A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
APPROVING BUDGET AMENDMENT 21-10-03 TO FUND CITY
PAYMENTS FOR UTILITY COSTS FOR FISCAL YEARS 2015-
2016 THROUGH 2020-2021, INCLUSIVE, AND DIRECTING THE
CITY MANAGER TO TRANSFER THE APPROPRIATE FUND
AMOUNTS FOR THE CITY'S UTILITY SERVICES
WHEREAS, as a result of inquiries associated with the City's 2020 Water and
Sewer Rate Study, the City Manager directed staff to engage an independent
auditor to review billing and accounting transactions for the City's water and
sewer services; and
WHEREAS, the City retained Willis Consulting & Accounting to perform an
Agreed -Upon Procedures engagement to review the City's utility accounts and
accounting activity; and
WHEREAS, this independent review has determined preliminarily that the City
has not transferred funds to the Water and Sewer funds to pay for City use of
utility services in the past five fiscal years; and
WHEREAS, the City Manager and staff have recommended a plan to reimburse
the Water and Sewer funds for City utility bills for the current fiscal year and the
five fiscal years immediately preceding; and
WHEREAS, the City Council is directing the City Manager to ensure that all
payments are transferred for the current fiscal year and the five fiscal years
immediately preceding; and
WHEREAS, the City's failure to transfer funds in past years does not impact the
analysis in the 2020 Water and Sewer rate study, which assumes that the City
makes payments in fiscal year 2020-2021 and going forward.
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. The City Council hereby approves budget amendment 21-10-03 to
increase appropriations to pay for water, sewer, street sweeping and tree
trimming for City utility accounts for Fiscal Year 2020-21 and to repay the Water
Fund, Sewer Fund and General Fund for City utility costs in Fiscal Years
2019-20, 2018-19, 2017-18, 2016-17 and 2015-16, as specified in the staff
report.
Section 2. The Council hereby directs the City Manager to execute the payments
specified in the staff report, to implement the processes necessary to ensure that
the City continues to pay for its utility services in the future, and to submit the
final report of Willis Consulting & Auditing to the City Council when it is finalized.

regular meeting held on the 12th day of April, 2021 by the following vote:
