Home My WebLink AboutCC Res 3601 1986-05-27 RESOLUTION NUMBER ~~I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH REDEFINING THE BOUNDARIES OF THE UNDERGROUND UTILITY DISTRICT NO. 84-1 I THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, a public hearing was called for May 27, 1986 at the hour of 7:88 p.m., or as soon thereafter as the matter could be heard, in the Council Chambers, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service to those certain properties along Eighth Street, Seal Way, Mean High Tide Boundary Agreement, First Street, Marina Drive, Second Street and Ocean Avenue) WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law~ and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. I NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Seal Beach hereby finds and determines that the public necessity, health~ safety and welfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within that area designated as Underground Utility District No. 84-1, more particularly described as follows: Beginning at the centerline intersection of Ocean Avenue and 8th Street as per parcel map in the City of the Seal Beach, County of Orange, State of California recorded in Book 68, Page 7, inclusive of Miscellaneous Maps, records of said Orange County. Thence, southeasterly along the centerline of Ocean Avenue, to a point of intersection with the southerly prolongatjon of the easterly right-of-way line of 8th Street. I Thence, southwesterly along said prolongation line to to the southerly right-of-way line of Ocean Avenue. Thence, northwesterly along said right-of-way line to the westerly right-of-w~y line of 8th Street. Thence, southwesterly along said right-of-way line to the southerly right-of-way line of Seal Way. Thence, northwesterly and continuing northwesterly along said southerly right-of-way line of Seal Way to a point of intersection with the southerly prolongation of the westerly right-of-way line of 2nd Street. Thence, continuing southwesterly, projecting said line to a point of intersection with the mean high tide boundary line agreement between the City of Seal Beach and the State of California Lands Commission as per deed recorded in Book 8345, Pages 392 through 482, official records of Orange County. Resolution Number!J60J I Thence, northwesterly, northeasterly and northwesterly along said boundary agreement line to a point of intersection with the southerly prolongation of the westerly right-of-way line of First Street. Thence, northeasterly along said southerly prolongation line of First Street and continuing northeasterly along said right-of-way line to the southerly right-of-way line of Marina Drive. Thence, northwesterly along said right-of-way line, to the westerly right-of-way line of the City of Los Angeles Department of Water and Power as shown in Book 90 Page 26 of Record of Survey Maps, records of Orange County. Thence, southwesterly along said right-of-way line to a point of intersection with the easterly line of the Los Angeles County Flood Control District. Thence, northeasterly along said line, to the northerly I right-of-way line of Marina Drive. Thence, southeasterly and northeasterly and continuing northeasterly along the of-way line of First Street, then intersecting with the centerline of Highway. along said line westerly right- projecting and Pacific Coast Thence, southeasterly along said Coast Highway to a point of northerly prolongation of the line of First Street. centerline of Pacific intersection with the easterly right-of-way Thence, southwesterly along said northerly prolongation line and continuing southwesterly along the easterly right-of-way line of First Street to a point, distant 50 feet from the northerly right-of-way line of Marina Drive. Thence, southeasterly, measured ,at right angles, 50 feet. Thence, southwesterly and parallel with said right-of- - way line of First Street to a point of intersection with the northerly right-of-way line of Marina Drive. Thence, northwesterly along said line, to a point of intersection with the northerly prolongation of the easterly right-of-way line of First Street. I Thence, southwesterly along said prolongation line and continuing southwesterly along the easterly right-of- way line of First Street to the northerly property line of Lot 12, Block I, of Bay City Tract, recorded in Book 3, Page 19 and Miscellaneous Maps, records of Orange County. Resolution Number ~~I' , I Thence, southeasterly along said line, projecting and continuing southeasterly along the northerly proeprty line of Lot II, Block I of said Bay City Tract intersecting the easterly right-of-way line of Second Street. Thence, southwesterly along said line, to the northerly right-of-way line of Ocean Avenue. Thence, southeasterly and continuing southeasterly along said right-of-way line to a point of intersection with the centerline of 8th Street. Thence, southwesterly along said centerline of 8th Street to the point of beginning. The above described area is hereby established as Underground District No. 84-1. Specifically excluded from the underground district is the 66KV transmission line along First Street. NOW, THEREFORE BE IT RESOLVED FURTHER that the City Council of the City of Seal Beach finds that: (a) Such undergrounding will avoid or unusually heavy concentration distribution facilities; and eliminate an of overhead I (b) Said street is extensively used by the general public and carries a heavy volune of pedestrian and vehicular traffic; and (c) The project is in an area of unusual scenic beauty. NOW, THEREFORE BE IT RESOLVED FURTHER that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times; (a) Underground installation by property owners and reconnect ions not later than July 1, 1987. (b) Removal of associated February 1, pOles, overhead wires and other overheadd structures not later than 1988 by all utility companies. I NOW, THEREFORE BE IT RESOLVED FURTHER that the City of Seal Beach specifically requests the Southern California Edison Company to charge against the Rule 20A allocations all costs of converting to underground each customer's service lateral, up to 100 feet from the distribution line (CPUC Decision 82-01-18). NOW, THEREFORE BE IT RESOLVED FURTHER that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Chapter 25A of the Seal Beach Municipal Code to affected property owners as such are shown on the last equalized roll and to the affected utilities.
