A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
AUTHORIZING AN APPLICATION FOR A FINANCIAL
ASSISTANCE AGREEMENT WITH THE STATE WATER
RESOURCES CONTROL BOARD AND DESIGNATING A
REPRESENTATIVE TO EXECUTE THE AGREEMENT AND
ANY AMENDMENTS OR CHANGES THERETO, FOR THE
BEVERLY MANOR PUMP STATION REHABILITATION (WT
0904) AND LCWA WATERMAIN LINING (WT 2103)
PROJECT
WHEREAS, the State of California State Water Resources Control Board has a funding
program entitled "State Water Resources Control Board State Drinking Water State
Revolving Fund" ("DWSRF") and pursuant to this program, the State Water Resources
Control Board makes funds available for various safe drinking water-related projects; and,
WHEREAS, the City of Seal Beach ("City") is a California charter city with responsibility
for and authority over the City's water system; and,
WHEREAS, the City's Beverly Manor Well and LCWA Watermain are essential facilities
to the water system; and,
WHEREAS, the City desires to seek financial assistance in improving these essential
facilities; and,
WHEREAS, the City is authorized to enter into an agreement with the State Water
Resources Control Board.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1 . The City Manager ('`Authorized Representative") or designee is hereby
authorized and directed to sign and file, for and on behalf of the City of
Seal Beach, a Financial Assistance Application for a financing
agreement with the State Water Resources Control Board to seek funds
made available under the State Drinking Water State Revolving Fund
("DWSRF") for the planning, design, and construction of the Beverly
Manor Pump Station Rehabilitation (WT0904) and LCWA Watermain
Lining (WT 2103) Project (the "Project").
Section 2. The Authorized Representative, or her designee, is designated to
provide the assurances, certifications, and commitments required for the
financial assistance application, including executing a financial
assistance agreement from the State Water Resources Control Board
and any amendments or changes thereto.
Section 3. The Authorized Representative, or her designee, is designated to
represent the City of Seal Beach in carrying out the City's responsibilities
under the financing agreement, including certifying disbursement
requests on behalf of the City and compliance with applicable state and
federal laws.
Section 4. The Council finds that the filing of a Financial Assistance Application
with the State Water Resources Control Board does not constitute a
project within the meaning of the California Environmental Quality Act
("CEQA"), pursuant to CEQA Guidelines Sections 15061(b)(3) and
15378(b)(5), because it can be seen with certainty that the action will
not have a significant effect on the environment.
PASSED, APPROVED and ADOPTED by the Seal Beach City Council at a regular
meeting held on the 27th day of June, 2022 by the following vote:
