HomeMy WebLinkAboutCC Res 4008 1991-01-28 . , RESOLUTION NUMBER ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING GENERAL PLAN AMENDMENT 2B-90, AMENDING TABLE 16 OF THE HOUSING ELEMENT TO REPRESENT THE INCREASE OF 1.1 ACRES OF RESIDENTIAL LOW DENSITY LAND WITHIN THE CITY II THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. On July 9, 1990 Surfside Colony, Ltd. filed an application with the Department of Development Services for Zone Change 1-90 and General Plan Amendments 2A-90 and 2B-90, requesting to merge each privately owned lot with that portion of the right-of way adjacent to the existing residential lots and change the zoning of the affected portion of the right-of-way from S-P Parking zone, (S-P) to Residential Low Density zone, (RLD) . :"':~.. .. Section 2. traverses the City direction. The Southern Pacific right-of-way of Seal Beach in roughly an east-west I . v Section 3. Within the surfside Colony the right-of- way is presently utilized for the private garages of single- family homes adjacent to the right-of-way, the alley adjacent to Pacific Coast Highway and for the Surfs ide Colony community parking lot. I Section 4. The adoption of Zone Change 1-90 will result in an increase of approximately 1.1 acres of low density residential land within the city. Section 5. Staff has prepared an initial environmental assessment and proposed Negative Declaration as required by the California Environmental Quality Act (CEQA). Staff received comments back from several governmental entities, each expressing "no concern" with the proposed project. Section 6. A duly noticed public hearing was held by the Planning Commission on October 3, 1990 to consider General Plan Amendment 2A-90. Section 7. The Planning Commission made the following findings, after receiving all public testimony: 1. The proposed Zone Change and accompanying Zoning Text Amendment and General Plan Amendments will not increase the number of lots within the Surfs ide Colony. The affected lots are presently utilizing the southerly 25 feet of the S-P right- of-way for Residential Low Density uses, namely detached garages and rear yards. 2. The proposal will not increase the density of development within Surfside. I 3. As conditioned by staff, the proposal will result in a more orderly use of the affected lots and provide for a decreased lot coverage of the affected lots and an increase in private open space on said lots. 4. As conditioned by staff, over time the proposal will result in a safer conditions for pedestrians, bicyclists and motor vehicles along surfside Avenue. Section 8. The Planning Commission held a duly noticed Public Hearing on October 3, 1990 and voted to recommend approval of General Plan Amendment 2a-90, and adopted Resolution Resolution Number IdJ8 No. 1602 to that effect. Section 9. hearing on January request. The City Council noticed a public 28, 1991, to consider evidence relating to the Section 10. The City council received into evidence the Report of the Planning Commission, including the Staff Report I dated October 3, 1990, Planning Commission Resolution No. 1603, and the Minutes of the Planning commission meeting of October 3, 1990. In addition, the City Council considered all oral evidence presented at the time of the public hearing. section 11. Based upon the evidence presented, the City Council hereby finds: 1. The proposed Zone Change and accompanying Zoning Text Amendment and General Plan Amendments will not increase the number of lots within the Surfs ide Colony. The affected lots are presently utilizing the southerly 25 feet of the S-P right- of-way for Residential Low Density uses, namely detached garages and rear yards. 2. The proposal will not increase the density of development within Surfside. 3.
