SUMMARY
City Council has already approved participation by the City of Seal Beach in the Orange
County Taxi Administration Program. In order to join OCTAP, Council must conduct a
public hearing on fees and rates of fare related to taxi administration in the City of Seal
Beach and adopt the attached Ordinance and Resolution.
BACKGROUND
The objective of the Orange County Taxi Administration Program is to increase public
safety, reduce administrative costs for the public and private sector and to expand private
transportation service in Orange County. OCTAP began operation in early 1998, and
now provides taxicab permitting on behalf of 27 Orange County cities. While
enforcement continues to be done by local police departments, OCTAP is responsible for
issuing taxicab driver, vehicle, and company business permits. In order to receive a
permit, a taxicab driver must pass a drug test, a criminal background check, and a DMV
check. OCTAP also conducts vehicle inspections, ensures that minimum insurance
requirements are met by taxicab companies, and verifies the accuracy of taximeters.

Government Code Section 53075.5 et seq. requires every city or county to protect the
public health, safety, and welfare by adopting an Ordinance and/or Resolution in regard
to taxi transportation services which are operated within the jurisdiction of said city or
county. The attached ordinance, which outlines the permitting and regulation of taxi
drivers and taxicab businesses within the City, achieves the objectives of the government
code. The ordinance also designates the OCTAP as the organization responsible for
administering the provisions of the ordinance.
By adopting this Ordinance, the City of Seal Beach agrees to only allow OCTAP-
approved taxi companies to operate within the community. In addition, the City will
retain authority to limit the number of taxicab companies which operate within its
jurisdiction. �jJ

FISCAL IMPACT
Funding of the OCTAP program is provided through the administrative fees collected by
the Orange County Transportation Authority. There will be no fiscal impact to the City
in order to enter and participate in the program. In addition, the City will still be able to
collect business license fees from taxi companies which transport customers from Seal
Beach. Some modest staff time will be saved by the City of Seal Beach when Orange
County Transportation Authority assumes responsibility for taxicab administration.
RECOMMENDATION
That the City Council conduct a public hearing on fees and rates of fare related to taxi
administration in the City of Seal Beach and adopt the attached Ordinance and
Resolution, and direct staff to execute the Inter-Agency Agreement with the Orange
County Transportation Authority.
