NOTICE REGARDING PUBLIC OBSERVATION AND PARTICIPATION IN THE CITY COUNCIL MEETING To comply with Governor Newsom's Executive Order N-29-20 and the Amended Order and Guidance of the Orange County Health Officer issued March 18, 2020 the City of Seal Beach hereby gives notice of the "means by which members of the public may observe the meeting and offer public comment" for the City Council meeting on August 9, 2021. Due to the need for social distancing and the prohibition on public gatherings set forth in the County Health Officer's Order, all participation in the above - referenced Meeting will be by teleconference for the Members of the City Council and staff. AYES: Kalmick, Varipapa, Moore, Sustarsic, Massa-Lavitt NOES: None ABSENT: None ABSTAIN: None Motion carried PRESENTATIONS / RECOGNITIO • Introduction of Water Operator Joseph Santoyo ORAL COMMUNICATIONS Mayor Kalmick opened oral communications. City Clerk Harper announced that one emailed comment and one comment via US mail was received. Mayor Kalmick then closed oral communications. CITY ATTORNEY REPORT City Attorney Steele had no report. CITY MANAGER REPORT City Manager Ingram announced that the City of Seal Beach received its first payment from the new American Rescue Plan Act (ARPA). The first payment was over $2.8 million, which represents 50% of the amount allocated to the City of Seal Beach. The second half is expected to be distributed to the City in July 2022. ARPA provides funding to state and local governments directly for relief for responding to COVID-19. The U.S. Department of Treasury is still issuing guidance on how these funds can be used, so the funds have not been programmed for anything specific as of yet; however, the funds have been set aside in a separate fund. More information is expected in the coming weeks and Finance Director Kelly Telford will plan to give an update on these funds as well as others in a COVID-19 Funding Update Presentation at the August 9, 2021 Council meeting. COUNCIL COMMENTS Mayor Pro Tem Varipapa indicated that he attended the Community Pool Ad Hoc Committee meeting. He noted that the Committee talked about past efforts and set the stage for the next meeting. He attended the concert in the park and thought it was well received, and guests appeared to be having a good time. Council Member Massa-Lavitt provided an Orange County Vector Control Board update. West Nile Virus remains tapered in Orange County. She indicated that the Board received a request from the City of Seal Beach regarding a rodent issue at the Pier. OC Vector assessed the issue and will work with City staff to remedy the issue. She indicated that she attended the Orange County Sanitation District meeting and noted that the District is moving forward with several projects. She reminded drivers to use caution when traveling between Westminster Blvd and Bolsa Chica Rd as projects continue to be worked on. Council Member Sustarsic indicated that she attended the 4th of July event at Heather Park sponsored by the College Park East Neighborhood Association. She thanked Orange County Fire Authority (OCFA) Garden Grove Station for participating and giving the children a tour the fire engine. She indicated that she attended the 4t" of July Joint Forces Training Base (JFTB) event as well and thanked them for sponsoring a great drive-thru event. She reported that the U.S. Olympic Water Polo team is off to a great start and noted that they are headquartered at the JFTB. She thanked Recreation Coordinator Anthony Nguyen for organizing pick-ups for Food Finders in Edison Gardens. She noted that it is a great idea, as the program helps to eliminate food waste and assists those experiencing food insecurities. Council Member Moore indicated that he and Mayor Kalmick met with Supervisor Foley to discuss the parking issue at the condominiums on Montecito Rd. He noted that there are plans to meet with her again next month in an effort to work with the County to help with parking solutions in the area. He thanked Supervisor Foley and Mayor Kalmick for their assistance in reviewing the parking issue. Mayor Kalmick announced that Congresswoman Steel made the final push, along with the work of the previous Congresspersons and the Surfside community, to receive the appropriation of $15.5 million for sand replenishment. He noted that the appropriations will also help to nourish the beaches in Huntington Beach and Newport Beach. He announced that he attended the Los Cerritos Wetlands Authority meeting and noted that the Wetlands Restoration project that will be in Seal Beach on the Hellman Ranch property has gotten the initial funding to start the plans for the restoration. Approval of the June 28, 2021 City Council Minutes - That the City Council approve the minutes of the Closed Session and Regular City Council meeting held on June 28, 2021. B. Authorizing the City Manager to approve additional work requests up to the total amount of $20,000 in connection with the Project. H. Notice of Completion for Navy Reservoir External Cathodic Protection System Improvements, CIP WT2107 - That the City Council adopt Resolution 7175: 1. Accepting the Navy Reservoir External Cathodic Protection System Improvements, CIP WT2107, by J&L Constructors, Inc. in the amount of $63,927.05; and, 2. Directing the City Clerk to file a "Notice of Completion" with the Orange County Clerk -Recorder within fifteen (15) days from the date of acceptance and to release retention 35 days after recordation of the Notice of Completion contingent upon no claims being filed on the Project. Awarding and Authorizing the City Manager to Execute a Professional Maintenance Services Agreement with ACCO Engineered Systems, Inc. for HVAC Maintenance and Repair Services - That the City Council adopt Resolution 7176: 1. Approving and awarding a professional maintenance services agreement with ACCO Engineered Systems, Inc., in the amount of $60,598.58 to provide HVAC Maintenance and Repair Services for a one-year term; and, 2. L. Approve the Memorandum of Understanding with the Seal Beach Marine Safety Management Association for the Period of July 1, 2021 through June 30, 2024 - That the Council adopt Resolution 7179: 1. Council Member Massa-Lavitt moved, second by Council Member Sustarsic to adopt Resolution 7185 approving the Articles of Incorporation and Initial Bylaws for the Seal Beach Historic Resources Foundation and directing the City Clerk to file the Articles of Incorporation with the Secretary of State; and, to appoint the initial five members of the Board of Directors; and direct staff to determine the solicitation process for appoint the initial Board of Directors. Discussion Regarding Proposed Amendment to the Seal Beach Municipal Code 8.20.015 Head in Parking Only — Council Member Moore requested discussion of this item, and there was Council consensus at the May 24, 2021 Council meeting, to direct staff to bring this item back to Council for discussion. That the City Council consider the proposed amendments to the City's "head in" parking regulations and: 1. Adopt Ordinance 1691 providing an exception to "head in" parking requirements for certain vehicles parked in beach parking lots; or, 2. Provide alternate direction to staff. Police Chief Gonshak provided a comprehensive background on the staff report and responded to Council Member questions. Council Member Moore moved, second by Council Member Sustarsic to approve for introduction and the first reading of Ordinance 1691 of the City of Seal Beach to amend Chapter 8.20 of the Seal Beach Municipal Code to amend Regulations for `Head in' Parking in the City Beach Parking Lots and to schedule the second reading of Ordinance 1691 for the August 9, 2021 City Council Meeting. The City Council of the City of Seal Beach does hereby find, determine, and declare that: A. On May 17, 2021, the Planning Commission considered this Ordinance at a duly noticed public hearing, as prescribed by law, at which time City staff and interested persons had an opportunity to and did testify either in support of or against this matter. B. At the conclusion of the Planning Commission hearing and after due consideration of the testimony, the Planning Commission adopted Resolution No. 21-1, recommending approval of the Ordinance by the City Council. C. The City Council, at a regular meeting, considered the Ordinance on June 28, 2021, at a duly noticed public hearing, as prescribed by law, at which time City staff and interested persons had an opportunity to and did testify either in support of or against this matter. D. Following the public hearing, the City Council considered the entire record of information received at the public hearings before the Planning Commission and City Council. Section 3. Findings. In approving the proposed Zoning Code amendment, the City Council hereby makes the following findings that the Ordinance is consistent with the General Plan as follows: A. The proposed Code Amendment is consistent with the following General Plan Land Use Element Goals and Policies in that accessory dwelling units improve and expand housing opportunities and housing choice: 1. Features of the Community: A goal of the City is to maintain and promote those social and physical qualities that enhance the character of the community and the environment in which we live. 1 2. Housing: It is to be a goal of the City to preserve its low- and medium -density residential character while still providing a wide choice of living accommodations and lifestyles for its residents. B. The proposed Ordinance is consistent with the following City's General Housing Element Goals and Policies in that it will: facilitate the development of a variety of housing types for all income levels to meet the existing and future needs of residents; assist in the development of adequate housing to meet the needs of low- and moderate -income households; address, and where appropriate and legally possible, remove governmental constraints to the maintenance, improvement and development of housing; and encourage more efficient energy use in residential developments. 1. Goal 1: Facilitate the development of a variety of housing types for all income levels to meet the existing and future needs of residents. The proposed Ordinance will allow and facilitate the provision of a broader spectrum of ADUs and hence housing types available to lower income, senior and special needs households. 2. Program lc: Second Units: Continue to allow for the development of second units consistent with state law and the Municipal Code. The proposed Ordinance will continue to allow second units (ADUs) consistent with state law. 3. Goal 2: Assist in the development of adequate housing to meet the needs of low- and moderate -income households. The proposed Ordinance will allow and facilitate the provision of ADUs thereby adding additional housing units available to low- and moderate -income households. 4. Policy 2a: Expand housing opportunities for households with special needs, such as the elderly, disabled, large households, female -headed households, and the homeless. The proposed Ordinance will allow and facilitate the provision of ADUs thereby adding additional housing units available to households with special needs, such as the elderly, disabled, large households, female -headed households, and the homeless. 5. Policy 2b: Provide incentives for and otherwise encourage the development of new affordable housing for low- and moderate -income households, including extremely -low-income persons. The proposed Ordinance will facilitate and incentivize the provision of a broader spectrum of ADUs, through relaxed development standards, and hence encourage the development of additional housing available in particular to lower income households. 6. Policy 2d: Direct the construction of low- and moderate -income housing to sites that are: 4 • located with convenient access to schools, parks, public transportation, shopping facilities, and employment opportunities; • adequately served by public utilities; • adequately served by police and fire protection; • compatible with surrounding existing and planned land uses; • minimally impacted by noise, flooding, or other environmental constraints; and • outside of areas of concentrated lower-income households. The proposed Ordinance will facilitate and incentivize the provision of a broader spectrum of ADUs throughout all the City's residential communities thereby assuring they are allowed and encouraged in areas appropriate for residential use in a manner that does not result in undue concentration of lower income households. C. The proposed amendments are also consistent with Chapter 3 of the Coastal Act, will not have an impact either individually or cumulatively on coastal resources, and do not involve any change in existing or proposed use of land or water. Section 4. Chapter 11.4.05.115 (Residential Uses - Accessory Dwelling Units) of Title 11 of the Seal Beach Municipal Code is hereby amended in its entirety to read as follows: "Sec. 11.4.05.115. - Accessory dwelling units. A. Purpose and applicability. The purpose of this chapter is to implement the requirements of Government Code Sections 65852.2 and 65852.22 to allow accessory dwelling units and junior accessory dwelling units in a manner that encourages their development but simultaneously minimizes impacts on traffic, parking, density, and other areas where the City is still permitted to exercise local control. B. Definitions. For the purposes of this section, the following definitions apply. (1) "Attached ADU" means an ADU that is constructed as a physical expansion (i.e. addition) of the Primary Dwelling and shares a common wall with the Primary Dwelling. (2) "Detached ADU" means an ADU that is constructed as a separate structure from the Primary Dwelling, which does not share any walls with the Primary Dwelling. (3) "Existing structure" means an existing single-family dwelling, duplex or other accessory structure that can be safely converted into habitable space under the California Building Standards Code, as amended by the City, and other applicable law. (4) "Junior Accessory Dwelling Unit" or "JADU" has the same meaning ascribed in Government Code Section 65852.22, as the same may be amended from time to time. JADU standards apply to properties containing a Primary Dwelling. 3 (5) "Multi -family Dwelling" for purposes of this chapter, means a property containing three (3) or more attached dwelling units. Multiple separate residential structures on the same lot do not qualify as a multi -family building. (6) "Primary Dwelling," for purposes of this chapter, means the existing or proposed single-family dwelling or duplex on the lot where an ADU would be located. (7) "Public transit," for purposes of this chapter, has the meaning ascribed in Government Code Section 65852.20), as the same may be amended from time to time. C. Building permit approval only. (Tier 1) (1) An accessory dwelling unit application is not required to be filed with the Community Development Director for an ADU or JADU that satisfies the requirements of subsection C(2) of this section (Government Code Section 65852.2(e)(1), as the same may be amended from time to time), subsections (G), (H), and (I) of this section, and Title 8, Building and Construction, of the Seal Beach Municipal Code. A Building Permit application is required to be filed with the Building and Safety Department. (2) Pursuant to Government Code Section 65852.2(e), the City shall ministerially approve an application for a building permit on a lot that is zoned to allow single family or multi -family residential use to create any of the following: (a) ADU and JADU within Primary Dwelling and ADUs within existing accessory structures. One ADU and one JADU per lot with a proposed or existing single-family dwelling if all of the following apply: (i) The ADU or JADU is within the proposed space of a single-family dwelling or existing space of a single-family dwelling or accessory structure and may include an expansion of not more than 150 square feet beyond the same physical dimensions as the existing accessory structure. An expansion beyond the physical dimensions of the existing accessory structure shall be limited to accommodating ingress and egress. (ii) When an ADU is attached to a single-family dwelling, the ADU shall have exterior access from the proposed or existing single-family dwelling. (iii)The side and rear setbacks are sufficient for fire and safety. (iv)The JADU complies with the requirements of Government Code Section 65852.22 and with the requirements set forth in subsection (F) of this section. 4 (b) Detached new construction ADUfor Primary Dwelling. One detached, new construction ADU for a lot with a proposed or existing single-family dwelling if all of the following apply. The ADU may be combined with a JADU described in subsection (C)(2)(a) of this section. (i) The ADU shall be no more than 800 square feet in size. (ii) The ADU shall not exceed a height limit of 16 feet. (iii) The ADU shall be setback a minimum of four feet from side and rear lot lines. However, in districts which allow lesser side setbacks, the lesser shall apply. (c) ADU within non -livable space in existing multifamily dwelling. One ADU within the portions of existing multifamily dwelling structures that are not used as livable space, including, but not limited to: storage rooms, boiler rooms, passageways, attics, basements, or garages, if each unit complies with state building standards for dwellings. If requested, multiple ADUs shall be allowed, up to the number of ADUs that equals 25 percent of the existing multifamily dwelling units in the structure. (d) Detached new construction ADUs for existing multifamily dwelling. Not more than two detached ADUs located on a lot that has an existing multifamily dwelling, subject to a height limit of 16 feet and minimum four - foot rear yard and side setbacks. However, in districts which allow lesser side setbacks, the lesser shall apply. Multiple separate residential structures on the same lot do not qualify as a multi -family building. D. Planning permit application. (Tier 2) (1) An accessory dwelling unit application is required to be filed with the Community Development Director for an ADU that does not satisfy the requirements of subsection (C)(2) of this section. An accessory dwelling unit application shall be made in writing to the Community Development Director on the forms provided by the Planning Department, shall be accompanied by the filing fee as established by resolution of the City Council, and shall include the following information: (a) Name and address of the applicant. (b) Completed Owner's Affidavit. (c) Assessor's parcel number(s) of the property. (d) A site plan drawn in sufficient detail to clearly describe the following: (i) Physical dimensions of the property. 5 (ii) Location and dimensions of all existing and proposed structures, walls, and fences. (iii)Location and dimensions of all existing and proposed easements, septic tanks, leach lines, seepage pits, drainage structures, and utilities. (iv)Location, dimensions, and names of all adjacent roads, whether public or private. (v) Setbacks. (vi)Existing and proposed methods of circulation, including ingress and egress, driveways, parking areas, and parking structures. (vii) Panoramic color photographs showing the property from all sides and showing adjacent properties. (viii) A description of architectural treatments proposed for the ADU. (ix)Written confirmation from any water district or sewer district providing service of the availability of service. (e) Floor plans. For an attached ADU, the plans must include the Primary Dwelling, as well. (f) Elevations. For an attached ADU, the plans must include the Primary Dwelling as well. (g) Such additional information as shall be required by the Planning Director. (2) All ADUs shall satisfy the requirements of Title 8, Building and Construction, of the Seal Beach Municipal Code. A Building Permit application is required to be filed with the Building Department. (3) In accordance with State law, ADUs are an accessory use or an accessory structure to the Primary Dwelling on the lot. ADUs shall not be considered to exceed the allowable density for the lot. (4) The Community Development Director shall ministerially review and approve an accessory dwelling unit application, provided that the submitted application is complete and demonstrates that the ADU complies with the requirements contained in this chapter and any other applicable law. A public hearing is not required. (5) Accessory dwelling unit applications subject to ministerial approval shall be processed within the timelines established by California Government Code Section 65852.2. The City shall act upon the accessory dwelling unit permit within 60 days of receiving the application, or as the deadline required by n Government Code Section 65852.2, as the same may be amended from time to time. Notice of decision on the application shall be mailed to the applicant. The decision of the Community Development Director shall be final. (6) Where an accessory dwelling unit application for an ADU is submitted with an application for a Primary Dwelling that is subject to discretionary review under Title 9 of the Seal Beach Municipal Code, the accessory dwelling unit application shall be processed in accordance with this section, separately without discretionary review or a public hearing, following action on the portion of the project subject to discretionary review. E. Standards for ADUs. Except those ADUs approved pursuant to subsection (C) of this section (Building Permit Approval Only (Tier 1)), ADUs shall comply with the following development standards: (1) Location Restrictions: One ADU shall be allowed on a lot with a proposed or existing Primary Dwelling that is zoned to allow single family or multi -family residential use. (2) Development Standards: (a) Size restrictions. i. Attached ADU (Existing Primary Dwelling): ADU shall not exceed the lesser of. 1) fifty percent (50%) of the gross floor area for the Primary Dwelling or 2) 850 square feet in gross floor area if it contains one or fewer bedrooms or 1,000 square feet in gross floor area if it contains more than one bedroom. Notwithstanding the above, an ADU with a gross floor area between 1,001 and 1,200 square feet is allowed provided a minimum of one parking space is provided for the ADU. ii. Attached ADU (New Primary Dwelling): ADU shall not exceed 850 square feet in gross floor area if it contains one or fewer bedrooms or 1,000 square feet in gross floor area if more than one bedroom. Notwithstanding the above, an ADU with a gross floor area between 1,001 and 1,200 square feet is allowed provided a minimum of one parking space is provided for the ADU. iii. Detached ADU: ADU shall not exceed fifty percent (50%) of the gross floor area for the Primary Dwelling or 850 square feet in gross floor area if it contains one or fewer bedrooms or 1,200 square feet in gross floor area if more than one bedroom, whichever is less. iv. In no case shall the gross floor area of an ADU be less than that of an "efficiency unit" as defined in Health and Safety Code Section 17958.1. 