HomeMy WebLinkAboutCC Min 2022-08-08 Concert Series, Leisure World Health Expo, Parks Make Life Better Month, the Junior Lifeguard Barbecue, National Night Out at the Seal Beach Police Department, Edison Community Garden Clean-Up and Barbecue, and the Summer Send-Off at Heather Park. COUNCIL COMMENTS Council Member Sustarsic noted that she attended the National Night Out event at the Police Department, the Summer Send-Off at Heather Park, Edison Park Garden Clean- Up, and Barbecue. She thanked staff for all the wonderful events. Council Member Moore reported that he attended the Leisure World Health Expo, two Leisure World meetings related to mandated water restrictions, National Night Out at the Police Department, and the Edison Garden Clean-Up and Barbecue. He thanked staff for coordinating the events. Council Member Massa-Lavitt noted that she attended the Leisure World Health Expo and thanked staff for their support with the event. She indicated that Orange County Vector Control gave notice to the directors that spraying would take place in Santa Ana due to the 80's mosquito infestation. She concluded that the 80's mosquitos are prevalent this year. Mayor Pro Tern Varipapa reported that he attended the National Night Out event at the Police Department with his family and had a great time. He thanked staff for a wonderful event. Mayor Kalmick indicated that he attended the National Night Out event at the Police Department and gave kudos to staff for a wonderful event. He noted that he attended the grand opening of the new City of Hope facility in Irvine with other Orange County mayors. He also noted how fortunate we are to have a City of Hope facility here in Orange County. He mentioned that they were breaking ground for the new $1 billion hospital that will be built next door to the City of Hope. Additionally, he indicated that he attended an Orange County Fire Authority meeting, and also noted that the City is embarking on an endeavor to curtail the pigeons in the hot spots throughout town. COUNCIL ITEMS There were no Council items. CONSENT CALENDAR Council Member Moore moved, second by Council Member Massa-Lavitt, to approve the recommended actions on the consent calendar. A. Approval of the July 25, 2022 City Council Minutes - That the City Council approve the minutes of the Regular City Council meeting held on July 25, 2022. B. Demands on City Treasury (Fiscal Year 2023) August 8, 2022 - Ratification. C. Review and Determine that the City Council will Continue to Conduct Public Meetings by Teleconference Pursuant to Government Code Section 54953(e) - The City Manager and City Attorney recommend that the City Council determine that the City Council, and City Boards and Commissions will continue to conduct public meetings by teleconference pursuant to Government Code Section 54953(e), because in-person meetings would present imminent risks to the health and safety of attendees and continue to review this matter periodically. D. Authorizing Expenditures with EXP U.S. Services, Inc. for the Seal Beach Boulevard at North Gate Road Improvement Project (CIP ST2301), Pursuant to an On-Call Professional Services Agreement - That the City Council adopt Resolution 7323: 1. Authorizing the City Manager to approve expenditures in the not-to-exceed amount of $85,813 to EXP U.S. Services, Inc. for professional engineering design services for the Seal Beach Boulevard at North Gate Road Improvement Project (CIP ST2301), pursuant to an On- Call Professional Services Agreement dated July 22, 2019; and, 2. Authorizing the City Manager to approve additional work requests, in the not-to- exceed amount of $10,000. City Clerk Harper took a roll call vote to approve the consent calendar items. Consideration by the City Council of Resolution Finding that the Housing Element is Consistent with the Purposes of the State Aeronautics Act and Overruling the Orange County Airport Land Use Commission's Determination that the Adopted Housing Element is Inconsistent with the 2017 Airport Environs Land Use Plan - That the City Council: 1. Conduct the public hearing; and, 2. Adopt Resolution 7324 Finding that the Adopted Seal Beach General Plan 2021-2029 Housing Element (6 Cycle) is Consistent with the Purposes of the State Aeronautics Act and Overruling the Orange County Airport Land Use Commission's Determination that the Housing Element is Inconsistent with the 2017 Joint Forces Training Base Los Alamitos Airport Environs Land Use Plan. This item was continued to a Special City Council meeting to be held on August 29, 2022 at 7:00 pm. F. Zone Text Amendment in the Residential Low Density (RLD-9) Zone District along the "Gold Coast" Area of Ocean Avenue - That the City Council: 1. Conduct a public hearing to receive input and consider the Planning Commission's recommendation to approve a Zone Text Amendment for the Residential Low Density (RLD-9) Zone District along the "Gold Coast" Area of Ocean Avenue; and, 2. Introduce, waive full reading, and read by title only Ordinance 1696, an Ordinance amending the City of Seal Beach Municipal Code by revising Subsection D (Minimum Front and Interior Side Yards) of Section 11.2.05.015 (Development Standards) of Chapter 11.2.05 (Residential Districts) of Title 11. Community Development Director Smittle provided a comprehensive background of the staff report. Council Members provided comments and questions were addressed. City Attorney clarified that language should be "legal non-conforming" rather than using the term "grandfathered", as properties referenced were legal when built but do not now conform to the code. Repeal of Local Residential Eviction Moratorium - That the City Council adopt Ordinance 1697-U Repealing Ordinance 1683-U, which will repeal the City's local moratorium on residential evictions relating to financial hardships caused by the COVID- 19 pandemic. City Attorney Steele provided a comprehensive background of the staff report. There were no Council Member questions. Seal Beach Historic Resources Foundation Funding Request - That the City Council adopt Resolution 7325 Approving a funding allocation in the amount of $10,000 to the Seal Beach Historic Resources Foundation from the General Fund. Management Analyst Barich and Seal Beach Historic Resources Foundation (SBHRF) Foundation President Deb Machen discussed the Seal Beach Historic Resources Foundation's mission and vision. A video was shown where each of the Directors introduced themselves and made the request for funding. There were no Council Member questions. CITY ATTORNEY REPORT City Attorney Steele indicated that all Council Members met in Closed Session to discuss the two items on the posted agenda and took no reportable action. CITY MANAGER REPORT City Manager Ingram highlighted several community events and the staff members who dedicated a significant amount of time and energy to support those event, and in many cases, above and beyond staff's normal work schedules to ensure the success of the events. The highlighted events included the Tennis and Pickleball Center Open House, the Summer Kick-Off event at Edison Park, Spikeball at the Beach, the Fish Fry. Summer "�
