Dear Council and Staff,
I see online that this agreement has been revised. These revisions resolve all of the issues that I raised in my
prior comments except one. Section 5.I.1 was not revised to delete the reference to the City providing a
retirement program that includes the provision of "Section 20042‐ One Year Final Compensation" (see
attachment). Unless this is our intention, then this is not correct. Our current CalPERS PEPRA plan does not
include this provision (see attachment).
I remain concerned that the contract as written potentially creates a "private" obligation on the City's part to
pay Ms. Telford the difference between a higher pension based on the final year average salary average
(which CalPERS will not pay) vs. her likely lower three‐year average final salary (which is the max that CalPERS
will pay under our current contract with them).
A very simple solution to this obvious ambiguity is to simply strike the one line referring to Section 20042
from the contract.
