Badum, Director of Public Works/City Engineer Subject: ACCEPTANCE OF MAIN STREET PARKING LOT AND DIRECTIONAL SIGNS, #801 GENERAL DESCRIPTION The proposed action will formally accept the completion of the contract for the Main Street Parking Lot and Directional Signs. DISCUSSION: In August, 1998, Council elected to award the Off Main Street Parking Lot and the Directional signage projects. In accordance with the plans and specifications, Excel Paving has completed the above-referenced project. The breakdown of costs are: Original Contract Price $318,085.25 Contract Total $303,197.04 Authorized Payments to date $272,877.34 10% Retention $30,319.70 Last meeting, Council requested staff to investigate whether the parking lot was ADA accessible. In particular, it was brought up that there was not a 4 foot travel area directly in front of the handicap parking area. This project was a rehabilitation of an existing facility. There were no provisions to acquire more land or expand the lot since it is bound on both sides by store buildings. In order to accomplish this 4 foot path way, the front lot would have needed to be designed to lose a total of 5 out of 13 regular spaces due to the tight space constraints, car overhang requirements, and minimum travel lane widths. Not only would this be detrimental to businesses and revenue for the City but also this would put the City at risk to be in violation of the Coastal Act for lost parking in a coastal zone. Agenda Item I Acceptance of Construction Contract City Council Staff Report March 22, 1999 Accordingly, this was considered an unreasonable accommodation or hardship. Furthermore, California Disability Guidebook states: "Parking Spaces may be provided which would require a person with a disability to wheel or walk behind other than accessible parking spaces when the enforcing agency determines that compliance with these regulations or providing equivalent facilitation would create an unreasonable hardship." In this instance, the person with the disability does not walk or wheel behind any regular parking spaces but rather at a maximum of one accessible space. Therefore, a design exception was granted for this facility. FISCAL IMPACT Funds were expended through the consolidation of a number of previously budgeted projects within the City's Capital Improvement Program and under the City's Parking Impact fund. RECOMMENDATION IIUpon motion of the consent calendar, it is recommended that the City Council: 1 1. Determine the work has been completed in accordance with the contract documents and declare the work to be accepted and the total amount of the contract is in the sum 0 of $303,197.04 2. Direct the City Clerk, within ten (10) days from the date of acceptance, file a "Notice of Completion" with the Orange County Recorder. 4. Direct City staff, upon expiration of thirty-five (35) days from the filing of the "Notice of Completion, to make the retention payment Excel Paving in the amount of $30,319.70.
