Ingram, City Manager FROM:Philip Gonshak, Chief of Police SUBJECT:A Resolution Ratifying the Proclamation of a Local Emergency ________________________________________________________________ SUMMARY OF REQUEST: That the City Council adopt Resolution 7013 to ratify the Proclamation of a Local Emergency for the 2020 Coronavirus Pandemic. BACKGROUND AND ANALYSIS: Governments worldwide are responding to an outbreak of respiratory disease caused by a novel (new) coronavirus that was first detected in China and which has now been detected in almost over 100 countries, including in the United States. The virus has been named “SARS-CoV-2” and the disease it causes has been named “coronavirus disease 2019” (abbreviated “COVID-19”). COVID-19 is a serious disease that has killed over 4,000 people worldwide with over 1,100 confirmed cases and over 30 deaths in the United States. On February 26, 2020, the County of Orange and County Health Officer issued a Proclamation of Local Emergency due to COVID-19. On March 11, 2020, the World Health Organization categorized the disease as a global pandemic. Through Seal Beach Municipal Code 3.25.020, the City Manager, as the Director of Director of Emergency Services, proclaimed a Local Emergency on March 13, 2020 to enhance the City’s ability to protect public health and safety, and to mobilize local resources, coordinate interagency response, accelerate procurement of vital supplies, use mutual aid, and seek potential reimbursement by the State and Federal governments. The Municipal Code requires that such proclamation be ratified by the City Council within seven days to remain in effect. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. Page 2 7 0 6 LEGAL ANALYSIS: Per California Government Code § 8630 and the Seal Beach Municipal Code, a proclamation of local emergency must be ratified by the governing body within 7 days of issuance and reviewed and continued every 30 days thereafter until termination of the local emergency as conditions warrant. The declaration of emergency permits the City to invoke the emergency powers of the City and to potentially qualify for state and or federal funding. FINANCIAL IMPACT: Ratification of this resolution will maintain the City’s compliance with State and Federal requirements for emergency response and promote the City’s eligibility to receive State and Federal emergency assistance funds. The Finance Department has designated a separate account to capture all costs associated with the 2020 Coronavirus Pandemic. STRATEGIC PLAN: This item is not applicable to the Strategic Plan. MEASURE BB: This item is not applicable to Measure BB, the Seal Beach Neighborhood and Essential Services Protection Measure. Seal Beach Local Emergency Proclamation 2 - Supplement One RESOLUTION 7013 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL RATIFYING AND SUPPLEMENTING THE PROCLAMATION OF A LOCAL EMERGENCY BY THE CITY MANAGER/DIRECTOR OF EMERGENCY SERVICES WHEREAS, the City Manager, as the Director of Emergency Services, proclaimed on March 13, 2020 a Local Emergency for the 2020 Coronavirus Pandemic pursuant to Seal Beach Municipal Code Section 3.25.020, to protect public health, safety and welfare, and to enhance the City’s ability to mobilize local resources, coordinate interagency response, accelerate procurement of vital supplies, use mutual aid, and seek potential reimbursement by the State and Federal governments; and WHEREAS, the City Manager, as the Director of Emergency Services, further added Supplement One to the said Local Emergency Proclamation on March 16, 2020; and WHEREAS, the emergency closures and bans on gatherings are likely to cause significant economic disruptions and hardships, most notably to the City’s most vulnerable residents who have, or may soon, experience sudden and unexpected loss of income; and WHEREAS, during this public health crisis, it is essential that people in the City have access to running water, sanitation and other essential services, and not incur other unnecessary expenses; and WHEREAS, this Proclamation of Local Emergency is necessary to protect public health, safety, life and property in the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. That the City Council hereby ratifies the Proclamation of Local Emergency for the 2020 Coronavirus Pandemic and Supplement One, both as attached hereto, pursuant to Seal Beach Municipal Code Section 3.25.020(A)(2). Section 2. That the City Council further orders that: a. The City shall immediately suspend: (1) the discontinuation or shut- off of water service for residents and businesses in the City for non-payment of water bills, (2) the imposition of late payment penalties or fees for delinquent water and/or sewer bills; and (c) the imposition of late payment penalties or fees for parking violations in the City during the period of local emergency. b. The City shall immediately suspend enforcement of parking violations for street sweeping