determined to be required. Such
certification shall be a condition precedent to qualifying
for bilingual pay.
SECTION 21, TERM
The term of this Resolution shall commence on July 1, 1991 and
shall continue through December 31, 1991.
SECTION 22, RESOLUTION. :'1 CONFLICT
All resolutions in con;:J ict with this resolution are repealed
upon the effective date set forth in Section 1.
