A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ESTABLISHING A PROCEDURE FOR DESTRUCTION OF POLICE RECORDS THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: I Section 1, The City Council of the City of Seal Beach hereby establishes the following procedure with respect to the destruction of records of the Seal Beach Police Department (without making a copy thereof) which are no longer needed and no longer required to be maintained by law, I A, The following records shall be retained for two years and subsequently destroyed with the approval of the City Council by resolution and the written consent of the City Attorney: 1, Dispatch cards 2. Jail registers 3, Officers' daily logs 4, Court transmittals 5, Repossession'r.eports 6, Warrant recall sheets 7, DR report number sheets 8, EAP skips 9, Bail receipts 10, Parking citations 11, Deceased arrest files 12, Letters regarding foreign hunting licenses 13, Solicitor applicant sheets and fingerprint cards 14, School applicant sheets and fingerprint cards B. The following records shall be retained for three years and subsequently destroyed with the approval of the City Council by resolution and the written consent of the City Attorney: 1. Expired bicycle licenses 2, Blue booking sheets I C. The following records shall be retained for five years and subsequently destroyed with the approval of the City Council by resolution and the written consent of ~he City Attorney: 1. Stored/Impounded vehicle reports 2, Non-injury accident reports 3, "Injury/overdose/attempted suicide reports not resulting in death 4, Lost and found property reports 5, Missing prsons reports which have been cleared 6, Incident reports . 7. Courtesy reports for other agencies 8: Moving violation citations 9. Misdemeanor crime reports providing that: a, There is no outstanding warrant relating to the report, b. There is no property outstanding in DOJ or NCIC, c, There is no death connected with the report, d, It is not involved in civil or criminal litigation, e, It does not involve a Seal Beach City employee, 10. Misdemeanor citations 11, Photos, negatives, and corresponding index cards relating to destroyed records. Resolution Number of';1~ D, The following records shall be retained for seven years and subsequently destroyed with the approval of the City Council by resolution and the written consent of the City Attorney: 1. Injury accident reports, if no litigation is known to be pending or proceeding. 2, Felony crime reports providing that: a. There is no outstanding warrant related to the report, b. There is no property outstanding in DOJ or NCIC. c. There is no death connected with the report, d. It is not classified under Penal Code Sections 290 and 800 and Health and Safety Code Section 11590, I Section 2, The records specified in Section 1 hereof shall not include any documents relating to citizen complaints or investigations in response to citizen complaints involving members of the Police Department, international affairs files, capital crimes, embezzlement of public funds, bribery of public officials, reports involving Seal Beach City employees, prisoner arrest files and child abuse reports.
