HomeMy WebLinkAboutCC Res 3713 1987-08-03 I RESOLUTION NUMBER ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTERED CITY, ESTABLISHING A SALARY AND WAGE SCHEDULE, AUTHORIZING THE IMPLEMENTATION OF EMPLOYEE BENEFITS FOR MANAGEMENT, NON-REPRESENTED AND PART-TIME EMPLOYEES AND REPEALING, ON THE EFFECTIVE DATES SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: SALARIES Section 1. Salaries The salary schedule as shown in Appendix A attached hereto and made a part hereof for each salary range and/or hourly rate of pay shall constitute the basic compensation and pay plan for management, confidential and non-represented personnel. The attached salary Schedule A shall become effective July 1, 1987. Appendix B attached hereto and made a part hereof for each hourly rate of pay shall constitute the bssic compensation and pay plan for part-time, hourly and seasonal salaries and shall become effective July 1, 1987. LEAVE TIME Section 2. Leave Time A. All full-time employees who have at lesst one yesr of continuous service as a full-time permanent employee shall esrn leave hours in accordance with paragraph E below. I B. Leave hours may be used for, but not limited to, the following purposes: vacation, sick le~ve, bereavement, personal leave. All lesves, other than sick leaves, must be approved in advance by the employee's department head. C. The department head may require employee's to present proof of illness for sick lesves in excess of twenty- four (24) hours. (3 working days) D. Employees who are on authorized leaves of sbsence, without psy, shall not accrue leave hours during said leaves of absence. E. In no case shall the hours earned exceed 280 hours per year. Executive Management personnel are exempt from the maximum accrual provisions of this section. F. An employee may not accrue leave hours in excess of the maximum accrual schedule. Hours in excess of the maximum accrual will be forfeited. G. Effective July 1, 1987 all employees with existing vacation balances shall have those balances converted to leave time on an hour for hour basis. I H. Effective July 1, 1987 employees will no longer accrue sick leave hours. Existing sick leave balances will remain intact and may be utilized by the employee for sick leave purposes only. Existing sick leave balances may be converted to leave time hours, at the option of the employee, at the ratio of one-quarter (1/4) hour of leave time for every hour of sick leave. The decision to convert sick leave hours to leave time hours must be done by January 1, 1988. No conversion will be made after that date. I. Upon termination of employment with the City, all leave hours will be paid to the employee at the employee~s base rate of pay. INSURANCE PROGRAMS Section 3. Insursnce Programs A. Health and Dental I. The City shall provide for eligible employees a group hospital, medical and dental insurance plan. 2. The City shall contribute to the cost of each medical/dental plan for each eligible employee and their dependents, up to the following amounts: I -For single employees . . . . . . . . . -For employee and 1 dependent . . . . . . -For employee and 2 or more dependents. . . $115/month. . $242/month. . $321/month. Employees enrolled in the plan are required to pay any premium amounts in excess of the above City contribution. Such amounts will be deducted from the affected employee~s payroll check on the first two pay periods for each month. 3. Part-time, seasonal, provisional and/or hourly employees shall not be eligible for participation in this program. 4. No person who is eligible to receive Worker~s Compensation benefits is eligible to receive benefits from the City~s group medical insurance. 5. Full-time employees of the City who have completed thirty (30) days of uninterrupted service shall be enrolled in this insurance program on the first day of the next succeeding month. I 6. Employees who change classification from full-time to part-time provisional, hourly or seasonal shall not be eligible for this benefit. 7. City shall not pay premiums for any employee on leave of absence without pay, who is absent from regular duties without authorization during the Resolution Number .:r;rl'~ month and/or for any employee who has terminated from City employment for any reason. City shall pay premiums for employees receiving temporary payments from Worker~a Compensation Insurance. B. Life Insurance II All employees listed in Appendix A as Executive Management and Direct Staff and Line Assistants, Confidential and Professional and Technical shall receive a $50,000 life insursnce policy paid by the City. C. Income Continuation All employees listed in Appendix A shall receive income continuation policy to provide for income continuation of 66 2/3% of the employee~s monthly salary or $5000, whichever is the lesser. Said income continuation shall commence on the thirty-first (31) day of sickness or other bona fide absence or upon expiration of sick leave, whichever occurs later, and continuing thereafter while the employee is absent from work for a period of up to age 65. RETIRED HEALTH PLAN Section 4. Retired Health Plan I All employees liated in appendix A have the option upon retirement to continue participation int he City's health insurance program at the employee~s expense. Executive Management employees with 20 or more years of continuous employment with the City and all other employees with 30 or more years of continuous employment with the City shall be provided with individual and eligible dependent health insurance coverage at no cost to the retiree. Sworn police personnel identified in Appendix A shall be subject to the retired health plan contained in the Memorandum of Understanding with the Seal Beach Police Officers~ Association. BEREAVEMENT LEAVE Section 5. Bereavement Leave The City agrees to provide three days bereavement lesve with pay for death in'the immediate family. The bereavement leave shall not be chargeable to or accumulate as leave time. "Immediate family" is defined as spouse, the father, mother, son, daughter, brother, sister, grandparents, step-mother, step-father, or dependent relatives of the employee. HOLIDAYS Section 6. Holidays All employees on Appendix A shall be granted the following holidays with pay: 'I Hew Year~s Day (January 1) Washington~s Birthday (Third Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4) "". Labor Dsy (First Monday in September) Veteran~s Day (November 11) Thanksgiving Day (Fourth Thursday in November) The Calendar Day following Thanksgiving Day Christmas Day (December 25) One half Day before Christmas or New Year~s One (l) Floating Holiday. A total of 10-1/2 holidays annually. Resolution Number ~~,1~ *The floating holiday must be taken during the term of this agreement. Floating holidays may not be carried forward beyond the term of this agreement. Floating holidays must be approved by the department head. RETIREMENT SYSTEM Section 7. Retirement System The retirement program provided by the City shall consist of a depooled PERS plan which includes the following provisions: A. Section 20024.2 One Yesr final compensation B. Section 20862.9 Credit of unused sick leave C. Section 20930.3 Military Service Credit I The City shall pay that portion of the affected employee's retirement contribution that is equal to seven percent (7%) of the affected employees~ base salary. Police and Lifeguard personnel listed in Appendix A shall participate in the 2% at 50 formula plan for Local Safety Members. OVERTIME AND CALL-DUT PAY Section 8. A. Overtime and CallOut Pay Only employees listed on Appendix A as Confidential, Professional and Technical are eligible for overtime or call-out pay. B. Callout and overtime pay shall be paid at the rate of time and one-half the hourly rate. Minimum "call out" time shall be two (2) hours. The City shall pay time and one-half for overtime. C. Overtime will be computed by dividing the employee~s regular monthly salary by 173.3 to arrive at an hourly wage. I D. Notwithstanding any provision of this paragraph, employee shall be entitled to select either compensated overtime or compensatory time off subject to budget limitations and departmental rules and regulations. UNIFORM ALLOWANCE Section 9. Uniform Allowance Sworn Police personnel listed in Appendix A shall receive an annual uniform allowance of $500. HOVE-UP PAY Section 10. Move-Up Pay City agrees that employees assigned, in an acting capacity, to a higher classification than the employees~ present classification for a period of not less than 120 consecutive working hours shall be entitled to move-up pay. In addition, employees who are assigned by the department director in writing to regularly scheduled acting assignments of less than 120 hours shall also be entitled to move-up pay. Move-up pay will be retroactive to the first hour served in the higher classification and shall be paid at a rate equal to the range of the higher classification. Minimum move-up pay shall be 5%. I SENIORITY BONUS Section 11. Seniority Bonus Employees who have achieved ten years of uninterrupted employment with the City shall receive a five percent (5%) increase in base salary effective on the 10th anniversary of their employment. Sworn police personnel are exempt from this section. Resolution Number ~;i',1~ AUTOMOBILES AND MILEAGE Section A. 12. Automobiles and Mileage Officers and employees of the City, utilizing their privately-owned automobiles for City business on a non- regular basis, shall be entitled to reimbursement for costs incurred at the rate of 20 cents (20) per mile. B. The following positions will receive a monthly automobile allowance of $150 in lieu of the above- stated mileage reimbursement: Assistant City Manager, Director of Public Works/City Engineer,d Director of Finance, City Clerk, Director of Parks and Recreation, Lifeguard Chief and Director of Development Services. I C. Building Inspectors shall be reimbursed at the rate of Four Hundred Dollars ($400) per month for the use of their privately-owned automobiles for the execution of their job duties on a regular basis. Building Inspectors who utilize private vehicles for City business may utilize, to a maximum of once per week, . the City-assigned car wash for the purpose of washing their vehicles used for City business. EXPERIENCE PAY II Section 13. Experience Pay Effective December 1, 1986, all employees listed on Appendix A with a minimum of ten (10) years of full-time service as a sworn police officer with a municipal, county or State police agency meeting California Police Officers's Standards and Trsining Commissions standards or their equivalent, shall e eligible to receive, upon receipt of an overall satisfactory performance appraisal, signed by the Chief of Police, his designate, or an individual acting in his capacity, or the City Manager, a five percent (5%) increase in their base salary. Effective January 1, 1988, eligible employees with twenty (20) years of full-time service shall receive a ten percent (10%) increase above their base salary. New hires shall not become eligible to receive experience pay until after satisfactory completion of their probationary period. ADMINISTRATIVE LEAVE Section 14. Administrative Leave All Executive Management personnel shall be entitled to two (2) days of administrative leave during the twelve month period from July l, 1987 through June 30, 1988. Administrative leave days may not be carried forward to succeeding years nor may they be turned in for cash value. '., LIMITATIONS I Section 15. Limitations Part-time, hourly, seasonal and/or provisional employees, contract employees, reserve police personnel and sny City employee who is not employed on a continuous full-time basis shall not be eligible for benefits stated in this resolution. No employee who is eligible to receive workman's compensation is eligible to receive overlapping benefits (except life insurance) stated in this resolution. City shall not make any monthly payments for premiums for any insurance benefit listed in this resolution, or uniform allowance, supplemental pay of any time snd/or type of bonus on behalf of or to any employee who has been absent without authorization during ssid month or for any employee who has terminated for any reasons whatsoever or who is on leave of absence without payor who is suspended from duties without pay. Resolution Number .5713 DEFERRED COMPENSATION Section 16. Deferred Compensation The City shall contribute the amount of $35.00 per payroll period into a deferred compensation program for the following positions: City Manager, Assistant City Manager, Director of Public Works, Director of Finance, Director of Development Services, Director of Parks and Recreation, City Clerk, Lifeguard Chief and Secretary to the City Manager I EMPLOYEE RECOGNITION FUND Section 17. Employee Recognition Fund There is hereby established an Employee Recognition Fund of $1500 to be utilized by the City Manager for the purpose of employee recognition. BONUS FUND Section 18. Bonus Fund There is hereby established a Bonus Fund of $5,400 to be utilized by the City Manager for the purpose of awarding performance bonuses. LIFEGUARD EMT CERTIFICATION Section 19. Lifeguard EMT Certification Part-time, seasonal lifeguard personnel who have been deemed to meet certain criteria established by the Lifeguard Chief and Personnel Officer and who have obtsined their Emergency Medical Technician (EMT) certification are eligible to receive a $100 annual bonus. PAGER COMPENSATION I Section 20. Pager Compensation The Police Chief and Captains shall receive 8 hours of compensation per month at an hourly rate equal to their base salaries.
