RESOLUTION NO. ~~
A RESOLUTION OF THE SEAL BEACH CITY COUNCIL OPPOSING
THE DRAFT NEGATIVE DECLARATION FOR
THE HAZARDOUS WASTE FACILITY PERMITS AT THE
SEAL BEACH NAVAL WEAPONS STATION AND
REQUESTING AN ENVIRONMENTAL IMPACT REPORT
BE PREPARED
WHEREAS,
in November, 1990, the U. S. Environmental Protection
Agency and the State of California Department of Health
services prepared a Draft Negative Declaration and Draft
Hazardous Waste Facility Permits for the Seal Beach Naval
Weapons station; and
WHEREAS, the Draft Negative Declaration recommends approval of
the draft hazardous waste facility permits since the
Department of Health Services finds that the project as
proposed will not have a significant deleterious effect
on the environment, based on the conclusions of the
Initial Study; and
WHEREAS, at the request of the City council, staff has reviewed
and prepared a summary of the Draft Negative Declaration
and Draft Hazardous Waste Facility Permits for the Seal
Beach Naval Weapons station dated December 10, 1990: and
WHEREAS, the city Council considered the .staff report at the
regular city council Meeting of December 10, 1990; and
WHEREAS, the city Council endorsed the preparation of a letter
response and the preparation of a Resolution in
opposition to the Draft Negative Declaration and Draft
Hazardous Waste Facility Permits at the December 10, 1990
city Council meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Seal Beach as follows:
Section 1.
The City Council of the City of Seal Beach finds
that a more thorough environmental review is
appropriate, such as a complete Environmental Impact
Report, or if Federal law is controlling, a complete
Environmental Impact Statement.
The city Council of the City of Seal Beach believes
that a more thorough environmental review is
appropriate and that the following areas of concern
have not been adequately addressed in the Draft
Negative Declaration:
section 2.
The actual volume of hazardous waste which can
be contained in each storage bay area when
fully filled with the allowable number of
containers should be indicated and compared
with the actual volumes of hazardous mate'dals
being stored within each of the storage bays.
This will allow a fuller understanding as to
the potential for overflow within these storage
bays.
2) The sixty-nine (69) Solid Waste Management
units (SWMU's) and nine (9) Areas of Concern
(ACC) identified in the Draft Hazardous Waste
Facility Permits should be mapped to indicate
their location on the Weapons station,
particularly in relation to the National
wildlife Refuge and residential areas, both on

and off the Weapons Station. In addition some
system of prioritizing the preparation of the
Phase I RCRA Facility Investigations for these
areas should be established.

In order to adequately determine if the
proposed mitigation measures are adequate, some
discussion as to the past history of the
facility in relation to fire, explosion or
release of hazardous waste constituents which
could threaten human health or the environment
should be provided.

adequately address the following areas of concern:
1) Impact of unstable earth conditions or changes
in geologic substructures.

The city council of the City of Seal Beach hereby
recommends that the level of environmental review
should be strengthened, and that an Environmental
Impact Report should be prepared for this project.

recommends that in order to adequately discuss the
impacts of this project, all proposed mitigation

measures designed to eliminate potential adverse
effects to a level of insignificance must be clearly
established, tested against proposed mitigation
measures for other projects as to effectiveness, and
only those which have proven to be effective should
be incorporated into the ultimate project to be
undertaken, if so determined upon completion of the
environmental review process.
Section 6.
The city Council of the City of Seal Beach hereby
recommends that as part of the more extensive
environmental analysis that alternative sites be
analyzed. The "Alternative project" section of a
Draft EIR or Draft EIS should thoroughly discuss
the option of relocating the existing hazardous
waste storage facilities to the Fallbrook facility.