7 (b) Height restrictions. A Detached ADU shall not exceed 16 feet in height, and an Attached ADU shall not exceed the height of the Primary Dwelling. An ADU may be constructed above a detached garage subject to the height limits of the underlying zone, subject to recordation of a declaration of restrictions, in a form approved by the City Attorney, agreeing to maintain the existing garage as functionally available for parking. (c) Setbacks. No setback shall be required for an ADU that is within a legally Existing Structure or new ADU that is constructed in the same location and with the same dimensions as a legally Existing Structure. For all other ADUs, the required minimum setback from side and rear lot lines shall be four feet, except in districts which allow lesser side setbacks, in which case the lesser shall apply. An ADU shall comply with all required front yard setbacks otherwise required by the Seal Beach Municipal Code. (d) Lot coverage. An ADU shall conform to all lot coverage requirements applicable to the zoning district in which the property is located, except where the application of the lot coverage regulations would not permit construction of an 800 -square -foot ADU that is 16 feet in height with at least four -foot side and rear yard setbacks, except in districts which allow lesser side setbacks, in which case the lesser shall apply. (e) Design. The ADU shall have the same design, architecture, colors and materials of the Primary Dwelling, and shall comply with any objective design standards adopted by the City that are applicable to the zoning district or Specific Plan area where the ADU is located. i. An ADU that is architecturally and aesthetically complimentary to the Primary Dwelling with regards to design, architecture, colors and materials may be considered subject to the City's minor use permit process. (f) Exterior access. An ADU shall have a separate exterior access. (g) Fire sprinklers. ADUs are required to provide fire sprinklers if required for the Primary Dwelling. (h) Historic resources. An ADU that has the potential to adversely impact any historical resource listed on the California Register of Historic Resources, shall be designed and constructed in accordance with the "Secretary of the Interior's Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring, and Reconstructing Historic Buildings" found at 36 CFR 68.3, as the same may be amended from time to time. An ADU shall also comply with all local historic register requirements, as well as all objective local requirements, ordinances, or Specific Plans that pertain to historic resources. (3) Parking Requirements: L-13 (a) In addition to the off-street parking space(s) required for the Primary Dwelling, one off-street parking space shall be provided for each ADU, except when: (i) The ADU is located within one-half mile walking distance of Public Transit; or (ii) The ADU is located within an architecturally and historically significant historic district; or (iii)The ADU is an attached ADU proposed with a new single-family development, or a proposed conversion of an existing Primary Dwelling or accessory structure; or (iv)The ADU is located in an area where on -street parking permits are required but not offered to an ADU occupant; or (v) The ADU is located within one block of a city -approved and dedicated parking space for a car share vehicle. (b) When the ADU is created by converting or demolishing a garage, carport or covered parking structure, replacement of parking space(s) eliminated by the construction of the ADU shall not be required as long as the ADU remains in use as a legal ADU. (4) Other provisions: (a) Recreational trailers are not permitted to be used as ADUs. This includes, but is not limited, to recreational vehicles and mobile/motor homes. F. Standards for JADUs. In accordance with the standards set forth in Government Code Section 65852.22, JADUs shall comply with the following requirements, unless State law is amended to set forth different standards in which case State law standards will govern: (1) A JADU shall be a minimum of 220 square feet and a maximum of 500 square feet of gross floor area. The gross floor area of a shared sanitation facility (bathroom) shall not be included in the maximum gross floor area of a JADU. (2) A JADU must be contained entirely within the walls of the existing or proposed single-family dwelling. (3) A separate exterior entry from the main entrance to the single-family dwelling shall be provided to serve a JADU. (4) A JADU may include a separate sanitation facility (bathroom), or may share sanitation facilities (bathroom(s)) with the existing single-family dwelling. 9 (5) A JADU shall include an efficiency kitchen which shall include all of the following: (a) A cooking facility with appliances. (b) A food preparation counter and storage cabinets that are of reasonable size in relation to the size of the JADU. (6) No additional parking is required for a JADU. G. Covenant required. Prior to the issuance of a Certificate of Occupancy for the ADU or JADU, the property owner shall record a declaration of restrictions, in a form approved by the City Attorney, placing the following restrictions on the property, the property owner, and all successors in interest: (1) The ADU or JADU shall not be sold, transferred, or assigned separately from the Primary Dwelling, but may be rented. (2) The ADU shall not be used for short-term rentals for less than 30 consecutive days. (3) If there is a JADU on the property, either the JADU or Primary Dwelling shall be occupied by the owner of record. H. Fees and utility connections. (1) ADUs and JADUs shall have adequate water and sewer services. These services may be provided from the water and sewer points of connection for the Primary Dwelling and not be a separate set of services. For an ADU that is not a conversion of an existing space, a separate utility connection directly between the accessory dwelling unit and the utility may be required. Consistent with Government Code Section 65852.2(f), the connection may be subject to a connection fee or capacity charge that shall be proportionate to the burden of the proposed accessory dwelling unit. (2) The owner of an ADU or JADU shall be subject to the payment of all sewer, water and other applicable fees, including impact fees set forth in Government Code Section 66000 et seq., except as follows: (a) ADUs that are less than 750 square feet shall not be subject to impact fees. (b) ADUs that are 750 square feet or more shall be charged impact fees that are proportional in relation to the square footage of the Primary Dwelling unit. (3) The City shall not issue a building permit for an ADU or JADU until the applicant provides a will serve letter from the local water and sewer provider. Notwithstanding the foregoing, if a private sewage disposal system is being used, the applicant must provide documentation showing approval by the 10 Building Official in lieu of the will serve letter by the local sewer provider. If a private well is being used, the applicant must provide documentation showing approval by the Building Official and Orange County Health Department in lieu of the will serve letter by the local water provider. I. Fire safety requirements. The construction of all new accessory dwelling units shall meet minimum standards for fire safety as defined in the Building Code of the City of Seal Beach and the Fire Code of the City of Seal Beach, as the same may be amended by the City from time to time. All applications for accessory dwelling units in areas designated as high or very high fire hazard zones shall be reviewed by the Building Official and Fire Marshal to ensure the standards for fire safety as defined in the Building Code of the City of Seal Beach and the Fire Code of the City of Seal Beach will be met. Fuel modification treatments (clearing requirements) will be greater for those properties in high and very high fire hazard severity zones, which may be characterized by steeper terrain, larger and denser fuels, fuels that are highly volatile, and subject to frequent fires. Clearing requirements shall meet the state's General Guidelines for Creating Defensible Space." Section 5. California Environmental Quality Act Exemption. The City Council determines that this ordinance is exempt from environmental review under the California Environmental Quality Act, (California Public Resources Code §§ 21000, et seq., ("CEQA") and the CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) because this zoning ordinance implements the provisions of Government Code Section 65852.2 and is therefore exempt from CEQA pursuant to Public Resources Code Section 21080.17 and California Code of Regulations Section 15282(h). To the extent that any provisions of this ordinance are not exempt pursuant to Section 15282(h), the amendments are not subject to CEQA pursuant to CEQA Guidelines Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Section 10. Submittal of Ordinance. The Planning Director shall submit a copy of the Ordinance to the Department of Housing and Community Development within 60 days after adoption of this Ordinance. Section 11. Severability. If any section, subsection, subdivision, sentence, clause, phrase, word, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, word, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, words or portions thereof be declared invalid or unconstitutional. Section 12. Certification. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted in the manner required by law. Section 13. SECTION 3. CEQA Findings. The City Council hereby determines that this Ordinance is exempt from the California Environmental Quality Act ("CEQA") because it can be seen with certainty that the adjustment of certain parking restrictions and requirements that already exist in the City is not a "project" under CEQA since such adjustments will not result in any physical change to the environment. SECTION 4. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this Ordinance or any part hereof. Adopt Resolution 7187 approving a Temporary Construction Easement Agreement with Old Ranch Country Club, LLC, and approving attorneys' fee reimbursement to Old Ranch Country Club, LLC of up to $6,000. BACKGROUND AND ANALYSIS: The Lampson Avenue Bike Lane Gap Closure Project received Active Transportation Program federal -aid transportation grant funding. The Project will be adding a bike lane in both eastbound and westbound directions along Lampson Avenue between Basswood Street and Seal Beach Boulevard. In compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (the Uniform Act), a Right -of -Way Certification is required to document property interests within the Project's limits. Two (2) easements were identified as part of this process: 1. A permanent easement at the intersection of Basswood Street at Lampson Avenue; and, 2. A temporary construction easement at the northeast corner of Lampson Avenue approaching Seal Beach Boulevard. Agenda Item F Grant of Permanent Easement On November 2, 1998, the City entered into a Bixby Old Ranch Towne Center Development Agreement where the Old Ranch Country Club main point of access was to be relocated to the Lampson Avenue and Basswood Street intersection. The signalized intersection was accordingly modified, where a portion of the traffic signal and pedestrian access was located on the Old Ranch Country Club private property. The easement documents for these improvements were inadvertently omitted at the time and are now being recommended for retroactive approval. Pursuant to Government Code Section 27281, the City shall execute and file a Certificate of Acceptance for the Grant of Permanent Easement with the Orange County Clerk -Recorder. Temporary Construction Easement Agreement (TCE Agreement) The Lampson Avenue Bike Trail Gap Closure Project will require a temporary construction easement from Old Ranch Golf Course. Although all permanent project improvements will be within the City's public right-of-way, the City needs to acquire an approximate 1,681 square -foot temporary construction easement on the Old Ranch Country Club property along Lampson Avenue east of Seal Beach Boulevard to provide adequate construction space. As shown in the TCE Agreement, the consideration to Old Ranch Country Club, LLC for the use of this temporary construction easement area for a term of 15 months includes the following: 1. Temporary construction area will be restored to pre -construction conditions or as stipulated on the Project plans; and, 2. Reimbursement of Old Ranch Country Club, LLC's attorneys' fees, up to $6,000, to review the easement documents. Old Ranch Country Club, LLC is supportive of the Lampson Avenue Bike Lane Gap Closure and has waived the formalities for appraisal and just compensation for the TCE, but is asking for reimbursement up to $6,000 for the cost of attorney's fees incurred to review the easement documents. Staff finds the request reasonable. Construction is anticipated to start on or after February 1, 2022, at which the term of the temporary construction easement will start. Under the TCE Agreement, the easement term is 15 months from the start date, if not terminated earlier. ENVIRONMENTAL IMPACT: This item is not subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15061(b)(3) of the state CEQA Guidelines because it can be Page 2 seen with certainty that approval of easement documents will not have a significant effect on the environment. Environmental impacts related to the project construction will be assessed under a separate effort. LEGAL ANALYSIS: The City Attorney has reviewed the easement documents and approved the resolutions as to form. FINANCIAL IMPACT: The consideration from the City to Old Ranch Golf Course, LLC for the Temporary Construction Easement includes attorneys' fee reimbursement incurred by Old Ranch Golf Course, LLC to review documents related to the easement, up to $6,000. TEMPORARY CONSTRUCTION EASEMENT AGREEMENT This Temporary Construction Easement Agreement ("TCE Agreement") is entered into by and between OLD RANCH COUNTRY CLUB, LLC, a California limited liability company ("Grantor") and the CITY OF SEAL BEACH, municipal corporation ("City"). Grantor and the City may be referred to collectively below as the "Parties". This TCE Agreement is based on the following facts, which are incorporated herein by this reference: A. Grantor is the record fee owner of that certain real property located at 3901 Lampson Avenue, in the City of Seal Beach, California, and identified as Orange County Tax Assessor's Parcel Numbers 130-012-55 and 130-012-58 ("Property"), and C1ubCorp USA, Inc., operates the Property for Grantor ("Operator"). B. Grantor wishes to grant to the City and the City wishes to acquire from Grantor an approximate 1,681 square foot non-exclusive temporary construction easement to facilitate the City's construction of the Lampson Avenue Bike Lane Gap Closure Project ("Project"), which is a public use. The Project will create a bike lane along the northerly and southerly sides of Lampson Avenue between Basswood Street and Seal Beach Boulevard. NOW THEREFORE, for a valuable consideration, receipt and sufficiency of which are hereby acknowledged, Grantor and the City agree to the following: 1. Grant of 1,681 Square Foot Temporary Construction Easement. Grantor hereby grants to the City, its contractors, agents, representatives, employees, and all others reasonably deemed necessary by the City ("City Designees"), that certain approximate 1,681 square foot non-exclusive Temporary Construction Easement more particularly described on -1- EXHIBIT A and depicted on EXHIBIT B hereto ("TCE") in, over, under and across the Property to facilitate the City's construction of the Project. EXHIBIT A and EXHIBIT B are attached hereto, and incorporated herein by this reference. 2. Term. The term of the TCE will commence on February 1, 2022 ("Commencement Date") and will terminate automatically fifteen (15) months from the Commencement Date ("Termination Date"), if not terminated earlier in accordance with this Section 2. The City is authorized to use the approximate 1,681 square foot TCE from the Commencement Date to the Termination Date to facilitate the City's construction of the Project. The TCE will expire on the earlier of (i) the Termination Date or (ii) the date on which the City records a notice of termination of the Temporary Construction Easement in the Official Records of the County of Orange. 3. Scope of Temporary Construction Easement. The 1,681 square foot TCE is for the use by the City Designees for the term set forth in Section 2 to facilitate the City's construction of the Project, including construction of the bike lane improvements, irrigation system improvements, and appurtenances. 4. Prohibited Uses. Notwithstanding anything to the contrary contained herein, under no circumstances shall the City, at any point, (a) tear down any portion of the fence surrounding Grantor's Property, it being understood that the fence serves crucial security purposes for the Property (for example, by preventing golf balls from leaving the Property and endangering neighboring property), and (b) use the TCE is such a way as to adversely affect Grantor's use of its Property. 5. Compensation for Grant of TCE. The consideration from City to Grantor for the grant of this TCE Agreement includes reimbursement to Grantor for attorneys' fees incurred by Grantor in connection with the review of documents related to the TCE Agreement. Grantor agrees that the fulfillment of the City's obligations at the end of this term as set forth in Section 7 below together with other valuable consideration received from the City constitutes the total and complete consideration and compensation for Grantor's grant of the TCE to the City pursuant to the terms of this Agreement. 6. No Liens. The City agrees to keep the approximate 1,681 square foot TCE and the Property free of any liens, including without limitation, liens by contractors, subcontractors, or suppliers, engineers, architects, surveyors, or others that may have lien rights for work arising out of the City's use of the TCE in connection with the construction of the Project. If any such lien is filed on the TCE or any portion of the Property in connection with the City's use of the TCE, the City will, at its sole cost and expense, have the lien released and discharged of record in a matter satisfactory to Grantor within 30 calendar days of receiving notice of the lien. If the City fails to remove the lien within such 30 -day period, Grantor will have the right to remove or bond over the lien, and the City, upon demand, will reimburse Grantor for all reasonable costs and expenses, including without limitation reasonable attorneys' fees incurred by Grantor in connection with such removal or bond. The City's obligations set forth in this Section 6 shall survive the termination of the TCE and the termination of this TCE Agreement. -2- 7. City's Oblifzations at End of Term. The City agrees that as of the termination date, the City will leave and restore the TCE in as close as possible to the condition in which said TCE existed at the Commencement Date. Further, upon the expiration of the term of the TCE, the City agrees to take such actions as necessary to evidence and give effect to the extinguishment of the TCE and the relinquishment of the City's rights and interests in the TCE pursuant to this TCE Agreement. This includes, without limitation, the recording by the City of such termination or extinguishment in the form and substance that is reasonably acceptable to Grantor and sufficient to remove this TCE Agreement as an encumbrance against title. The City's obligations set forth in this Section 7 shall survive the termination of the TCE and the termination of the TCE Agreement. 8. Insurance. Prior to entry onto, or use of, the approximate 1,681 square foot TCE area, the City will cause the City's contractor for the Project to procure and maintain a policy of commercial general liability insurance issued by an insurer reasonably satisfactory to Grantor covering the use by and activities of the City and the City's Designees with a single limit of liability (per occurrence and aggregate) of not less than $2,000,000, and to deliver to Grantor a certificate of insurance and copy of additional insured endorsement naming Grantor and Operator as named additional insureds, evidencing that such insurance is in force and effect, and evidencing that Grantor and Operator have been named as an additional insured thereunder with respect to the use by the City and the City's Designees of the TCE. Such insurance will be maintained in force throughout the term of this TCE. 9. Indemnification. The City hereby agrees to indemnify, defend and hold Owner and Operator, each of their successors and assigns, and their respective officers, directors, employees, members, guests, clients and agents harmless from and against all claims, demands, proceedings, losses, actions, damages, suits, liabilities and expenses (including reasonable attorneys' fees), to the extent arising out of the City's use of the TCE. The City's obligations set forth in this Section 9 shall survive the termination of the TCE and the termination of this TCE Agreement. 10. Notices. All notices and demands will be given in writing by certified mail, postage prepaid, and return receipt requested, by personal delivery, or by Federal Express. Notices will be considered given upon the earlier of (a) personal delivery, (b) two business days following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, or (c) one business day following deposit with an overnight carrier. This TCE Agreement is deemed to have been prepared by each of the Parties hereto, and any uncertainty or ambiguity herein shall not be interpreted against the drafter, but rather, if such uncertainty or ambiguity exists, shall be interpreted according to the applicable rules of interpretation of contracts under the laws of the State of California, and not the substantive law of another state or the United States or federal common law. Entire Agreement. This TCE Agreement contains the entire agreement between Grantor and the City regarding the City's use of the TCE area to facilitate the construction of the Project. No person is authorized to make, and by execution hereof Grantor and the City acknowledge that no person has made, any representation, warranty, guaranty or promise except as set forth herein; and any such agreement, statement, representation or promise not contained in this TCE Agreement will not be binding on Grantor or the City. C. Amendments. Any amendments to this TCE Agreement will be effective only by a writing executed by all Parties to this TCE Agreement that will be recorded by the City in the Official Records of the County of Orange. d. Successors and Assigns. This TCE Agreement will be binding upon and inure to the benefit of the heirs, executors, administrators, successors and assigns of the Parties hereto. e. Counterparts. This TCE Agreement may be executed in whole or in counterparts, which together shall constitute the entire Agreement. f. Legal Representation. Each of the Parties acknowledge that in connection with the negotiation and execution of this TCE Agreement, they have each been represented by independent counsel of their own choosing and the Parties executed this Agreement after review by such independent counsel, or, if they were not so represented, said non - representation is and was the voluntary, intelligent and informed decision and election of any of ie the Parties not so represented. The Parties further acknowledge that, prior to executing this TCE Agreement, each of the Parties has had an adequate opportunity to conduct an independent investigation of all the facts and circumstances with respect to the matters that are the subject of said Agreement. g. Attorneys' Fees. If either of the Parties hereto incurs attorneys' fees in order to enforce, defend or interpret any of the terms, provisions or conditions of this TCE Agreement or because of a breach of this TCE Agreement by the other party, the prevailing party, whether by suit, negotiation, arbitration or settlement will be entitled to recover reasonable attorneys' fees from the other party. h. Severability. Ingram, City Manager FROM: Barry Curtis, Interim Director of Community Development SUBJECT: Local Coastal Program — Land Use Plan, Coastal Commission Comments SUMMARY OF REQUEST: That the City Council consider the five issue items identified in the staff report and provide feedback and further guidance to the Staff team. BACKGROUND AND ANALYSIS: The Staff team presented this item to the City Council on June 28, 2021. After discussion, the Council indicated a desire for additional time to consider the issues and directed staff to return at a later date where the Council could work through each of the items. The City of Seal Beach has been awarded $217,000 in grants from the California Coastal Commission (CCC) to prepare a draft Local Coastal Program (LCP) — Land Use Plan (LUP) (cumulatively, the "LCP"). Staff has retained the services of Michael Baker International (Michael Baker) to assist in preparation of the draft LCP. A certified LCP will provide benefits to the City of Seal Beach, including satisfying the California Coastal Act requirement that local governments lying with the coastal zone shall prepare an LCP. Certification of an LCP would grant the City permitting issuance authority within the coastal zone, streamline the permitting process, and significantly improve the efficiency of Seal Beach staff review and Coastal Commission staff review. Furthermore, an LCP allows community-based policies to guide development activities and resource protection, ensuring the City's vision is reflected. Under an LCP, the City would control local decision- making in accordance with the Coastal Act. The City submitted a draft LCP-LUP to the CCC in December 2019. The CCC provided comments back in March and June of 2020. Michael Baker has incorporated the majority of the CCC's comments into the Seal Beach LUP, with the exception of the five comments discussed below. The City team is seeking Agenda Item G feedback and further guidance from the City Council, as specified in the following policy discussion sections. Michael Baker is committed to preparing an LCP that accomplishes the goals and objectives of Seal Beach and attains California Coastal Commission (CCC) certification. Below are the comments and suggested policy revisions provided by the CCC, as well as analysis and recommendations from Michael Baker staff for addressing the CCC comments. Key to CCC Comments Existing policy text is in bold CCC requested text is in underline CCC notes are in italic COMMENT #1 — SEA LEVEL RISE Policy 5.1.1-4: Development shall be sited and designed to avoid hazards associated with projected sea level rise over the anticipated duration of the proposed development, considering the best available science. If complete avoidance is infeasible, the project shall be sited and designed to minimize hazards to the extent feasible. Project applications shall be assessed for vulnerability including but not limited to, tidal action, waves, and storm surge, and erosion, considering sea level rise. If a project is determined to be vulnerable to coastal hazards, require an adaptation strategy that ensures the safety and stability of the structure and does not rely on hard armoring shoreline protective devices, such as increasing the elevation of the structure and floodproofing. When establishing safety, new development and redevelopment shall not rely on existing shoreline protective devices that substantially alter natural landforms along bluffs and cliffs or otherwise harm coastal resources in a manner inconsistent with LCP policies or Coastal Act public access policies, and not contribute significantly to erosion, geologic instability, or destruction of the site or surrounding area. Some edits were needed to clarify that new development should be sited to avoid coastal hazards, including hazards impacted by sea level rise over the anticipated life of the development. If hazards cannot be completely avoided, hazard should be minimized to the extent feasible. Policy 5.2.3-7: Prohibit the use of shoreline protective devices to protect newly authorized development and redevelopment. Page 2 As a condition of approval of such development, applicants shall also waive any rights to construct such devices that may exist under applicable law. Staff Analysis: Both CCC recommended policy inclusions would formalize Coastal Act Section 30235 (Construction Altering Natural Shoreline) into the Seal Beach LCP. Generally, the CCC will only permit shoreline protective devises when required to serve coastal -dependent land uses or protect existing structures/public beaches (provided the protective devices mitigate adverse impacts to shoreline erosion and sand supply). Additionally, both policy inclusions would formalize Coastal Act Section 30253 (Minimization of Adverse Impacts) into the LCP. Since at least the late 1990's, the CCC has required many new developments to include deed restrictions that specifically prohibit future construction of shoreline protection'. The intent behind this waiver is to internalize the risks of building in an inherently hazardous location. Residents in Seal Beach are subject to both Coastal Act requirements when they permit projects through the CCC. COMMENT #2 — LAND DIVISIONS SEA LEVEL RISE Section 2.2.1 should include policies that prohibit land divisions where shoreline armoring would be required and where coastal resource impacts occur. Two policies are listed below as examples: a. Land divisions, including subdivisions, lot splits, lot line adjustments, and certificates of compliance which create new beachfront lots, shall not be permitted unless the subdivision can be shown to create lots which can be developed without requiring a current or future shoreline protection structure. No new lots shall be created that could require shoreline protection or bluff stabilization structures at any time during the full anticipated lifespan of the development. b. Land divisions, including subdivisions, lot splits, lot line adjustments, and certificates of compliance, shall only be approved through a Coastal Development Permit where they are designed to avoid impacts to coastal resources to the maximum extent feasible, including public access and recreation, environmentally sensitive habitat areas ("ESHA"), and visual resources, or minimize such impacts where coastal resource impacts cannot be avoided. Land Divisions shall be prohibited where any proposed parcel will not be safe from flooding, fire, erosion, and geologic hazards, or where a property requires development within or adjacent to ESHA, unless consistent with the coastal resource protection policies of the LCP. California Coastal Commission, Sea Level Rise Policy Guidance, Final Adopted Science Update, November 7, 2018. Page 3 Staff Analysis: CCC policy and case law confirm that subdivisions/lot splits/lot line adjustments constitute a development under the Coastal Act and require a Coastal Development Permit (CDP).2 Similar to how the City must prohibit construction in known hazardous areas without mitigation, the Coastal Act requires findings to confirm development will be safe from coastal hazards. The first policy recommendation is specific to beachfront lots, and Michael Baker's recommendation would be to also include a specific definition as to what constitutes a beachfront lot in the LCP. As mentioned previously, the waiver of shoreline protection devices has been applied in CDPs since the late 1990's and would also be applied to subdivisions/lot splits/adjustments. The second policy recommendation would require all applicants to demonstrate their project is designed to avoid/mitigate flooding hazards (including potential flooding hazards associated with sea level rise), fire, erosion (including coastal erosion) and geologic hazards. At the time of permit issuance, the City would be required to include findings consistent with this policy. COMMENT #3 — SURFSIDE COLONY, PUBLIC ACCESS Part 1 We would like to discuss how public access is provided to Surfside overall and via the Surfside Colony gated community, and whether the example policy below should be included in some form in the LUP: Plan for expansions, where feasible, in public access to the shoreline and the public sandy beach area seaward of the Surfside Colony gated community. Part 2 The third paragraph of Section 3.1.3 of the draft LUP states that "the Surfside Colony is a long-established neighborhood, and new development is generally the type and scale that does not have a direct adverse impact on existing public access or coastal resources. New development generally consists of additions, or redevelopment of residential structures in a similar nature to existing development." We note that new development and redevelopment proposals in the Surfside Colony would require a CDP and thus findings of consistency with the LCP and Coastal Act, including determining that existing public access is not impacted, which may be problematic given the existing public access restrictions in this neighborhood. Page 4 Staff Analysis: A CCC priority is to ensure public access to the California coastline, both vertical access (to and from the coast) and lateral access (along the coast)(Coastal Act, Article 2). This CCC policy priority can conflict with the property rights of private or gated communities along the coast founded prior to establishment of the Coastal Act in 1972. Surfside Colony is an example of such a community. Part one of the CCC comment is framed to open discussion regarding the recommended policy inclusion. Michael Baker's recommended response is to clarify with the CCC that Surfside Colony is operating within their right to maintain a private community. Beachfront lots in the Surfside Colony legally own portions of the sandy beach and expanding lateral access would be infeasible. As Surfside Colony adjoins the Seal Beach Naval Weapons Station, where access to the coast is also legally constrained. Part two of the comment recommends rephrasing LUP content and furthering the discussion of public access in Surfside Colony. The intent behind the LUP language as provided in the LUP (bold italic) was to demonstrate that Surfside Colony is not expanding outside of the existing footprint, and the existing footprint constraints the type of redevelopment that could occur. Clarification upon the text should specify "redevelopment" instead of using the term "new development", as additions or remodels of existing residential properties would constitute redevelopment. The discussion regarding CCC's request "how public access may be maximized" would occur in coordination with the response outlined above. If the City and the CCC are unable to come to an agreement on how to address public access concerns specifically at Surfside Colony, Michael Baker recommends evaluating the opportunity to designate this community as "deferred certification." This would allow for the remainder of the Seal Beach Coastal Zone to be included in the LCP but defer certification for Surfside Colony. Surfside Colony would be responsible for obtaining CDPs directly from the CCC instead of from the City. The City of Huntington Beach utilized a similar approach during the last LCP update process and identified Sunset Beach/Huntington Harbor as an area of deferred certification. COMMENT #4 — VISITOR ACCOMMODATIONS Given the low number of lower-cost accommodations within the City's Coastal Zone, we strongly encourage the City to include a policy under LUP section 2.3.3 regulating short-term rentals and home -sharing as a form of overnight, visitor -serving accommodations. We would like to discuss this issue with the City, including the City's overall approach at regulating short-term rentals and home -shares. In addition, the City should develop a policy to encourage maintenance of the existing moderate cost accommodations and prevent their conversion into high-cost accommodations to the maximum extent feasible. Please share the details Page 5 of the method used to determine these rates as "moderate" rates. Staff Analysis: Under Coastal Act Section 30213, lower cost visitor serving accommodations shall be protected, encouraged and where feasible, provided. As short-term rentals and other "home -sharing" websites have become more popular in recent years, the CCC has provided policy guidance to regulate short- term rentals as an opportunity to increase public access opportunities. City staff has indicated there have been internal discussions regarding the existing short- term rental program, including an opportunity to open the application up for new permits. While it is unlikely that short-term rentals in the City will constitute low- cost accommodations, this is an opportunity to reevaluate the existing moratorium on issuing new short-term rental permits. Historically, the CCC has opposed bans on vacation rentals within the coastal zone, citing such bans as inconsistent with the Coastal Act.3 CCC does support regulating short-term vacation rentals, including limits on vacation rentals allowed in certain areas, limits on types of housing that could be used as vacation rentals, limits on maximum occupancies, limits on the number of stays within specific time periods, payment of transient occupancy tax, and property management/code enforcement protocols. Michael Baker provided the details of the method used to determine low/moderate/high rates to the City in 2019. All three hotels within the City (two within the coastal zone and one outside of the coastal zone) are considered "moderate" rate, during both the peak and non -peak season. This method would be incorporated into the Local Implementation Plan (LIP) component of the LCP. COMMENT #5 — PARKING Similar to the above comment, the LUP states that "the City's preferential parking zones were initiated in the 1970s and was determined not to adversely impact coastal access and recreation due to the adequacy of available parking in public lots. In the Surfside community, vehicular access is restricted to residents and their guests; therefore, no preferential parking district is necessary within this portion of the City." We would like to discuss preferential parking districts with the City, including any prior CDP(s) issued for these existing preferential parking districts and whether/how they should be incorporated into the LCP. Staff Analysis: As previously discussed, a CCC priority is to ensure public access to the California coastline. This comment relates to parking concerns as they relate to public access and the existing preferential parking districts in the 3 California Coastal Commission, Short-Term/Vacation Rentals in the California Coastal Zone, dated December 6, 2016. 'M- Old Town neighborhood. Below is a brief history of metered parking and preferential parking zones in Old Town. Parking meters were originally installed on Main Street in the 1960s. The Coastal Act was enacted in 1972, and the permitting jurisdiction within the coastal zone was moved to the California Coastal Commission. Parking meters were removed in 1976 by ordinance; this ordinance also established the preferential parking districts in Old Town, including residential area time limits and fees for parking permits. In February 2004, the CCC approved CDP 5-02-422 to authorize: (a) the addition of parking meters to Main Street; (b) restriction of parking from 5th Street to 12th Street to 1 -Hour Parking (8 AM to 6 PM)(Residential Area); and, (c) "after the fact" approval for 80 off-street parking meter spaces located along Main Street as well as the replacement of these existing meters with new meters. Michael Baker recommends further discussion with the CCC to understand its concerns, and how/if preferential parking districts are incorporated into the LCP. Recommendations Summary: • Comment #1: Not applicable; no further action required. • Comment #2: Michael Baker to include specific definition in LCP as to what constitutes a beachfront lot. • Comment #3: Michael Baker and City staff to discuss approach with CCC regarding public access and the Surfside community; Michael Baker to clarify in the LCP with the correct term, "redevelopment" instead of "development". • Comment #4: Staff team seeks Council direction whether there is interest in opening short-term rental permits up for new applicants. If there is interest; Michael Baker will update the LCP to formalize this interest in a policy. If there is no interest; Michael Baker and City staff will discuss existing conditions and constraints with CCC to decide on a path forward. • Comment #5: Staff team to discuss approach with CCC regarding preferential parking zones. If CCC is against including in the LCP, then Michael Baker and City staff recommend removal. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: The City Attorney has reviewed the staff report and approved as to form. Page 7 FINANCIAL IMPACT: All costs associated with the preparation of the draft LCP are within the scope of the City's contract with Michael Baker. STRATEGIC PLAN: This item is applicable to the Strategic Plan. MEASURE BB: This item is not applicable to Measure BB, the Seal Beach Neighborhood and Essential Services Protection Measure. RECOMMENDATION: That the City Council consider the five issue items identified in the staff report and provide feedback and further guidance to the Staff team.
