HomeMy WebLinkAboutCC Res 3529 1985-10-28 RESOLUTION NUMBER ~~~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, APPROVING APPEAL 4-85 AND GRANTING CONDITIONAL USE PERMIT 8-85 I THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, an application was duly filed by the Rossmoor Business Center; and WHEREAS, the property is located on the West side of Seal Beach Boulevard North of St. Cloud Drive (12121 Seal Beach Boulevard); and WHEREAS, the property is described as Parcels 1 through 11 of Section 31, Township 4 South, Range 11 West in Rancho Los Alamitos, County of Orange, State of California as per map filed with the Recorder of said county; and WHEREAS, the property contains several retail/commercial buildings located in the C-2 (General Commercial) Zone; and WHEREAS, the surrounding land uses and zoning are as follows: North, West and South - single family residences located in the community of Rossmoor in the unincorporated territory of the County of Orange. East - a mixture of open space utilized for the most part as a golf course in the R-G Zone, retail/commercial uses in the C-1 Zone and residential uses in the City of Los Alamitos; and WHEREAS, the applicant specifically requested to legalize a number of existing nonconforming pylon signs which were constructed without Planning Commission approval of a Conditional Use Permit. The Center also requested that the Planning Commission approve a Planned Sign Program which establishes specific design standards for signs within the Center, an additional 32 foot high pylon sign and a 75 sq. ft. readerboard sign; and a Planned Sign Program is a voluntary, optional alternative to the general sign regulations, intended to encourage the maximum incentive latitude in order to achieve variety and good design. The Planned Sign Program must not circumvent other objectives of the Sign Code; and I WHEREAS, ~ WHEREAS, one of the objectives associated with the Sign Code is to limit the total amount of signing along City streets to an intensity that will adequately identify each premises without being unduly distracting; and WHEREAS, on July 17, 1985, the Planning Commission held a public hearing on CUP 8-85 and approved the application with conditions; and I WHEREAS, on August 7, 1985 the Planning Commission adopted Resolution #1377 expressing its findings and conditions of approval of Conditional Use Permit 8-85 on July 17, 1985; and Resolution Number ~~ WHEREAS, on August 26, 1985, the applicant filed Appeal 4-85 on Conditions #1 and #2 of Planning Commission Resolution #1377 which read as follows: WHEREAS, 1. That pylon sign #9 not be permitted as shown on the submitted plans. 2. That the double-faced 75 sq. ft. readerboard not be permitted as part of the existing Rossmoor Center identification sign; and on October 14, 1985, the City Council received the Planning Commission report and recommendations; and I WHEREAS, on October 14, 1985, the City Council held a public hearing; and I WHEREAS, the City Council hereby makes the following findings regarding Conditional Use Permit 8-85 and Appeal 4-85; 1. The proposed signs, including the two signs which are part of Appeal 4-85, are consistent with the intent of Article 18 of the Zoning Ordinance and the General Plan which designates the subject property for commercial uses. The subject signs relate to and will be an essential part of the commercial uses on the subject property. 2. The existing signs, in addition to the two new proposed signs, are the minimum number of signs necessary to adequately identify the commercial uses on the subject property. Such signs are compatible with each other and the surrounding area. 3. The signs authorized by CUP 8-85, including the two new proposed signs, will be in harmony with and visually related to the signs included with the Planned Sign Program, the buildings that they identify, and the surrounding land uses. Further, such signs will not obscure any existing conforming signs. 4. The approval of CUP 8-85 does not constitute a grant of special privilege or allow substantially greater visibility than the standard provisions allow. The existing pylon signs and center identification sign were improperly approved by the Planning Department as a Planned Sign Program. Such approval was improper as a Planned Sign Program and could only be approved by the Planning Commission under the provisions of the Seal Beach Municipal Code. In good faith reliance on such "approval", substantial sums of money were spent in upgrading the existing signs on the subject property. The removal of such signs which are necessary for the adequate identification of the existing commercial uses on the subject property would result in an unnecessary and unfair hardship to the property owner and its tenants. I NOW, THEREFORE, BE IT RESOLVED that the City Council of Seal Beach does hereby approve Appeal 4-85 and grant Conditional Use Permit 8-85 subject to the following conditions: 1. Pylon sign #9 shall be permitted as shown on the plans submitted as part of the application for Conditional Use Permit 8-85. Resolution :lumber~9 , 2. A double-faced 75 foot readerboard shall be permitted under the sign designated as pylon sign #6 on the plans submitted as part of the application for Conditional Use Permit 8-85. 3. That the applicant provide modified drawings of pylon signs 12 and 13 showing the Thrifty's and Lucky's signs as they exist if the applicant wants such signs to be authorized as part of the sign program. 4. That the Rossmoor Bowl and Town & Country 8ank tenant signs be included within the application. PASSED, APPROVED and ADOPTED by the City Council of the C~ ~f.
