SUB=: DWP SPECIFIC PLAN - STATUS OF OCEAN AVENUE
Ocean Avenue is indicated as a public roadway on the Orange County Tax Assessor Map
between First Street and the San Gabriel River. The roadway right-of-way is also indicated on
the DWP Specific Plan, and is included within the project boundary of the DWP Specific
Plan. A review of the legal description indicates clearly that "All that portion of the
southwesterly half of Ocean Avenue, 80 feet in width," is included as part of the specific plan
area.
The DWP Specific Plan restricts the contemplated hotel development to the "northerly 30% of
the DWP parcel" and "In all cases, visitor- serving shall be limited to the area north of an
imaginary westerly prolongation of Central Way."
Open Space uses, defined as "Public parks, green belts, bike trails, nature trails, hiking trails,
and any passive recreational uses normally located in parks or open spaces' —shall be located
on the southerly 70•� of the DWP site ".
There is also a provision that indicates `Subterranean parking is specifically authorized,
subject to approval of security measures by the Seal Beach Police Department." It has been
my understanding over the years that the Ocean Avenue right -of -way would he incorporated
into the passive recreation area on the southerly 70% of the site, and that if subterranean
panting were to be utilized that the access point would be at Fast Street and the extension of
Ocean Avenue.
In order to determine if the Ocean Avenue rightof -way is owned in fee title or is dedicated to
the city as a public right-of-way it would be necessary to have a title search conducted on the

property. It is estimated that the title search would cost between $1,000.00 and $2,500.00 due
to the age of the adjoining subdivisions (early 1920's). In either case, the extension of Ocean
Avenue is clearly a public right -of -way.

Plan Area" for information purposes.
