A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, DESIGNATING ORANGE
COUNTY HEALTH CARE AGENCY AS ENFORCEMENT
AGENCY FOR THE PROVISION OF THE Z' BERG
KAPlLOFF SOLID WASTE CONTROL ACT OF 1976

I THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY RESOLVES:
WHEREAS, in 1977, the Z'Berq-Kapiloff Solid Waste Control Act of
1976 went into effect, enablinq county board of
supervisors throuqhout California to establish Local
Enforcement Agencies (LEA'S) for the purpose of
enforcing State Solid Waste Management Laws; and
WHEREAS, in August, 1977, the Orange County Board of Supervisors
designated as its LEA, a board consisting of
representatives of the County's General Services
Agency, Environmental Management Agency and Health Care
Agency together with the Vector Control District, the
League of Cities, the Sanitary Districts and private
waste haulers; and
WHEREAS, in May of 1989, the California Waste Management Board
determined that the Orange County local enforcement
agency was not in accordance with the requirements of
Government Code Section 66796(3) and directed Orange
County Board of Supervisors to abolish the existing LEA
and designate a County department to fill that
function; and
WHEREAS, in response to concern about the loss of city input
into the LEA function reSUlting from disbandment of the
existing agency, the Orange County Division, League of
California Cities, has secured an agreement with the
Orange County Board of Supervisors whereby the Orange
County Waste Management Commission will review each
year the budge and work program and any changes to
either during the year, for the LEA within the Health
Care Agency; and

WHEREAS, the Orange County Division, League of California
Cities, is satisfied that the agreed upon arrangement
preserves the opportunity for city input through the
Waste Management Commission, while allowing for the
designation of the Health Care Agency as the Orange
County local enforcement agency.
WHEREAS, the Orange County Health Care Agency possesses the
required capabilities in environmental health and solid
waste management to implement the Z'Berg-Kapiloff Solid
Waste Control Act of 1976 and the regUlations and
ordinances that have been and will be adopted pursuant
thereto; and
WHEREAS, it is required by law that the designated enforcement
agency be approved by a majority of the cities of
Orange County containing a majority of the citizens of
the incorporated areas.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Seal Beach does hereby approve of establishing the Orange
County Health Care Agency for the purpose of enforcing State
Solid Waste Management laws.
