A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH APPROVING TENTATIVE PARCEL MAP
86-349
The City Council of the City of Seal Beach does hereby resolve:

WHEREAS, the property is described as a portion of the Hellman
specific Plan area and is located north of Marina Hill,
west of Seal Beach Boulevard, east of the Haynes Cooling
Channel and northeast of Pacific Coast Highway; and
WHEREAS,
filed by Mola Development
for Tentative Parcel Map 86-
WHEREAS, the proposal is to subdivide the Hellman Specific Plan
area into four numbered lots and three lettered lots;
and
WHEREAS, the primary purposes of the Tentative Parcel Map are for
conveyance purposes and to divide the area into a lot
suitable for further subdivision for a residential
project, oil extraction areas, and right-of-way
dedication; and
WHEREAS, the entire area subject to the Tentative Parcel Map is
192 acres; and
WHEREAS, the Environmental Impact Report and Supplemental Impact
Report demonstrate that Tentative Parcel Map 86-349 will
have no significant impact on the environment that cannot
be mitigated to a level of insignificance; and
WHEREAS, the Planning Commission of the City of Seal Beach has
reviewed and considered the proposed Tentative Parcel
Map and conducted a duly noticed public hearing on May
9, 1990 at which time both written and oral evidence was
received; and
WHEREAS, the Planning Commission, through the adoption of
Resolution 1577, recommended Tentative Parcel Map 86-349
to the City Council for approval; and
WHEREAS, the City Council of the City of Seal Beach has reviewed
and considered the proposed Tentative Parcel Map and
conducted a duly noticed continued public hearing on
May 10 and 14, 1990 at which hearing both written and
oral evidence was received.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Seal Beach does hereby make the following findings:
That the proposed map is consistent with applicable
General and Specific plans and with those plans as they
are proposed to be amended in pending applications
proposed for this development, in that, inter alia, the
map requires dedications that are consistent with said
plans.
2. The design of the subdivision will not interfere with
existing easements, acquired by the pUblic or utilities
that serve the public, because the proposed subdivision
will preserve and maintain existing easements.

3. The site is physically suitable for the type and density
of the proposed subdivision, and will allow for further
subdivision that can meet the density and configurations
of adopted Specific and General plans.

4. The design of the subdivision will not cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat because all
mitigation measures contained in the Environmental Impact
Report (EIR) and Supplemental EIR for the project will
be implemented.
Pursuant to section 15168 of the CEQA Guidelines, a
program EIR and a Supplemental Environmental Impact
Report have been prepared and certified by the City, and
this subdivision is within the scope of the certified
program EIR and Supplemental EIR.

6. Since the Supplemental EIR was prepared the project has
been altered in these respects:
(a) The total number of dwelling units has decreased
from 355 to 329, as a result of Coastal Commission
approval of the proposal.
(b) Wetland acreage has increased from 37.7 to the
present 41. 4 acres and a formal Wetlands Restoration
ElAn has been approved by the Coastal Commission.
(c) The right-of-way width of proposed Hellman Ranch
Road has been reduced from eighty feet (80') to
fifty-six feet (56') to reflect the reduced traffic
flow to be generated by the project in light of the
reduction of the number of housing units in the
project from a much greater proposal for a
substantially larger number of units (773 units
reduced to 329 units).
(d) The land to be dedicated for Gum Grove Park and for I
the community park is increased from 24.7 to 26.0
acres, due to the reduced right-of-way width for
Hellman Ranch Road.
These changes reflect measures imposed by the California
Coastal Commission in further mitigation of the
environmental effects documented in the EIR and
Supplemental EIR. Accordingly, none of the conditions
set forth in Public Resources Code 521166 which would
require additional environmental review are present and
no such review is necessary.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of
the City of Seal Beach does hereby approve Tentative Parcel Map
86-349, subject to the following conditions:
1. Prior to final map approval, applicant shall make an
irrevocable offer to dedicate "A" Street from Pacific
Coast Highway to Hellman Ranch Road/Regency Drive to the
City for street purposes. The street shall be shown as
a fifty-six foot (56') right-of-way.
Prior to its approval, the final map shall show the
configuration of "A" Street. Minor changes in lot size
or configuration will not require an amendment to this
parcel map.

3. Southern California Edison has determined, in a letter
dated May 11, 1987, that this subdivision will not
interfere with the free and complete exercise of any
easements held by Southern California Edison. The final
determination as to the location or changes of any power
transmission lines shall be to the satisfaction of
Southern California Edison and the city of Seal Beach.
4. Prior to final map approval, Appellant is hereby required
to obtain approval of a Development Agreement with

respect to the development of Parcel Numbers 1 and 2. As
part of the Development Agreement, applicable shall officer,
or cause to be offered, five (5) contiguous acres of land
located on Parcel Number 4 with reasonable access to Hellman
Ranch Road to the City for purchase for park and recreation
purposes. The Development Agreement shall specify the method
for determining the purchase price of such property which
shall be based upon the fair market value of such property,
taking into account any characteristics of the property (such
as the presence of hazardous waste or materials, if any)
which would be considered by an appraiser in valuing the
property.
