HomeMy WebLinkAboutCC Res 3398 1984-07-23 RESOLUTION NUMBER ~~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, MAKING CERTAIN ENVIRONMENTAL FINDINGS RELATING TO THE ESTABLISHMENT OF THE BIXBY OLD RANCH BUSINESS PARK SPECIFIC PLAN THE CITY COUNCIL OF THE CITY OF SEAL BEACH ODES HERESY FIND, DETERMINES, RESOLVE AND ORDERS AS FOLLOWS: WHEREAS, the Bixby Old Ranch Business Park Draft Environmental Impact Report has been prepared to address the environmental effects, mitigation measures, and project alternatives associated with the proposed Bixby Old Ranch Business Park Specific Plan; and WHEREAS, the following relevant background information is noted: 1, On May IS, 1980, the Seal Beach Environmental Quality Control Board moved that the Environmental Impact Report on proposed Bixby Ranch Company's Old Ranch Business Park Tentative Parcel Map '80-100l be recommended as complete and in accordance with the Seal Beach Environmental Guidelines and be so recommended to City Council, 2. On July 16, 1980, the Planning Commission approved and recommended approval of Tentative Parcel Map 80-100l (Resolution '1214). 3. On August 25, 1980, the City Council adopted the Bixby Ranch Company's Old Ranch Business Park Tentative Parcel Map 80-1001 (Resolution #2994) and certified the corresponding Environmental Impact Report in compliance with the Seal Beach Environmental Guidelines and the California Environmental Quality Act ICEQA}. 4, In 19S0, the property was resubmitted for consideration of a specific plan, This specific plan was titled the Bixby Ranch Company Old Ranch Business Park and dated May, 1983, The Specific Plan contained: A} three buildings not to exceed six stories, B) two free-standing restaurants, C} a street stystem with all access to and from the site limited to Seal Beach Boulevard. A new Environmental Impact Report (Bixby Ranch Old Ranch Business Park Oraft Environmental Impact Report) was prepared to discuss this revised project. WHEREAS, on May 9, 1983, th~ City of Seal Beach performed an Initial Study (Appendix A) ftS required under the California Environmental Quality Act (CEQA) finding that the proposed project (Specific Plan) may have a significant effect on the environment, and an Environmental Impact Report would be required. WHEREAS, subsequently a focused Draft Environmental Impact Report was prepared pursuant to the requirements of the California Environmental Quality Act (CEQA), the State Guidelines (Guidelines). under the City's direction by Ultrasystems. Inc. of Irvine, California, The issues indicated by the Planning Department (lead agency) which could cause a substantial environmental impact as noted in the Initial Study were covered. Also, references were made to the 19S0 Environmental Impact Report of the Original Bixby Old Ranch Business Park Project (TPM SO-IDOl) to those other environmental issues previously covered which were considered to have not changed. This focused Environmental Impact Report is dated July. 1983. I I I Resolution Number .:J54'! . WHEREAS, I WHEREAS, WHEREAS, WHEREAS, I after the preparion of the Draft Environmental Impact Report (DEIR), the DEIR as required by CEQA, was circulated to affected public agencies. As a result of the review and recommendations by these ag~ncies on the DEIR and the project in general, revisions were made in the project, and addenda made to the DEIR, These project revisions specifically were: A) Including the westbound 7th Street connector as recommended by Caltrans and the City's Engineering staff. B) Reducing the number of parking spaces from 1230 to 1100. C) Reducing the height of the eastern most office building 12 feet to 87 feet and increasing its width and depth from 86 feet to 104 feet and 200 feet to 220 feet, respectively. on October 20, 1983, the Seal Beach Environmental Quality Control Board held a public hearing on the DEIR and addendum. After discussion, it was moved-that the DEIR with conditions be adopted and the DEIR forwarded to the Planning Commission and City Council for their con~iderationi and the Seal Beach Planning Commission conducted public hearings on December 7, 1983 and January 18, 1984 to receive all public testimony with respect to the DEIRi and Section 21081 of CEQA and Section 15090 of the Guidelines requires that the City Council make one or more of the following findings prior to approval of a project for which an EIR has been completed identifying one or more significant effects of the project, along with statements of facts supporting each finding: FINDING 1 - Changes or alterations have been required in, or incorporated into the project which mitigate or avoid the significant environmental effects thereof as identified in the FEIR. FINDING 2 - Such changes or alterations are within the responsibility and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency, FINDING 3 - Specific econQmic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the EIRi and WHEREAS, Section l5093(a) of the Guidelines requires the City Council to balance the benefits of a proposed project against its unavoidable environmental risks in determining whether to approve the projecti and WHEREAS, Section 15093(b) requires, where the decision of the City Council allows the occurrence of significant effects which are identified in the EIR but are not mitigated, , the CITY must state in writing the reasons to support its action based on the EIR or other information in the record. I NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach, California finds as follows: Resolution Nu~ber ~~~l? Section 1. The City Council hereby certifies that the Final Environmental Impact Report (the FEIR), attached hereto as Exhibit A, on the proposed Bixby Old Ranch Business Park Specific Plan was completed pursuant to the provisions of the California Environmental Quality act and the Guidelines thereto and that the City Council has reviewed and considered the contents of the EIR prior to deciding whether to establish such specific plan (the "project"), and has found the FEIR as complete and adequate in that it addressess all environmental effects. Said FEIR is composed of the following elements: A. Draft EIR B, Appendices to Draft EIR C, City staff reports dated November 29, 1983, January 9, 1984 and July 6, 1984 D. Minutes of the Environmental Quality Control Board dated October 20, 1983. E. Draft EIR Addendum dated September, 1983 F. Minutes of the Planning Commission meetings dated December 7, 1983, and January 18, 1984 G. Letter from Principal Planner dated May 23, 1984 H. Comments received on DEIR and responses to those comments. I. All attachments, incorporations, and references delineated in A-H above. All of the above information has been and will be on file with the City Planning Department and with the City Clerk of the City of Seal Beach, California. Section 2, This City Council adopts the following findings with respect to each of the potential significant environmental effects identified in the EIR: I A. The EIR identifies the impact on land use and zoning as a potential significant environmental effect. Changes or alternations I have been required in, or incorporated into the project which avoid or substantially lessen this effect as any project must be developed in accordance with the regulations and procedures of the of the Specific Plan, and precise landscaping plans which incorporate the use of berms, hedges and thick foliage will be utilized to lessen impacts on surrounding areas; and the specific plan regulations require that the City Planning Department approve all uses or businesses. B. The EIR identifies the impact on traffic/circulation as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoid or substantially lessen this effect as the 7th Street connector has been included in the project; and the design of the northeast parking lot will be such that it discourages short-cutting of traffic through the parking lot to the 7th Street connector or the office complex; and the westbound interior street will be striped such that left-turning vehicles into the office complex do not impede through traffic; and interior street drivewawys are required to be spaced so that adequate left-turn pocket space is available to prevent conflicts with through traffic; and signal modifications and traffic improvements will be provided as required by the Specific Plan, C. The EIR identifies the impact on air traffic as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoids or substantially lessens this effect as the development has obtained permission from the Federal Aviation Authority (FAA) in the form of a Certificate of No Hazard. Further, the project as revised is consistent with the Orange County Airport Environs Land Use Plan. I I I I Resolution Number ~~~~ " lr.~ . \' , D. The EIR identifies the impact on air quality as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoid or substantially lessen this effect as the City will implement the mitigation measures required by the Air Quality Management Plan prepared by the South Coast Air Quality Management District; and dust control measures will be incorporated; and bicycle facilities will be provided so to encourage such use as an alternative to motor vehicles; and a convenient bus stop will be incorporated into the site plan. E. The EIR identifies the impact on noise as a potential significant environmental effect. Changes or alterations have been required in or incorporat~d into the project which avoid or substantially lessen this effect as delivery and maintenance vehicles will only be allowed to operate on the site from 7:00 a.m. to 7:00 p.m.; and restaurant tenancy will be screened by the City Council to assure patronage would not cause disturbances; and a construction schedule subject to City approval will include restrictions limiting heavy earth-moving activities to between the hours to 7:00 a.m. and 3:30 p.m.; and a special acoustical review of each commercial use within the Orange County Airport Land Use Commission AELUP 60 CNEL will be performed prior to issuanee of the building permit; and heavy landscaping will be planted between the proposed restaurants and the north-western property boundary, F. The EIR identifies the impact on visual/aesthetics as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoid or substantially lessen this effect as project lighting will be directed away from adjacent land uses; well designed precise sign program for all exterior signage will be incorporated and elevations will utilize non-mirrored glass; and hardscape walkways will be incorporated to direct pedestrians to proper areas. G. The EIR identifies the impact on energy conversvation as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoid or substantially lessen this effect as the design of the building will be in compliance with the State Energy Conservation standards. H. The EIR identifies the impact on shade/shadow as a potential signficant environmental effect. Changes or alterations have been required or incorporated into the project which avoid or substantially lessen this effect as the development will limit height and retain a setback which will keep all shade/shadows on the project site. I, The EIR identifies the impact on public services as a potential significant environmental effect. Changes or a~terations have been required in or incorporated into the project which avoid or substantially lessen this effect as energy conservation measures will be utilized; and specific water-saving systems will be contained in the precise landscaping plan and building design; and security devices and lighting will be incorporated into the building design subject to approval of the Police Department; built-in fire protection such as automatic fire sprinklers will be provided in all structures. J. The EIR identifies the impact on seismic safety as a potential significant environmental effect. Changes or alterations have been required in or incorporated into the project which avoid or substantially lessen this effect as project structures will be designed to withstand projected seismic accelerations. K. Members of the public have expressed concerns regarding the impact on public safety as a potential significant environmental effect. The City Council hereby finds that the potential impact on pUblic safety is not significant as the project complies with all FAA regulations and is consistent with the Orange County Airport Environs Land Use Plan, Further, the adjacent airport operator has stated that it is not opposed to the project.
