HomeMy WebLinkAboutCC Res 3935 1990-05-14 RESOLUTION No. J9~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, APPROVING GENERAL PLAN AMENDMENT 1b-90, AN AMENDMENT TO THE OPEN SPACE, RECREATION/CONSERVATION ELEMENT OF THE GENERAL PLAN DEALING WITH THE HELLMAN SPECIFIC PLAN AREA. II The city Council of the City of Seal Beach does hereby resolve: WHEREAS, the California Government Code requires that cities adopt open space and conservation elements for their general plans; and WHEREAS, on December 10, 1973, the City Council adopted an Open Space/Recreation/Conservation Element for the General Plan; and WHEREAS, in November 1987, the City Council adopted Resolution No. 3737, approving GPA 2d-87, incorporating the concepts of the Hellman Specific Plan into the city's General Plan; and I WHER~S, this General Plan amendment is needed to address the restoration of wetlands on the site of the Hellman property and to set the amount of acreage to be set aside as parkland; and WHEREAS, General Plan amendment lB-90 proposes an amendment to the open space/conservation/recreation element consistent with the proposed Land Use Element changes; and WHEREAS, pursuant to Section 15168 of the CEQA Guidelines, a program Environmental Impact Report (EIR 87-1) and Supplemental Environmental Impact Report have been prepared and certified by the City of Seal Beach, and this amendment is within the scope of the certified program EIR and Supplemental EIR; and WHEREAS, Since the Supplemental EIR was prepared the project has been altered in these respects: (a) The total number of dwelling units has decreased from 355 to 329, as a result of Coastal Commission approval of the proposal. (b) Wetland acreage has increased from 37.7 to the present 41.4 acres and a formal Wetlands Restoration Plan has been approved by the Coastal commission. I (c) The right-of-way width of proposed Hellman Ranch Road has been reduced from eighty feet (80') to fifty-six feet (56') to reflect the reduced traffic flow to be generated by the project in light of the reduction of the number of housing units in the project from a much greater proposal for a substantially larger number of units (773 units reduced to 329 units). (d) The land to be dedicated for Gum Grove Park and for the community park is increased from 24.7 to 26.0 acres, due to the reduced right-of-way width for Hellman Ranch Road. These changes reflect measures imposed by the California Coastal Commission in further mitigation of the environmental effects documented in the EIR and Supplemental EIR. Accordingly, none of the conditions Resolution Number ~9~~ set forth in Public Resources Code 521166 which would require additional environmental review are present and no such review is necessary. WHEREAS, General Plan Amendment IB-90 will not adversely affect the health, safety, and general welfare of the surrounding community, and should be granted. WHEREAS, the Planning Commission of the City of Seal Beach facilitated public participation in the preparation of I General Plan Amendment lB-90 by inviting public participation at its duly noticed public hearing on May 9, 1990, and considered the views of speakers at that meeting through both written and oral evidence, before adopting resolution 1574 recommending approval of General Plan Amendment lB-90 to the City Council; and WHEREAS, the City Council of the City of Seal Beach facilitated public participation in the preparation of General Plan Amendment lB-90 by inviting public participation at its duly noticed continued public hearing on May 10 and 14, 1990, and considered the views of speakers at that hearing through both written and oral evidence, before adopting this resolution; and WHEREAS, the City has reviewed the existing text of the Open Space/Recreation/conservation Element and the text of all other elements of the General Plan and determined the proposed amendments to the Open Space/Recreation/ Conservation Element are consistent with the letter and the spirit of the Land Use Element and the other elements of the General Plan. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City I of Seal Beach does hereby approve General Plan Amendment lb-90, as shown in Attachment "A," attached. These parks often attract people from outside the area in which they are located. Typically these facilities contain tennis, volleyball, handball and basketball courts, picnic areas and sports fields for seasonal sports such as baseball and football. Community parks generally I range in size from approximately 5 to 30 acres. Add new section as follows: Wetlands Area An area of approximately 41.4 acres of tidal influenced wetlands will be restored in the southwest corner of the Hellman property. The size of the wetlands is based on a wetlands assessment and restoration recommendation by the Department of Fish and Game in 1980 (updated in 1988) and amended by the California Coastal Commission in January of 1990. The project should create a habitat for a wide variety of fauna, with supporting the flora representative of a salt water wetlands. A fuller description of the wetlands and some of its functions is described in the amended Hellman Specific Plan. 2. Add to Communi tv Park An area of approximately 26 acres will be developed as a Community Park including the Gum Grove area which would incorporate nature trails, active and passive recreation elements into its design.
