A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH AWARDING AND AUTHORIZING THE CITY MANAGER
TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH
HF&H CONSULTANTS, LLC FOR SOLID WASTE CONSULTING
AND NEGOTIATION SERVICES FOR SENATE BILL (SB) 1383
CONTRACTING ASSISTANCE
WHEREAS, the City Council of the City of Seal Beach deems it desirable and
necessary to fulfill the requirements of Senate Bill 1383 (SB 1383), a state
unfunded mandate that calls for CalRecycle to develop regulations to reduce
organics in landfills as a source of methane. These regulations, adopted in 2020
("SB 1383 Regulations"), place requirements on multiple entities including the City;
single-family residential households: commercial businesses, including multi-family
property owners with five or more dwelling units; commercial edible food
generators; haulers, including self-haulers; food recovery organizations; and food
recovery services to support achievement of statewide organic waste disposal
reductions targets; and,
WHEREAS, HF&H Consultants, LLC, possesses the specialized ability, has the
pertinent experience, and has familiarity with the City's solid waste goals and
obligations that will assist the City in achieving implementation of an organic waste
recycling program which will meet the directive outlined under SB 1383. HF&H will
evaluate the City's waste hauler's (Republic Services) proposed program to
comply with SB 1383, negotiate rates and terms of a compliant program, and
prepare an SB 1383 amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:
SECTION 1 . The City Council hereby awards a Professional Services Agreement
(Agreement) to HF&H Consultants, LLC, in the not-to-exceed
amount of $75,000 to provide professional services for SB 1383
Contracting Assistance.
SECTION 2. The City Council hereby authorizes and directs the City Manager to
execute the Agreement on behalf of the City pursuant to the HF&H
Proposal dated February 28, 2022.
SECTION 3. The City Council hereby authorizes the City Manager to approve
Agreement amendments for additional work payment requests for
additional work that cannot be precisely determined in advance but
that may be incurred due to the complexity of the negotiations, for
solid waste consulting and negotiation services. in the cumulative
not-to-exceed amount of $15,000.

regular meeting held on the 28th day of March, 2022 by the following vote:
