BACKGROUND The California Building Standards Commission published the 1998 California State Building Codes on January 1, 1999. The City has 180 days to enact any amendments to these model codes. If the City does not enact the recommended amendments, the State-adopted codes are automatically invoked and will govern the City's construction activities. Staff has prepared and the City Council has adopted as an urgency measure Ordinance No. 1448, amending the Code to reflect the appropriate amendments to the 1998 California Codes, the 1997 "Uniform Codes" and the 1996 National Electric Code. It was essential that the City have in effect prior to July 1, 1999,the appropriate codes that comply with State law and contain those modifications necessitated by unique topographic, geologic and climatic conditions. In the absence of adoption of Ordinance No. 1448, the provisions of the various codes unique to the City's special circumstances would not have been in place and this would have had a detrimental effect on the public health, safety and welfare. Ordinance No. 1448 was adopted on June 14 with an operative date of July 1, 1999 in order to comply with the State deadline. Staff is also recommending to the City Council an ordinance to be considered 1998 California Code Adoption.CC Staff Report 2 Adoption of 1998 California Codes City Council Staff Report June 14, 1999 in the normal ordinance adoption process, e.g., first and second readings, but which will not be effective until the end of July, 1999. This proposed code amendment ordinance is identical to currently adopted Ordinance No. 1448, with the exception of the deletion of all language relating to an urgency measure, and has been developed to make the City Municipal Code consistent with state regulations, provide for the specific city amendments, provide adequate health, safety and welfare protections to local citizens, and standardize the ordinance requirements with surrounding jurisdictions'requirements. The modifications to the various Uniform Codes contain vital provisions regarding administrative procedures, roofing materials, sprinkling systems and other similar matters necessitated by the City's unique locational circumstances. Many of the proposed modifications are carried over from the previously approved modification to the 1991 and 1994 Uniform Codes, which were adopted by the City Council in August 1992 and December 1995, respectively. The remaining amendments reflect changing conditions and improvements to the codes since the adoption of the appropriate 1991 and 1994 Uniform Codes. The Ordinance under consideration includes the requested amendments to the Uniform Fire Code, 1997 Edition, as requested by the Orange County Fire Authority. The proposed amendments have been reviewed by County Counsel and the Office of the City Attorney. The Orange County Fire Authority recommends that the City adopt the 1997 Uniform Fire Code and Uniform Fire Code Standards with the proposed amendments. FISCAL IMPACT None, complies with provisions of law to ensure the Uniform Codes are updated pursuant to Health and Safety Code § 18941.5.
