Badum, Director of Public Works/City Engineer Subject: UTILITY UNDERGROUNDING DISTRICT SEAL BEACH BOULEVARD, ELECTRIC AVENUE TO ADOLFO LOPEZ DRIVE GENERAL DESCRIPTION Upon conclusion of a public hearing, the proposed City Council action will adopt a resolution making findings and determining that public necessity, health, safety, and human welfare requires the removal of overhead utilities and appurtenant structures along Seal Beach Boulevard from Electric Avenue to Adolfo Lopez Drive. The adoption of the resolution is the first step in the SCE Rule 20-A program that will underground the overhead utilities at SCE expense. DISCUSSION The City of Seal Beach currently has an opportunity to fund the undergrounding of overhead utilities along Seal Beach Boulevard from Electric Avenue to Adolfo Lopez Drive under the Southern California Edison (SCE) Rule 20-A Program. In general, the California Public Utilities Commission (CPUC) requires that SCE to, at their expense, underground overhead facilities in situations where: 1) undergrounding will avoid or eliminate an unusually heavy concentration of overhead facilities; or 2)the street right of way is extensively used by the general public and carries high volumes of vehicular or pedestrian traffic; or 3) The street right of way adjoins or passes through a civic area or an area of unusual scenic interest to the general public. In order to iniate the undergrounding process, Rule 20-A requires that an underground district be formed. The first step of the process is a public hearing and the adoption of a resolution making findings and determining that public necessity, health, safety, and human welfare requires the removal of overhead utilities. Upon adoption of the resolution, SCE will begin the design process. SCE will take the lead for the undergrounding and coordinate with the other overhead utilities such as telephone and cable. Construction can be expected to start within 14 months. The target date for the completion of the underground utilities is December 30, 2000. 1 AGENDA ITEM/1/ i Seal Beach Blvd. Underground District City Council Staff Report May 24,1999 FISCAL IMPACT: SCE will fund the majority of project. Rule 20-A specifies that the undergrounding project will fund up to 100 feet of the electric service laterals. The City may need to budget additional funds to cover the shortfall, if any. Estimates of those costs will be available at the completion of the utility design. RECOMMENDATION: Staff recommends that the City Council : 1. Hold a public hearing to provide an opportunity for public comment;and 2. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach hereby finds and determines that the public necessity, health, safety and welfare requires the removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within that area more particularly described as the property within the public right-of-way on Seal Beach Boulevard between Adolfo Lopez Drive and Electric Avenue, which is hereby established as Seal Beach Boulevard Underground Utility District 99-1. BE IT FURTHER RESOLVED that the City Council of the City of Seal Beach finds that: a) Such undergrounding will avoid or eliminate an unusually heavy concentration of overhead transmission facilities; and b) Said streets and avenues are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. BE IT FURTHER RESOLVED that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district no later than December 30, 2000 by all affected utility companies. Whenever in this chapter the words or phrases hereinafter in this section defined are used, they shall have the respective meanings assigned to them in the following definitions: Commission. The Public Utilities Commission of the State of California. Person. Includes individuals, firms, corporations, partnerships, and their agents and employees. Poles, overhead wires and associated overhead structures. Poles, tower, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cutouts, switches, communication circuits, appliances, attachments and appurtenances located aboveground within a district and used or useful in supplying electric, communication or similar or associated service. Underground Utility District or District. That area in the City within which poles, overhead wires, and associated overhead structures are prohibited as such area is described in a resolution adopted pursuant to the provisions of Section 25A-3 . 5900 (Seal Beach 12/91) S 25A-5 Underground Utilities S 25A-7 Section 25A-5. Unlawful Acts. Whenever the Council creates an underground utility district and orders the removal of poles, overhead wires and associated overhead structures therein as provided in Section 25A-4 , it shall be unlawful for any person or utility to erect, construct, place, keep, maintain, continue, employ or operate poles, overhead wires and associated overhead structures in the district after the date when such overhead facilities are required to be removed by such resolution, except as such overhead facilities may be required to furnish service to an owner or occupant of property prior to the performance by such owner or occupant of the underground work necessary for such owner or occupant to continue to receive utility service as provided in Section 25A-10, and for such reasonable time required to remove such facilities after such work has been performed, and except as otherwise provided in this chapter. (Ord. No. 747 , S5) Section 25A-6 . Emergencies or Unusual Circumstances. Notwithstanding the provisions of this chapter, overhead facilities may be installed and maintained for a period, not to exceed ten days, without authority of the City Engineer in order to provide emergency service. The City Engineer may grant special permission, on such terms as he may deem appropriate, in case of unusual circumstances, without discrimination as to any person or utility, to erect, construct, install, maintain, use or operate poles, overhead wires and associated overhead structures. (Ord. No. 747 , S6) Section 25A-7 . Other Exceptions. In any resolution adopted pursuant to Section 25A-4 , the City may authorize any or all of the following exceptions: (a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (b) Poles, or electroliers used exclusively for street lighting. (c) Overhead wires (exclusive of supporting structures) crossing any portion of a district within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a district, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited. (d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of thirty-four thousand five hundred volts. 5902 (Seal Beach 12/91) S 25A-12 Underground Utilities S 25A-13 Section 25A-12 . Extension of Time. In the event that any act required by this chapter or by a resolution adopted pursuant to Section 25A-4 cannot be performed within the time provided on account of shortage of materials, war, restraint by public authorities, strikes, labor disturbances, civil disobedience, or any other circumstances beyond the control of the actor, then the time within which such act will be accomplished shall be extended for a period equivalent to the time of such limitation. (Ord. No. 747 , S12 . ) Section 25A-13 . Penalty. It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($500 . 00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment.
