In that decision, SCWC was ordered to set eligibility income guidelines for its CARW program at 175% of the federal poverty level. The CARW eligibility guidelines are patterned after those established in the California Alternate Rates for Energy (CARE) Program for energy utilities. This filing, when approved, will increase the eligibility income guidelines in SCWC's CARW program to match eligibility income guidelines in the energy utilities CARE program. Because this advice letter is not seeking authorization to increase rates, a resolution will not be needed to approve this advice letter. Background On January 9, 2002, the California Public Utilities Commission (Commission) issued Decision No. 02 -01 -034, granting SCWC authority to establish the CARW program in its Region 2 and Region 3 service territories. The CARW program provides a 15% rate reduction to eligible residential customers on each component of their water bill. In compliance with Decision 02 -01 -034, on February 6, 2002, SCWC filed Advice Letter 1109 -W to implement the CARW program in its Region 2 and Region 3 service territories. Advice Letter 1109 -W became effective on May 1, 2002. Ordering Paragraph No. 2 of Decision No. 02 -01 -034 orders SCWC to set the eligibility income guidelines at 175% of the federal poverty guidelines, which is currently applicable to energy utilities. These eligibility income guidelines are revised annually by the Commission and go into effect June 1. On April 29, 2002, the Commission established the 200212003 eligibility income guidelines, effective June 1, 2002. The advice letter is being filed to reflect the updated eligibility income guidelines on SCWC's CARW tariffs. Compliance SCWC has revised its Schedule No.'LI -10 and Form No. 20 to reflect the annual increase to eligibility income. The table below shows the increase to each level of the eligibility income. Protest and Responses A protest is a document objecting to the granting in whole or in part of the authority sought in this advice letter. A response is a document that does not object to the authority sought, but nevertheless presents information that the party tendering the response believes would be useful to the Commission in acting on the request. A protest must be mailed within 20 days of the date the Commission accepts the advice letter for filing. The filing date is the date the advice letter was put on the Commission Calendar. The Calendar is available on the Commission's website at www.cpuc.ca.gov. Click on SEARCH SITE (upper left comer). Uncheck all but Daily Calendar. Enter "WATER 1110 -W (include the quotation marks) and click SEEK. A protest must state the facts constituting the grounds for the protest, the effect that approval of the advice letter might have on the protestant, and the reasons the protestant believes the advice letter, or a part of it, is not justified. If the protest requests an evidentiary hearing, the protest must state the facts the protestant would present at an evidentiary hearing to support its request for whole or partial denial of the advice letter. The utility must respond to a protest with five days.
