ROLL CALL Present: Commissioners: Miller, Massetti, Klinger, Campbell, Thomas Absent: None Staff Present: Amy Greyson, Senior Assistant City Attorney Alexa Smittle, Community Development Director Marco Cuevas, Jr., Assistant Planner Dana Engstrom, Acting City Clerk Jennifer Robles, Management Analyst APPROVAL OF AGENDA Community Development Director Smittle requested that the Commission continue Item D to the August 1, 2022 Planning Commission meeting to allow staff to review the proposed CUP at 1709 Apollo Court in more detail. Acting City Clerk Engstrom indicated that 9 supplemental communications were received after the posting of the agenda that were distributed to the Planning Commission and made available to the public. Motion by Commissioner Klinger, second by Commissioner Massetti to approve the agenda. AYES: Klinger, Miller, Massetti, Campbell, Thomas NOES: None ABSENT: None ABSTAIN: None Motion Carried PUBLIC COMMUNICATIONS Chair Miller opened public communications. Acting City Clerk Engstrom announced that six (6) emailed comments was received. Speakers: None. Chair Miller closed public communications. CONSENT CALENDAR A. Approval of the May 2, 2022, Minutes. APPROVAL OF CONSENT CALENDAR Motion by Thomas, second by Klinger to approve the Consent Calendar. AYES: Klinger, Miller, Campbell, Thomas, Massetti NOES: None ABSENT: None ABSTAIN: None Motion Carried CONTINUED ITEMS — None NEW BUSINESS - None SCHEDULED MATTERS - None PUBLIC HEARING B. Conditional Use Permit (CUP 22-5) 120 1st Street Applicant: Jack and Allison Gonsalves Request: Request for a Conditional Use Permit (CUP 22-5) to allow an interior and exterior remodel and the addition of a second-floor deck to an existing residence on a property that is nonconforming due to height in the Residential High Density (RHD-20) zoning district. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 22-10, APPROVING Conditional Use Permit 22-5 with conditions. Community Development Director Smittle introduced Assistant Planner Cuevas who provided a comprehensive staff report on this item. Staff indicated they would need to report back with the answer to Commissioner Campbell's question regarding the maximum lot coverage in Old Town. Chair Miller opened the public hearing. Acting City Clerk Engstrom announced that no emailed comments were received. Speaker: No speakers. Chair Miller closed the public hearing Motion by Commissioner Massetti, second by Chair Miller that the Planning Commission adopt Resolution No. 22-10, APPROVING Conditional Use Permit 22-5 with conditions. AYES: Miller, Campbell, Massetti, Klinger, Thomas NOES: None ABSENT: None ABSTAIN: None Motion Carried Senior Assistant City Attorney Greyson noted that there is a 10 day appeal period that starts July 19, 2022. C. ZTA 22-1 RLD-9 District area along Ocean Avenue between First Street and Eighth Street (the Gold Coast) Applicant: City Initiated Request: Zone Text Amendment 22-1 amending portions of TITLE 11 of the Seal Beach Municipal Code to allow architectural projections into side yard setbacks in the Residential Low Density (RDL-9) zone district along the "GOLD COAST" area of Ocean Avenue. Recommendation: That the Planning Commission hold a public hearing regarding Zone Text Amendment 22-1 and after considering all evidence and testimony presented adopt the Resolution recommending approval of Zone Text Amendment 22-1 to the City Council. Community Development Director Smittle provided a comprehensive staff report on this item including the background, previous regulations, current regulations, proposed clarification, architectural projection examples, and recommendations. Council Member questions were addressed. Chair Miller opened the public hearing. Acting City Clerk Engstrom announced that six (6) emailed comments were received. Speakers: Michael Bixler and Pete. Chair Miller closed the public hearing Motion by Commissioner Klinger, second by Commissioner Thomas that the Planning Commission adopt the Resolution recommending approval of Zone Text Amendment 22-1 to the City Council. AYES: Miller, Campbell, Massetti, Klinger, Thomas NOES: None ABSENT: None ABSTAIN: None Motion Carried D. Conditional Use Permit (CUP 22-4) 1709 Apollo Court Applicant: Fabio Manda Request: Request for a Conditional Use Permit to allow a modification to the previously approved Conditional Use Permit allowing for a Type 23 alcohol license (Small Beer Manufacturer) in lieu of a Type 41 alcohol license (on- sale beer and wine) in conjuction with the operation of a restaurant/cafe within an indoor sports facility at 1709 Apollo Court within the Boeing Integrated Defense Systems (BIDS) Specific Plan area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 22-09, APPROVING Conditional Use Permit 22-4 with Conditions. Chair Miller opened the public hearing. Acting City Clerk Engstrom played the one (1) voicemail recording that was left by Ryan, a Seal Beach resident. Speaker: No speakers. Chair Miller continued the public hearing to the August 1, 2022 Planning Commission meeting. Motion by Chair Miller, second by Commissioner Klinger that the Planning Commission continue proposed CUP 22-4 to the August 1, 2022 Planning Commission meeting. AYES: Miller, Campbell. Massetti, Klinger, Thomas NOES: None ABSENT: None ABSTAIN: None Motion Carried DIRECTOR'S REPORT Community Development Director Smittle thanked the Commissioners for their continued flexibility as the city responds to the rapid increase in COVID-19 cases within the city organization. Additionally, she highlighted that the City Clerk's office instituted a phone number to call in a public comment which is (562) 431-2527 x1601, a new way for the public to communicate with the Planning Commission while we continue to meet virtually. COMMISSION CONCERNS There were no Commission concerns.
