Till, City manager From: Lee Whittenberg, Director of Development Services Subject: CITY RESPONSE LETTER RE: `DRAFT FOCUSED SITE INSPECTION PHASE H WORK PLAN, NAVAL WEAPONS STATION" RECOMMENDATION Authorize the Mayor to sign the draft response letter, with any additional comments determined appropriate. Receive and File Staff Report. DISCUSSION The report before the City Council is the "Draft Focused Site inspection Phase 11 Work Plan" (Draft FSI Phase II Work Plan), which describes the procedures by which further investigations at IR Sites 12, 16, 25, 37, 38, 42, 44/45, AOC 6, SWMU 24, SWMU 56, SWMU 57, the Old Skeet Range, Building 128 Strip Pit, and Site 73 - Water Tower Area will be undertaken to accomplish the following goals and objectives: o carry out the recommendations as a result of previous Installation Restoration Program (IRP)investigations; o screen for ecological and human health risks; o fill data gaps from previous investigations; o supplement information presented in past site inspections; and o to decide whether cleanup or no further action is warranted at specific sites. The Department of the Navy (DON) has circulated the above referenced document and is requesting comments by October 29, 1999. AGENDA ITEM L C:1My Documerta\NAVWPSTA1Dra*FSI Phase II Work Plao.CC.doc1LW110-05-99 Draft Focused Site Inspection Phase II Work Plan -Naval Weapons Station City Council Staff Report October 11, 1999 Overview of Proposed Project: DON is requesting comments on the Draft FSI II Work Plan by October 29, 1999. Staff has prepared a "Draft Comment Letter" for consideration by the EQCB and the City Council, provided as Attachment 1. The EQCB considered this matter on September 29, 1999, and determined to froward the comment letter to the City Council without any modifications. Staff provided the Report and pages A-12 through A-44 of Appendix A — Field Sampling Plan for the information of the EQCB (See Attachment 2). These pages and the remainder of Appendix A, and Appendices B through G, comprise the majority of the document (315 pages) and are available for review at the Mary Wilson Library, 707 Electric Avenue, and at the Department of Development Services, City Hall, 211 Eighth Street. Overview of Draft Focused Site Inspection Phase II Work Plan: The objective of the subject report is to supplement data obtained during previous site investigations at the subject sites to: o carry out the recommendations as a result of previous Installation Restoration Program (IRP) investigations; o screen for ecological and human health risks; o fill data gaps from previous investigations; o supplement information presented in past site inspections; and o to decide whether cleanup or no further action is warranted at specific sites. This Draft FSI Phase II Work Plan includes a brief description and historical overview of each site and a summary of the previous investigations conducted, including definition of the remaining data gaps to be addressed; and a description of the additional information gathering steps to be taken. The overall purpose of the FSI Phase II effort is to close existing data gaps by: o Better delineating the lateral and vertical extent of chemicals of potential concern (COPC) in soils, sediments, and groundwater(as necessary). o Evaluating COPC concentrations in soil sediment and groundwater (as necessary) to assess the potential threat to human health and the environment through screening risk assessments. o Evaluating the Installation Restoration Program (IRP) locations for potential No Further Action (NFA), removal actions, or further evaluations (with an emphasis on the former two types of decisions). Draft FSI Phue 11 Work Plan.CC.doc 2 Draft Focused Site Inspection Phase II Work Plan -Naval Weapons Station City Council Staff Report October 11, 1999 This Work Plan details the tasks to be conducted as part of the FSI Phase II. Organization of Draft Focused Site Inspection Phase II Work Plan: The document consists of the FSI Phase II Work Plan, which is organized into 4 sections, and 7 appendices. The sections of the FSI Phase II Work Plan and their contents are listed below: o Section 1 - "Introduction", provides "Project Background", "Purpose of the Focused Site Inspection Phase II", and "Work Plan Organization". o Section 2 - "Locations Background", provides the "Location Description and History" and "Summary of Previous Investigations" for each site. o Section 3 - "Data Quality Objectives" describes the "Data Quality Objectives Process" and the "Location-Specific Data Quality Objectives". o Section 4- "References", provides a list of the documents and information sources used in the data gathering process. The appendices to the FSI Phase II Work Plan include: o Appendix A-Field Sampling Plan (FSP); o Appendix B- Quality Assurance Project Plan (QAPP); o Appendix C -Health and Safety Plan (H&SP). o Appendix D -Photographs of Locations o Appendix E-NPDES Permit Number CA8000375 o Appendix F-Sample Identification System o Appendix G -Response to Comments Document Availability: The subject document is available for review at the Mary Wilson Library, 707 Electric Avenue, and at the Department of Development Services, Seal Beach City Hall, 211 Eighth Street. Proposed City Response: Staff has reviewed the subject document, and finds the document very well organized and understandable, with Section 2, "Locations Background" being very helpful. Table 3-1, "Revised DQO Summary, Focused Site Inspection Phase II is extremely helpful in obtaining a quick overview of each site, and the 7-step process to be undertaken to fill the specific data gaps remaining from previous investigations. In addition, the discussion and presentation of information on pages 12 through 44 of Appendix A, is helpful in achieving a clear understanding the issues of concern regarding each site to be further investigated. Draft FSI Phase II Work Plan.CC.doc 3 ry Draft Focused Site Inspection Phase II Work Plan -Naval Weapons Station City Council Staff Report October 11, 1999 Overall, staff has no concerns regarding the amount or locations of the proposed additional investigations for each site. The document does indicate that the investigations at Site 73, the Water Tower Area, is within archaeological site CA-ORA-322/1,118, which is considered to be eligible for the National Register of Historic Sites, and therefore an fieldwork will require the presence of a qualified archaeological monitor (page 2-14). It is recommended that the comment letter request the presence of a qualified "Native American monitor" also. Restoration Advisory Board (RAB) Information Materials: Provided as Attachment 3 is a copy of the presentation materials submitted to the RAB on August 11, 1999. This information packet provides an overview of the objectives of the FSI Phase II Work Plan, an overview of the sampling strategies by site, and a summary. These materials are also not provided with the City Council Staff Report, and are available for review by the City Council or the public at the Department of Development Services. FISCAL IMPACT None, all activities associated with this project are the responsibility of the Department of Navy, and the City has no economic exposure to the proposed project. RECOMMENDATION: Authorize the Mayor to sign the draft response letter, with any additional comments determined appropriate. Receive and File Staff Report. The work plan will better define the appropriate actions to take to eliminate existing potential adverse impacts to the residents of the City of Seal Beach and to employees of the Weapons Support Facility at the 14 sites to be investigated in the Phase II work plan. The overall structure of the document is well organized, with Section 2, "Locations Background" being particularly helpful to the general reader. In addition, Table 3, "Revised DQO Summary - Focused Site Inspection Phase II" is helpful in presenting at a quick overview of the data quality objectives to be utilized in order to arrive at a final site decisions for the targeted locations. The City also supports the following proposals contained within the FSI Phase II Work Plan document: o The proposed "Study Boundaries" set forth in Step 4, Table 3-1. o The proposed "Decision Rules" set forth in Step 5, Table 3-1. o The proposed "Optimize the Sampling Design" set forth in Step 7, Table 3-1". Draft FSI Phase II Work PIan.CC.doc 7 a Draft Focused Site Inspection Phase II Work Plan -Naval Weapons Station t City Council Staff Report October 11, 1999 It would be helpful in the "Final" document to include the site specific information regarding the following areas in a Table within the main document, perhaps as Table 3-2, that is now included within Appendix A, pages A-12 through A-44: o Sampling Objective o Proposed Activities o Performance Methodology a Data Use, and a Potential Receptors of Concern Providing this information in a Table within the main document would allow the general reader to obtain a very good summary of the sampling program proposed for each site, the use of the collected data, and the receptor of concern. In regards to Site 73, Water Tower Area, the City supports the required presence of a "qualified archaeological monitor" during fieldwork at this site. However, given the potential significance of the archaeological site, which overlaps the Water Tower site, it is requested that a qualified Native American monitor also be present during all fieldwork activities at this site. In reviewing the discussion regarding SWMU 24 - Stationary Demilitarization Furnace Facility, and Section 4, References, the City is now aware of the decommissioning of this facility in 1998. Please provide a copy of the June 1998 report by Brown and Caldwell, titled "Decommissioning Plan of Action (DPOA)for Stationary Demilitarization Furnace at Weapons Support Facility, Seal Beach, California" and the 12 January 1999 report of Foster and Wheeler titled "Draft Project Closeout Report:Decommissioning of Stationary Demilitarization Furnace Facility, Naval Weapons Station, Seal Beach, California" for our information and files.