hours during the period of local emergency. c. Trucks and other vehicles engaged in the delivery of grocery items to grocery stores, when such items are to be made available for sale to the public. are hereby exempt from complying with City ordinances or conditions of City permits that limit the hours for such deliveries including, without limitation, City noise ordinances for the duration of this emergency. d. Residents of the City are strongly encouraged to refrain from “overbuying” of grocery products and to be considerate of their neighbors’ needs. The California Grocers’ Association has informed cities that “overbuying “ is creating unnecessary strains on the supply chain. Food and goods will continue to flow from manufacturers to stores for consumers if we all work together to avoid buying beyond our reasonable needs. Harper, City Clerk CITY OF SEAL BEACH FIRST SUPPLEMENT TO PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY BY THE EMERGENCY SERVICES DIRECTOR WHEREAS, City of Seal Beach Municipal Code Section 3.25.020 empowers the City Manager as the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said city is affected or likely affected by a public calamity and the City Council is not in session, and WHEREAS, on March 13, 2020 the City Manager/Emergency Services Director of the City of Seal Beach proclaimed a local emergency to help the City and the region prepare for and respond to the public health crisis created by the spread of the COVID-19 virus; and WHEREAS, on March 13, 2020, the President of the United States also declared a national emergency, joining the State of California and the County of Orange in making resources available to fight the spread of the virus and imposing or suggesting certain restrictions; and WHEREAS, on March 16, 2020 the President requested that people avoid non-essential travel and congregating in groups of 10 or more, among other precautions; and WHEREAS, Governor Newsom has called for bars, wineries, gyms and health clubs to be temporarily closed, among other restrictions and “social distancing” requirements; and WHEREAS, the St. Patrick’s Day Holiday is traditionally a day where multiple people congregate in large groups at bars and restaurants in the City, which has been prohibited and discouraged by health officials at multiple levels; and WHEREAS, this supplement to the Proclamation of Local Emergency is necessary to protect public health, safety, life and property in the City. NOW, THEREFORE, I, Jill R. Ingram as City Manager and Director of Emergency Services for the City of Seal Beach, do hereby issue the following order to be effective immediately, subject to ratification by the City Council on Thursday, March 19, 2020: 1. Because of the rapid spread of COVID-19 and the need to protect the most vulnerable members of our community, this Order prohibits all indoor public and private gatherings and all outdoor public and private events within a confined space, where at least 50 people are expected to be in attendance at the same time. This Order applies within the City of Seal Beach beginning at 11:59 PM on March 16, 2020 and continues through at least 11:59 PM on March 19, 2020, subject to the terms and conditions more particularly set forth below unless extended by the City Council. For all gatherings that are not prohibited, the City orders the event and gathering holders and venues to implement the following infection control precautions: (1) enforce social distancing within the confined space by requiring attendees to be separated by six (6) feet; (2) provide access to hand washing facilities with soap and water or hand sanitizer that contains at least 60 percent alcohol; (3) post a sign in a conspicuous place at the public entry to the venue instructing members of the public to not attend if they are experiencing symptoms of respiratory illness, including fever or cough; and (4) adhere to communicable disease control recommendations provided by the Orange County Department of Public Health. Further, this Order requires all permanent food facilities to limit their services to only preparing and offering food to customers via delivery service, via pick up for take-out dining only, or via drive thru. Therefore, this Order immediately requires closing the following types of businesses in the City of Seal Beach: (1) All bars, wineries, tasting rooms, distilleries, and nightclubs that serve the public, except to the extent food is served for takeout or delivery services. (2) Gyms and Fitness Centers. (3) Movie Theaters, Live Performance Theaters, Bowling Alleys, and Arcades. The City will continue to monitor COVID-19 disease spread, State and CDC recommendations, and the impact of the required measures, and as needed, may revisit, extend, expand, or otherwise modify this Order to protect the public’s health. 2. Any violation of this or other Orders shall be punishable as a violation of Seal Beach Municipal Code Section 3.25.030. 3.
