A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH AFFIRMING THE PLANNING COMMISSION'S
DETERMINATION THAT THE GROWING OF NURSERY STOCK
BE CONSISTENT WITH SECTION 2B-400(3) OF THE
ZONING CODE.
Section 28-400(3) of the Zoning Code states that flower and
vegetable gardening is a permitted use in the low density
residential (R-l) zone; and
ambiguity exists regarding this section as it relates to
the growing of nursery plants; and
on January 19, 1983, by Resolution Number 1277, the Planning
Commission maoe the following findings:
1) The growing of nursery plants in containers can be
compatible with the surrounding land use.
2) The growing of nursery plants in containers will not
result in noise, dust, vibration, objectionable odors
or other imcompatible effects.
3) Article 29 of the City Zoning Code permits conditions
to be imposed to insure compatibility with any surrounding
public or private land use.
4) No on-site sales will occur either wholesale or retail,
and
the Planning Commission forwarded their determination to City
Council for final action.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby determine
that Section 28-400(3) of the City's Comprehensive Zoning Or.dinance i'llcludes
the growing of nursery stock in containers and affirms the Planning
Commission's action. ---
