HomeMy WebLinkAboutCC Res 3934 1990-05-14 THE CITY I FOLLOWS: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, IWHEREAS, WHEREAS, WHEREAS, I WHEREAS, RESOLUTION NUMBER ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, APPROVING GENERAL PLAN AMENDMENT la-90, AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN DEALING WITH THE HELLMAN SPECIFIC PLAN AREA. COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE AS the Land Use Element of the General Plan was adopted in October, 1973, and has been amended and updated at various times since 1973; and the Land Use Element was amended in November, 1987, to incorporate the Hellman Specific Plan; and Mola Development Corporation has met with representatives of the agencies responsible for the adminstration of wetlands in the State of California; and General Plan Amendment la-90 proposes an amendment to the Land Use Element incorporating the concerns of these agencies regarding wetlands, and further setting out the number of acres in the Gum Grove and Community Park area; and pursuant to Section 15168 of the CEQA Guidelines, a program Environmental Impact Report (EIR 87-1) and Supplemental EIR have been prepared and certified by the City of Seal Beach, and this amendment is within the scope of the certified program EIR; and the Environmental Impact Report and Supplemental Environmental Impact Report demonstrate that the proposed amendment to the Land Use Element will have no significant impact on the environment that will not be mitigated to a level of insignificance; and in accordance with Sections 65351 and 65353 of the California Government Code, the Planning Commission of the City of Seal Beach facilitated pUblic participation in the preparation of this amendment to the Land Use Element of the General Plan by inviting public participation at its duly noticed public hearing on May 9, 1990, and considered the views of speakers at that meeting through both written and oral evidence, before adopting Resolution 1576 recommending approval of General Plan Amendment la-90 to the City Council; and in accordance with Sections 65351 and 65355 of the California Government Code, the City Council of the City of Seal Beach facilitated public participation in the preparation of this amendment to the Land Use Element of the General Plan by inviting public participation at its duly noticed continued public hearing on May 10 and May 14, 1990, and considered the views of speakers at the hearing through both written and oral evidence, before adopting this resolution; and the City has reviewed the existing text of the Land Use Element and the text of all other elements of the General Plan and determined the proposed amendments to the Land Use Element are consistent with the letter and the spirit of the Land Use Element and the other elements of the General Plan. J9jl Resolution Number NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach, does hereby approve General Plan Amendment la-90, as shown in Attachment "A", attached, based on the following findings: SECTION 1. SECTION 2. SECTION 3. SECTION 4. Since the Supplement EIR was prepared the project has been altered in these respects: a. The total number of dwelling units has decreased from 355 to 329, as a result of Coastal Commission approval of the proposal. I b. Wetland acreage has increased from 37.7 to the present 41.4 acres and a formal Wetlands Restoration Plan has been approved by the Coastal Commission. c. The right-of-way width of proposed Hellman Ranch Road has been reduced from eighty feet (80') to fifty-six feet (56') to reflect the reduced traffic flow to be generated by the project in light of the reduction of the number of housing units in the project from a much greater proposal for a substantially larger number of units (773 units reduced to 329 units). d. The land to be dedicated for Gum Grove Park and for the community park is increased from 24.7 to 26.0 acres, due to the reduced right-of-way width for Hellman Ranch Road. These changes reflect measures imposed by the California Coastal Commission in further mitigation of the I environmental effects documented in the EIR and supplemental EIR. Accordingly, none of the conditions set forth in Public Resources Code SS 21166 which would require additional environmental review are present and no such review is necessary. The City Council of the City of Seal Beach finds the adoption of the proposed amendment to the Land Use Element of the General Plan on file in the office of the City Clerk, attached hereto as "Exhibit A," and incorporated herein by this reference, will not have a significant impact on the environment that will not be mitigated to a level of insignificance as provided in the Environmental Impact Report and the Supplemental Environmental Impact Report prepared for this project. The City Council of the City of Seal Beach finds that the proposed amendment to the Land Use Element of the General Plan has been prepared according to the procedures set forth in the applicable provisions of the City Code and of the Government Code and that the terms of the Land Use Element as amended by this proposal comply with the requirements of Section 65302(a) of the Government Code. I The City Council of the City of Seal Beach finds that the proposed amendment to the Land Use Element of the General Plan is in the Public interest, is consistent with the land use goals of the City as set forth in the existing Land Use Element, and that the uses proposed for the affected parcels are compatible with the present use of neighboring parcels. The City Council of the City of Seal Beach finds that the Land Use Element of the General Plan as amended by this proposal is consistent with the other elements of the General Plan of the City of Seal Beach. The exact location, size, and restoration process will be reviewed and approved by the agencies that have control over the state's wetland resources. Although the city supports this proposal, it is not envisioned that the City will either own or maintain the wetlands area. A fuller description of the wetlands is provided in the amended Hellman Specific Plan. Approximately 26 acres of land is devoted to community parkland including the Gum Grove Park area.
