A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL bEACH OkDEkING PROPOSED IMPROVEMENTS TO BE MADE ANU THE FORMATION OF A STREET LIGHTING DISTRICT NO.1; CONFIRMING THE DIAGRAM AND ASSESSMENTS; AND, LEVYING ASSESSMENTS FOR THE STREET LIGHTING DISTRICT NO. 1 FOR FISCAL YEAR 198H-89 WHEREAS, City Council Resolution Number 3776 initiated the proceedings for formation of a Street Lighting District; and WHEREAS, Clty Councll Resolution Number 3777 approved the Engineer's Report as flIed; and WHEREAS, Clty Councll Resolution Number 3778 declared intention to order the 10rmation 01 a Street Llghting District to levy and collect assessments for certain street llghting and set a time and place for a public hearing thereon; and WHEREAS, notice was duly given and a public hearlng held durlng which all Int~rested persons were afforded the opportunity to hear and be heard; and wHEREAS, any and all protests and obJectlons to tormatlon of the dlstrict and the levYlng and collectlon of assessments, ana any and all other protests have been considered; and WHEkEAS, th~ Engineer has presented certain proposed changes in the report as fllea and the City Councll has ordered those changes; and WHEREAS, based upon the changed Englneer's Report, the Clty Councll hereby flnds and determines that: i. The dlstrict of land within Street Lighting Distrlct No.1 described by the changed Engineer's Report will be benefitted by the improvements to be made; il. The district of land within Street Lightlng Dlstrlct No.1 lncludes all the lands so benefltted; lii. The net amount to be assessed upon the parcels of land wlthln Street Lighting Distrlct No.1 in accordance with the changed Engineer's keport IS apportloned by a 10rmula and method which falrly distributes the net amount among all assessable lots or parcels In proportion to the estlmated benefits to be recelved by each such lot or parcel from the lmprovements to be made. NOW, THEREFORE BE IT RESOLVED THAT THE City Council hereby oraers the lmprovements to be made and the assessment dlstrict to be formed, conflrms the diagram and assessment set forth in the Englneer's Report as changed, ana directs the City Clerk to file such diagram and assessment, or a certified copy thereot with the county audltor by not later than the thlrd Monday in August; and NOW, THEREFORE BE IT FURTHER RESOLVED THAT adoption of this Resolution constltutes levying 01 assessments for the fiscal year 1988-89.
