Good afternoon,
We are encouraged that the Seal Beach city council is considering the 2nd reading and adoption of
amendments to prohibit electronic smoking device use wherever cigarette smoking is currently prohibited.
We recommend that the current Seal Beach ordinance includes an evidence- based definition to
cover all forms of tobacco smoking, instead of adding the electronic cigarette provision to each
section of code. We recommend using the definition from the American’s for Non-Smoker’s Rights:
“Smoking” means inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe,
hookah, or any other lighted or heated tobacco or plant product intended for inhalation, including
marijuana, whether natural or synthetic, in any manner or in any form. “Smoking” includes the use of an
electronic smoking device which creates an aerosol or vapor, in any manner or in any form, or the use
of any oral smoking device for the purpose of circumventing the prohibition of smoking in this Article.
Expanding electronic cigarette prohibitions is a good first step, but Seal Beach city council can and
should do more. We recommend a comprehensive smoke-free ordinance to help protect residents from
unintentional exposure to smoke, and the cancers caused by that exposure. A comprehensive smoke-free
policy includes components that protect people where they work, play, and live their daily lives and includes a
15-25-foot buffer zone to ensure that secondhand smoke doesn’t drift into these areas.
We look forward to working with city staff and coalition partners to develop a strong ordinance.
