A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SEAL BEACH DENYING APPEAL
NO. 6-84 AND APPROVING A PARKING
VARIANCE FOR A RESTAURANT LOCATED AT
138-1/2 - 140 MAIN STREET
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1. Hennessey's Taverns duly filed an
~pplication with respect to the property described as Lot
38 and 40 of Block 9 of the Bay City Tract, in the City
of Seal Beach, requesting a variance from certain parking
requirements of the City of Seal Beach Zoning Ordinance.
Section 2. On December 5, 1984 and December 19,
1984, the Planning Commission held a public hearing on
the requested variance. On January 2, 1985, the Planning
Commission adopted Resolution No. 1351 granting a variance
from certain parking 'requirements.
Section 3. On January 14, 1985, pursuant to a
timely filed appeal of the Planning Commission's decision,
the City Council held a duly noticed public hearing to
consider the appeal of Variance No. 14-84. Evidence both
written and oral, was duly presented to and considered
by the City Council during the public hearing.
Section 4. The City Council finds, pursuant to
Section 28-2502 of the Seal Beach zoning Ordinance that:
1. Granting the requested variance will not adversely
affect the General Plan which designates the subject property
for commercial uses, including restaurants. The proposed
conditions of approval for such variance'will ensure that
adequate off-street parking is provided for the proposed
restaurant. The surrounding land uses to the north, south
and west consist of retail and service commercial uses.
Further, the City Council has directed staff to implement
the recommendations of the Downtown Parking and Urban Design
Task Force and Market & Business Analysis Task Force on
Downtown Revitalization to increase the amount of restaurant
space within the downtown area and to provide for greater
flexibility in existing parking requirements, including
the allowance for off-site and in-lieu fee parking programs.
2. Due to the size, shape and location of the
subject property and the location of the existing buildings
on such property, the strict application of the Zoning
Ordinance parking requirements will deprive the subject
property of privileges enjoyed by other property in the
same vicinity and zone. The subject property consists
of only approximately 5,875 square feet with 50 feet of
frontage on Main Street. The existing buildings on the
subject property, excluding the existing residence, consist

of approximately 3,512 square feet. Thus, there is not
sufficient area on-site to satisfy the City's parking requirements.
3. The granting of the requested variance will
not constitute a grant of special privilege inconsistent
with other limitations upon other properties in the same
vicinity and zone as the applicant will be required to
meet the required parking requirements by providing both
on-site and off-site parking spaces. Further, the applicant
will be required to participate in any in-lieu parking
program established by the City.

Section 5. The City Council hereby finds that
the requested variance is categorically exempt from the
requirements of the California Environmental Quality Act
pursuant to Sections l530l(a) and (l)(~) and 15311 of the
State CEQA Guidelines. The City Council further finds
that the requested variance will not reduce the number
of required parking spaces provided for the proposed use.
Section 6. Based upon the aforementioned findings,
the City Council hereby denies Appeal No. 6-84 and hereby
grants Variance 14-84 to allow the applicant to provide
less than the required on-site parking, to provide off-street
parking at a distance greater than 300 feet from the subject
property and to provide a type, form, width and location
of on-site parking as shown on the attached Exhibit A,
subject to the conditions attached hereto as Exhibit B.
