Based on the record of the proceedings, the City Council hereby finds as follows -
X The State of California requires every municipality to periodically update: the
Housing Element of its General Plan to review the housing needs of the community and
revise its policies, programs, and objectives to address those needs. Jurisdictions such
as the City of Seall Beach that are within the Southern California Association of
Governments region are required to update their Housing Elements for the 61'h planning
cycle, which covers the 2021-2029 period.
C. The City's share of the regional housing need, or Regional Housing Nee
Assessment (RHNA) was established at 1,243 units in the Regional Housing Nee
Assessment Plan prepared and adopted by the Southern California Association
Governments (SCAG) in March 2021 . The allocation establishes the number of new un I
needed, by income category, to accommodate existing housing demand and expect
popuilation growth over the planning period of the Housing Element�;
D, State law requires the Housing Element to identify adequate sites
accommodate the City's RHNA for all income categories, and the Housing Eleme
Update identifies sites that can accommodate housing exceeding the City's RHNA; I
March 8, 2021 the Seal Beach City Council and Planning Commission
conducted a joint meeting to consider housing issues affecting the community and State
requirements regarding the Housing Element, and received public oral and written
comments.

Section 2. Environmental Review. The City Council finds that the 2021-2iO29
Housing Element Update is exempt from the requirements of the California Environmental
Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, which
states in part the general rule that CEQA applies only to projects which have the potential
for causing a s,ignificant effect on the environment. Where it can be seen with certainty
that there is no possibility that the activity in question may have a significant effect on the
environment, the activity is not subject to CEQA,
B. The 2021-2029 Housing Element Update contains goals, policies, a
programs aimed at addressing the City's housing development, preservation, a
rehabilitation needs, including accommodating the City's RHNA of 1,243 housing units
2029, encouraging housing to serve lower income and special needs household
increase access to affordable and special needs h_Q, i
housing. The proposed project does not entitle, propose, or otherwise require th
construction of new development or rehabilitation of existing development, but rath
includes goals and policies to facilitate the development, preservation, and rehabilitatio
of housing consistent with existing and proposed uses identified in the General Plan an
as mandated to be allowed under State law. I
Section 3. Findings. Based upon all available evidence presented to the City
Council during the above -referenced public hearing on February 7, 2022, including written
and oral staff reports and public testimony, the City Council hereby specifically finds as
follows:
A. In accordance with Section 65585 of the Government Code, the Ci
Council has reviewed HCD's comments and the revised Draft Housing Element and fin
that the 2021-2029 Housing Element has been revised to address each of the findin
made by HCD. I
B. The 2021-2029 Housing Element Update includes nonvacant sites in t
Sites Inventory to accommodate the lower income RHNA of 459 units. Government Co
Section 65583.2(g)�(2) provides that when a jurisdiction relies on nonvacant sites
accommodate 50% or more of its lower income RHNA, the methodology used *00

period. The nonvacant sites identified in the Sites Inventory, including accessory dwelli 0
units identified in Appendix B Table B-1, as well as 9 of the 11 sites identified in Appendil
