A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
RATIFYING THE DECLARATION OF AN EMERGENCY AND
DISPENSING WITH PUBLIC BIDDING FOR EMERGENCY
WATERLINE RELOCATION FOR THE 1-405 IMPROVEMENT
PROJECT ADJACENT TO THE BEVERLY MANOR RESERVOIR
(CIP EM2201) ON THE BASIS THAT THE WORK WAS OF
URGENT NECESSITY, RATIFYING THE PURCHASE ORDER
WITH VALVERDE CONSTRUCTION, INC., AUTHORIZING THE
CITY MANAGER TO EXECUTE A PURCHASE ORDER,
ACCEPTING COMPLETION OF WORK AND DIRECTING THE
FILING OF A NOTICE OF COMPLETION FOR THE PROJECT,
AND APPROVING BUDGET AMENDMENT BA #22-12-01 TO
ALLOCATE $128,006.42
WHEREAS, the 1-405 Improvement Project is widening the 405 Freeway between
the Orange County limits and City of Costa Mesa, including a portion of the 405
Freeway within the City of Seal Beach ("City"); and,
WHEREAS, on February 25, 2022 OCTA notified the City that the 1-405
Improvement Project impacted an existing 12-inch City water line ("Waterline") that
runs along the northerly edge of the City's Beverly Manor Reservoir and North
Gate Road within the City, because the 405 Freeway widening included demolition
of existing sound walls and installation of new sound walls within the area where
the Waterline was partially located; and,
WHEREAS, the Director of Public Works determined that as a result of the
proposed construction by OCTA, there was an imminent need for the City to
relocate the Waterline to prevent impairment of the potable water supply and fire
flow water for the City and its residents and businesses, and the Director of Public
Works thereupon declared an emergency finding that the relocation of the
Waterline was of urgent necessity for the preservation of life, health and property,
and that there would not be sufficient time for public bidding in order to carry out
the work, and authorized the emergency relocation to be performed by Valverde
Construction, Inc. (Valverde); and,
WHEREAS, the City's Charter Sections 107 and 1010 authorize the City to
dispense with public bidding as necessary for the preservation of life, health or
property..
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE, FIND AND
DETERMINE AS FOLLOWS:
SECTION 1. Based on the recitals set forth above, the City Council the City
Council hereby declares that the 1-405 Improvement Waterline
Relocation, CIP EM2201, was necessary for the immediate
preservation of life, health and property of the City, and the City
Council therefore ratifies the declaration by the Director of Public
Works that the 1-405 Improvement Waterline Relocation, CIP EM
2201, adjacent to the Beverly Manor Reservoir, was of urgent
necessity for the immediate preservation of life, health and property.
SECTION 2. The City Council hereby authorizes the City Manager to execute a
purchase order contract with Valverde Construction, Inc. for the I-
405 Improvement Waterline Relocation, CIP EM2201 , under an
existing on-call agreement, without advertising for bids, in
accordance with Valverde invoices dated April 13, 2022, for a total
amount not-to-exceed $128,006.42.
SECTION 3. The City accepts the completion of 1-405 Improvement Waterline
Relocation, CIP EM2201, by Valverde Construction, Inc. in the
amount of$128,006.42 for the work performed.
SECTION 4. The City Clerk is hereby directed to file a "Notice of Completion" for
the 1-405 Improvement Waterline Relocation, CIP EM2201, with the
Orange County Clerk-Recorder within ten (10) days of the date of
this resolution.
SECTION 5. The City Council hereby approves Budget Amendment #BA 22-12-
01 allocating $128,006.42 to account number 501-500-0900-51280,
as follows:

SECTION 6. The City Clerk shall certify to the passage and adoption of this
resolution.
PASSED, APPROVED and ADOPTED by the Seal Beach City Council at a regular
meeting held on the 13th day of June, 2022 by the following vote:
