Approves the filing of an application for camunity Parklands Act of 1986 state grant assistance for the above project(s); and 2. Certifies that said agency understands the assurances and certification in the app1icatioo fODII; am 3. Certifies that said agency has or will have sufficient funds to operate and maintain the project(s); am 4. Certifies that said agency will OCIIplete the project(s) within three years fran date of approval by the State; and 5. Appoints the City Manager as agent of the City to conduct all negotiatioos, execute am suJ:mit all documents including but not limited to app1ications, agreE!ll.eutS, aR8ldnents, paynent requests, and so 0n, which may be necessary for the coopletion of the aforementioned project (s) . The grant recipient hereby gives assurance and certifies with respect to the grant that: It possesses legal authority to apply for the grant, and to finance, acquire and construct the proposed project: that a resolution, motion or similar action has been duly adopted as an official act of the applicant's governing body, authorizing the filing of the application, including all understandings and I assurances contained therein, and directing and authorizing the person identi- fied as the official representative of the applicant to act in connection with the application and to provide such additional information as may be required. 2. It understands that grant funds must be appropriated by the State Legislature before costs can be incurred against the grant. 3. It will cause work on the project to be commenced within three years of appro- priation and agrees to make the property to be acquired or developed open to use by the public by the DATE SPECIFIED IN THE AGREEMENT WHICH WILL NOT BE MORE THAN THREE YEARS AFTER THE DATE UPON WHICH THE PROJECT WAS APPROVED BY THE STATE. 4. It will provide and maintain competent and adequate architectural/engineering supervision and inspection at the construction s1te to insure that the completed work conforms with the plans and specifications: that it w111 furnish progress reports and such othe~ information as the State may require. 5. It will give the State's authorized representative access to and the right to examine all records, books, papers or documents related to the grant. 6. It will not dispose of or encumber its title or other interests in the site and facilities without permission from the State Leg1s1ature. 7. For each individual project listed on the front of this form, it will submit appropriate California Environmental Quality Act documents, a project infor- I mation form, cost estimates for development projects, an acquisition schedule for acquisition projects, site and location map and appropriate engineering and/or acquisition certifications. [This information must be submitted before grant funds are disbursed.] B. In cases involving leased property I it agrees to maintain and operate the property and/or facilities acquired or developed for an agreed to perlod com- mensurate with the type of project and the proportion of State grant tunds and local funds allocated to the capital costs of the project.
