HomeMy WebLinkAboutCC Res 3876 1989-09-11 RESOLUTION NUMBER 58th A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ESTABLISHING HOURS AND LOCATION FOR AQUATIC ACTIVITIES PURSUANT TO SECTION 4-8 OF CHAPTER 4, ARTICLE I, OF THE SEAL BEACH CITY CODE. I section 4-8 of Chapter 4, Article I of the Seal Beach City Code provides that the City Council may specify use restrictions and regulate aquatic activities on or adjacent to the beach within the CitYl WHEREAS, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach: Section 1. Designated Swimming Areas. Restricted Swimming Areas. Swimming within the City of Seal Beach shall be regulated as follows: Swimming Permitted. Section 4-8(a) of the City Code designates as a swimming area that area of the Pacific Ocean within the territorial limits of the City and extending seaward two hundred (200) yards from the mean high tide line. Swimming is permitted all day, seven days a week, within this designated swimming area, except that the Supervising Lifeguard on duty has the authority to expand, restrict, confine or close the designated swimming area in the interest of public safety. Swimming seaward from this area from 8:00 a.m. to 6:00 p.m shall not be permitted. B. Swimming Prohibited. Section 4-8(b) of the City Code designates as a restricted swimming area the navigable waters of Anaheim Bay and the San Gabriel River. This restricted swimming area includes the Aquatic Sports Area and surf zones of the San Gabriel River delta. It shall be unlawful for any person to swim in these locations. This restriction shall not apply to any lifeguard, Lifeguard Trainees, City Employees, or Marine Safety Officer acting in the discharge of official duties, including but not limited to emergency rescue operations or training maneuvers. A. C. I Special Event Activities. Prior City approval, in writing from the City Manager or his designee, shall be required for special event activities extending either seaward of the designated swimming area or in areas designated as restricted swimming areas, including but not limited to Anaheim Bay and San Gabriel River. I 1 I I Section 2. Section 3. Resolution Number ~~~ Designated Summer Boardsurfing Areas. A. Boardsurfing Permitted. Boardsurfing within the City of Seal Beach during the period of June 15 to September 30, inclusive, is permitted as follows: 1. Seven days a week, all day, in the area bordered on the Northwest by the Easterly Alamitos Bay Marina jetty and bordered on the Southeast by the prolongation of Second Street. 2. Seven days a week, all day, in the area bordered on the Northwest by the Easterly Anaheim Landing jetty, and bordered on the Southeast by . ' the prolongatIon of Anderson Street, Surfs ide Colony. B. 3. Seven days a week, from sunrise to 10:00 a.m. and from 5:30 p.m. to sunset, in the area bordered on the Southeast by the Western line of the Municipal pier and bordered on the Northwest by Fourth Street. Boardsurfing Prohibited It shall be unlawful to boardsurf in the City of Seal Beach during the period of June 15 to September 30, inclusive, from 9:00 a.m. to sunset, in any area not specified above in Subsection A of Section 2 and in the area bordered on the Northwest by the Eastern line of the Municipal pier and bordered on the Southeast by the Westerly Anaheim landing jetty. c. Lifeguard Authority. Pursuant to Section 4-8 of the City Code, Supervising Lifeguards on duty have the authority to expand, prohibit, confine, or restrict boardsurfing under circumstances set forth therein. Designated Winter Boardsurfing Areas. Boardsurfing within the City of Seal Beach during the period of October 1 to June 14, inclusive, is permitted in the following areas, from sunrise to sunset, In the area bordered on the Northwest by the Easterly Alamitos Bay Marina jetty, and bordered on the Southeast by the Westerly Anaheim Landing jetty. B. In the area bordered on the northwest by the Easterly Anaheim Landing jetty, and bordered on the Southeast by the prolongation of Anderson Street, Surfs ide Colony. A. Pursuant to Sectlon 4-8 of the City Code, Supervising Lifeguards. on duty have the authority to expand, prohibit, confine, or restrict boardsurfing under circumstances set forth therein. Aquatic Sports. Unless otherwise restricted, boardsailing or other aquatic sports devices and/or equipment shall be regulated a follows: I A. Aquatic Sports Area Designated. The area bordered on the West by the prolongation of Second Street and bordered on the Southeast by the prolongation of Fourth Street is hereby designated as the Aquatic Sports Area. Aquatic activities such as boardsailing is permitted from sunrise to sunset in the Aquatic Sports Area. B. Prohibition. Boardsailing and other aquatic equipment or activities other than swimming, boardsurfing and belly boarding is not permitted within any designated area outside the Aquatic Sports Area. It shall be unlawful for any person to boardsail or engage in other aquatic activity, other than swimming, boardsurfing or belly boarding in any other area designated in this resolution. I C. Life~uard Authority. Pursuant to Sectlon 4-8 of the City Code, Supervising Lifeguards on duty have the authority to expand, prohibit, confine, or restrict aquatic sports under circumstances set forth therein. Violation. Violation of this resolution is a violation of Ordinance Number 1277 and is punishable as a misdemeanor. Severability. If any section, subsection, sentence, clause, phrase, or portion of this resolution, or the application thereof to any person, firm, corporation or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this resolution. The City Council of the City of Seal-Beach hereby declares that it would have adopted this resolution and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentence, clause, phrase, or portion thereof, may be declared invalid or unconstitutional.
