RESOLUTION NUMBER 3tIc q A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ORDERING VACATION OF THE ON-SITE DOMESTIC WATER SERVICE EASEMENT AND AND APPURTENANT FACILITIES LOCATED ON THE RIVERBEACH CONDOMINIUM PROJECT Section 1. The City Council of the City of Seal Beach on August 13, 1984, adopted Resolution No. 3401, entitled "A Resolution of the City Council of the City of Seal Beach declaring its intention to Vacate the Domestic Water Service Easement and Appurtenant Facilities and setting a time and place for a pub Ii c heari ng thereon". Section 2. Notices of the proposed "Vacation of the On-Site Domestic Water Service Easement and Appurtenant Facilities" were duly published and posted in the manner and form and at the time required by Streets and Highways Code 8323. Section 3. The City Council of the City of Seal Beach held a public hearing thereon September 10, 1984, at 7:00 p.m., at the Council Chambers. 211 8th Street, Seal Beach, California, at which time said Council heard all evidence offered by persons interested in said Vacation. Section 4. The City Council of the City of Seal Beach does hereby find that the On-Site Domestic Water Service Easement and Appurtenant Facilities, as described in said Resolution No. 3401, are unnecessary for present or prospective public needs. Section 5. That the proposed Vacation is consistent with the Seal Beach Municipal Code, General Plan and complies with the requirements for Vacations as cited in the Streets and Highways Code, Section 6, The City Council makes the following findings regarding the Vacation: 1, That the subject right-of-way is unnecessary for present and prospective public use. 2. That the subject facilities and right-of-ways are not needed as part of the City's maintained Domestic Water Distribution System. - 3. That the proposed Vacation is consistent with the Seal Beach Municipal Code, General Plan and complies with the requirements for Vacations as cited in the Streets and Highways Code. Section 7. The City Council'of the City of Seal.Beach hereby. orders that the On-Site Domestic Water Service Easement and Appurtenant Facilities located On-Site in Tract No. 9783 within the City of Seal Beach as delineated and shown on the map and plan on file in the office of the City Clerk of the City of Seal Beach and particularly described as: The On-Site Domestic Water Service Easement and Appurtenant Facilities, located on the Assessor's Map Book 199, Block 012, Lots 81, 82, 83 & 84, (Tract No. 9783, Lots 81 & 82) in the City of Seal Beach, Count~ of Orange, State of California, (Exhibit "A"), Shall be and hereby are Vacated.
