Badum, Director of Public Works/City Engineer Subject: OCTA MASTER FUNDING AGREEMENT AMENDMENT No. 1, C95-991 SUMMARY OF REQUEST: The proposed action will amend the original Master Funding Agreement with the Orange County Transportation Authority (OCTA)to provide for indemnification and right of way disposal criteria. DISCUSSION: Upon the voter approval of Measure M in 1990, the City of Seal Beach entered into a Master Funding Agreement with OCTA which sets the criteria for receiving, accounting, and expending Measure M funds. OCTA is requesting an amendment to correct deficiencies in the existing cooperative agreement. The amendment will add indemnification sections and criteria for the disposal of excess right of way that was originally purchased with funding from the Measure M program. In general, funds derived from the sale of excess right of way which were originally purchased using Measure M funds must be returned to OCTA. FISCAL IMPACT: No fiscal impact.
