Subject:External Email : Question and Comment for Tuesday's Public Hearing on the Street
Lighting Assessment District
Dear Council and Staff,
For Tuesday's public hearing, I would like to have one question answered:
Page 7 of 18 in the Engineer’s Annual Levy Report indicates that staff provided the Engineer with a cost
estimate of $5400 for attorney fees. This is noteworthy since the last time attorney fees were included in an
Annual Levy Report was FY 16‐17. At that time, $600 was estimated and budgeted, but none was expended
(based on later budget “actuals”). Looking through older budgets and “Engineer’s Reports” going back to FY
11‐12, I found that $5000 in Engineer Reports and budgets for FY 11‐12, FY 12‐13, and FY 13‐14. However,
once again, later budgets show no actual expenditures for attorney fees in any of these three years.
What legal services are anticipated in FY 20‐21 that will cost $5400?
If staff cannot provide specifics on anticipated legal services, legal fees should be deleted from both the
Engineer’s Report and the proposed General Fund subsidy in the FY 20‐21 Budget.
Thank you for your consideration and service,
Robert Goldberg
