HomeMy WebLinkAboutCC AG PKT 2001-08-13 Supplemental Information - Correspondence re: Minor Plan Review 01-6August 10, 2001 Walt Miller 231 Seal Beach Boulevard Seal Beach, CA 90802 SUBJECT: RESPONSE TO RECONSIDERATION REQUEST - MINOR PLAN REVIEW 01 -6 Dear Mr. Miller The City is in receipt of your letter of August 3, 2001 requesting reconsideration of Minor Plan Review 01 -6. As I indicated during our discussion on July 31, it is reasonable for you to seek reconsideration by the City Council on the basis that you were out of the state when the City Council took its action regarding Minor Plan Review 01 -6. I have outlined the process under which you may seek modification to the conditions imposed on your permit. I understand that you have other concerns regarding the current construction activity on Seal Beach Boulevard. However, these are two separate matters. Time Frame for Submission of Modification of Conditions Request Package In order for a public hearing before the Council to be scheduled on September 24, 2001, you must submit the information below by August 31, 2001. This will provide staff adequate time to review your request, prepare the appropriate public hearing notices and properly notice the matter in the newspaper and by mail, and prepare the appropriate staff report for City Council consideration. If you need additional time, you may seek modification of conditions at any time. Information Necessary for Request to Modify Conditions: Provided below is information previously provided on July 3, 2001 by FAX to you in Colorado, regarding the previous letters you have provided, with an indication as to the actions you would need to seek modification of any conditions. We recommend that you combine your requests in a single application requesting waiver /modification/deletion of any conditions you wish. C:wyn ummuWirm Rm Reiea 1- 6.Requmt for Recomide ion Wr.dmc W08 -10 -01 Response Letter re: Request for City Council Reconsideration 229 Seal Beach Boulevard (Minor Plan Review 01 -6) August 10, 2001 Letter re: "Request to waive certain conditions required under Planning Resolution No. 01 -22". dated June 13, 2001: This letter requests relief of certain conditions imposed by the Planning Commission upon adoption of Planning Commission Resolution No. 01 -22, regarding Minor Plan Review 01 -6. As you were aware at the time of filing this letter, an appeal of the Planning Commission decision had been filed and the City Council considered this matter at a public hearing on June 11, 2001, closed the public hearing and continued consideration of the [natter until June 25, 2001. After receiving an additional staff report, the City Council approved Minor Plan Review subject to terms and conditions through the adoption of City Council Resolution No. 4906. Those conditions as to which you requested a waiver were retained in City Council Resolution No. 4906. Necessary Action for Waiver of Conditions: In order for these items to be considered by the City Council, you will need to file a written request for waiver, similar to your letter of June 13, 2001. The request will need to reference the approved City Council Resolution No. 4906, specify the conditions you want waived and specify the reasons why you feel the requested waivers should be granted by the City Council. A public hearing is required. If both requests are filed as a single application as we have suggested, a single filing fee of $100.00 is required to be submitted for these matters to be scheduled for the necessary public hearing. The filing fee is to reimburse the City for costs involved in publishing notices in the newspaper and mailing required notices to all property owners and occupants of structures within 300 feet of the subject property. Letter re: "Appeal Conditions Adopted by City Council June 25 2001 to Minor Plan Review 01 -06, Architectural Review ", dated June 27, 2001: This letter requests an appeal of certain conditions imposed by the City Council upon adoption of City Council Resolution No. 4906, regarding Minor Plan Review 01 -6. An appeal of a City Council action is not permitted under the Code of the City of Seal Beach. However, as indicated above, you may file an application to modify any conditions imposed by the City Council. Necessary Action for Council Consideration of Your Reauest: In order for this item to be considered by the City Council, you will need to file an application to modify conditions, similar to your letter of June 27, 2001. The request will need to reference the approved City Council Resolution No. 4906, the specific conditions you want modified or deleted, and specify the reasons why you feel certain conditions should be modified and/or deleted by the City Council. A public hearing is required for a modification to a quasi - judicial action. If both requests are filed in a single application, a single filing fee of $100.00 is required.
