Home My WebLink AboutCC Res 3774 1988-04-05 I I I RESOLUTION NUMBER .311~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE PRIMARY MUNICIPAL ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 29TH DAY OF MARCH, 1988, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS, a Primary Municipal Election was held and conducted in the City of Seal Beach, County of Orange, State of California, on Tuesday, the 29th day of March, 1988, as required by Ordinance Number 1265 of the City of Seal Beach, California; and WHEREAS, notice of said election was duly and regularly given in time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed; and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed, and the returns made and declared in time, form, and manner as required by the provisions of the Election Code of the State of California for the holding of elections in general law and charter cities; and WHEREAS, pursuant to Resolution Number 3749, adopted the 7th day of December, 1987, the City Clerk of the City of Seal Beach canvassed the returns of said election and has certified the results to this City Council, said results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY RE~OLVE AS FOLLOWS: Sect ion 1. That there were twenty-three (23) voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in the City of Seal Beach, California, as established for the holding of State and County elections. Section 2. That said Primary Municipal Election was held for the purpose of nominating the following officers of said City as required by the Charter of the City of Seal Beach and general laws of the State of California, to wit: One member of the City Council of said City for the full term of four years from Councilmanic District Two; One member of the City Council of said City for the full term of four years from Councilmanic District Four; City Clerk of said City for the full term of four years. Section 3. That a Special Municipal Election was called by Ordinance Number 1265 and consolidated with Primary Municipal Election to be held on said date to submit to the voters the following measure: Shall the Seal Beach Yes Preservation & Open Spaces Initiative Ordinance be adopted? No Resolution Number ~~,,~ Section 4. Section 5. Section 6. ~ That the whole number of ballots cast in said City, except absent voter ballots, was 6726. That the whole number of absent voter ballots cast in said City was 760, making a total of 7486 I ballots cast in the City. That the name of the person voted for at said election for member of the City Council in Councilmanic District Two is as follows: Edna Wilson That the name of the person voted for at said election for member of the City Council in Councilmanic District Four is as follows: Frank Laszlo That the names of the persons voted for at said election for City Clerk, City-wide is as follows: Vanessa McCants Joanne Yeo That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates are as shown in Exhibit "B" attached hereto and made a part hereof. I That the Measure voted upon at said election is as follows: Measure A Shall the Seal Beach Yes Preservation & Open Spaces Initiative Ordinance No be adopted? The City Council does declare and determine that Edna Wilson is elected as a member of the City Council of the City of Seal Beach from Councilmanic District Two, for the full term of four years; The City Council does declare and determine that Frank Laszlo is elected as a member of the City Council of the City of Seal Beach from Councilmanic District Four, for the full term of four years; I The City Council does declare and determine that Joanne Yeo is elected as City Clerk of the City of Seal Beach, for the full term of four years. .1 That as, a result of the election, a majority of the voters voting on Measure A did not vote in favor of it, and that the Measure was not carried, and shall not be deemed adopted and ratified. ~ , I I I ," ,. , Resolution Nuber ~J1~~ Section 7. The City Clerk shall enter on the records of the City Council of said City, a statement of the results of said election, showing: (1) The whole number of votes ballots in the City: (2) The names of the persons votes for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person for and against the measure; (5) The number of votes given for and against the measure. Section 8. That pursuant to the City Charter, on the seventh day following the time for holding a General Municipal Election at the hour of the completion of the canvass of said election returns, the City Clerk shall make and deliver to each of such persons so elected, a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. Section 9. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and in the records of the proceedings of tne City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
