Paul Yost Mayor, Seal Beach And Council Members Shawn Boyd Patricia Campbell Bill Doane Paul Snow 211 Eighth Street Seal Beach, California 90740 Dear Mayor Yost and Council Members, I am writing on behalf of my mother, Jean Mauldin Fisher(known as Jean Mauldin), who is the sole owner of the property at 112 8th St., Seal Beach. Her family has been in continuous ownership of this property since 1906_ We intend to attend the Public Hearing regarding"Public Nuisance Declaration, 112 8111 St."on Monday, October 25, 1999. Should we be unable to attend, please consider this letter in our absence. As of the date of the"Notice" October 11, 1999, a crucial element of the"Need for Declaration"had been corrected and acknowledged by city employees. The landscaping is not overgrown with weeds or grass. A landscaping service has been contracted to cut the lawn on a regular basis. The owner responded to the city's complaints and requirements as soon as she received them. She currently resides out of state and her post office has been slow at forwarding mail. She received three notices bundled together on September 16, 1999. She immediately asked me to empty the yard of all debris and to get the yard maintained. This was swiftly accomplished_ She then asked me to remove my son, who was occupying the building without permission,remove his possessions and completely empty the house to enable an accurate inspection by the Senior Building Inspector. To assist in removing the occupant, I asked the City to proceed immediately with the order of non-occupancy that they held as necessary. Subsequently, on that day, the house was locked and sealed off from entry unless the permission of the City is given. The house has been emptied of nearly all contents and the utilities have been disconnected. The yard has been cleared of all vehicles, debris, and tall grass or weeds and is being maintained by a yard service. No fire danger exists to the house or the neighbors. There are no occupancy problems. Given the quick response and cooperation given to the City once notification had been received, an order of abatement is excessive and unnecessary. The immediate necessity, that of a noxious exterior condition and occupancy of a building deemed unsafe has been eliminated. The owner,Mrs. Mauldin, proposes and pledges these actions: 1. To maintain the exterior free of vehicles or debris,with the understanding that service vehicles will need access during working hours. 2. To continue regular yard service to keep the grass cut. 3. To cooperate with the City's control over admittance. 4. To proceed with repairs or sale of the property. 5. To solicit bids for repairs necessary for minimum safe and sanitary occupancy as required by your letter(Notice)dated August 10, 1999. This includes repair of windows,ceilings/walls/floors, plumbing, electrical, replacement of rear door with an acceptable door, installation of stair hand rails, heater installation, smoke detector installation,and installation of a new stove,all as detailed on pages two and three of the Notice. 6. Subsequent to the bidding process, owner will make the economic decision to proceed with contracting the repairs, or to proceed with the sale of the property. 7. Concurrently, owner is proceeding with discussions with local realtors and other interested persons for the sale of the property at fair market value as established by comparable recent sales. 8. Should the decision be made to not proceed with the needed repairs, the house will be put on the market,kept non-occupied, and the yard maintained pending sale. In return for these pledges, the owner, Mrs. Mauldin, requests that the City put in abeyance the proceedings of abatement. She understands that the council at any meeting following notice can reinstitute the abatement procedure should the terms of this agreement be violated by the owner.
