A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, ESTABLISHING A USE
AND RENTAL SCHEDULE FOR MUNICIPAL COMMUNITY
CENTER BUILDINGS, AND RESCINDING RESOLUTION
NUMBER 2745.

WHEREAS,
it is necessary to establish a use and rental schedule for the
use of municipal community center buildings, the City Council
of the City of Seal Beach, California, hereby establishes the
following schedule for use and fees of municipal community
center buildings:

A. Resident groups shall be those having at least 60% of their
active membership residing within the City of Seal Beach.
Resident groups have preference over non-resident groups.
Section 1. Classification and Fees

B. Permits may cover a period of time not to exceed six (6) months
at which time a new application will be evaluated.
C. Groups may reserve facility on a regular basis no more than
twice per month.
D. One week is required to process applications. Applications
must be made at least two weeks in advance if any special
a rrangernents by the Ci ty are necessa ry.
E. Copy of permit must be presented when signing for a key.

F. Groups must maintain a regular attendance of no less than
30 for use of large rooms and 10 for use of small rooms in
order to retain a valid permit.
G. If a group fails to use the building on three consecutive
reservation dates. the permit will be cancelled.
H. A damage and clean-up deposit of $50 is required before a
permit will be issued. This deposit will be used to cover
the cost of clean-up made necessary by a group. The deposit
will be returned if not subject to the above cost of clean-up.
Addition~l fees are required when alcoholic beverages are to
be served.
I. Any fees charged must be paid in advance and will include
time necessary for set-up and clean-up.
J. A Certificate of Insurance may be required before a permit
will be issued to groups having activities that may cause
injury to participants or spectators.
Section 3. Special Arrangements - Additional Charges for Services
The City will supply assistance in arranging tables and chairs
for a charge equal to the labor expenses involved. To cancel
or change the time of this service. 48 hours notice is required;
otherwise. the quoted charge will .be made.
Section 4. Policies for Facility Use
A. Masking tape only will be allowed in placing decorations on
doors and windows; walls must not be damaged.
B. Smoking is allowed only when minors are not involved.
C. Gambling is not allowed in any City facility or on City
grounds at any time.
D. Groups provide their own kitchen utensils. soap. dishcloths.
towels, etc.
E. In some instances. arrangements may be made with the City to
store certain supplies in locked areas to which only the
user and the City have access. The City assumes no responsi-
bility for such stored materials.
F. No activities may be directed in any way toward the violent
overthrow of the present form of government of this City.

G. The use of alcoholic beverages shall be in accordance with
the specified alcoholic beverage Rules and Regulations
attached hereto as Exhibit "A".
H. Any infraction of these rules and regulations will be grounds
for refusal of any further use of City facilities.
Section 5. Rescinding of Previous Resolution
Resolution Number 2745 is hereby rescinded.

EXHIBIT A
RULES AND REGULATIONS FOR
USE OF ALCOHOLIC BEVERAGES IN MUNICIPAL FACILITIES
Use of alcoho11c beverages must be requested at the time the facility use
application 1S made. Th1s applicat10n must be submitted to the Recreat10n
Department at least two weeks 1n advance of the event.
The distribution or consumption of alcoholic beverages shall be 1n compliance
w1th all app11cable law, including regulations of the Alcoho11c Beverage Control
Comm1ssion. Any organizat10ns using the City premises shall be solely responsible
for obtain1ng all required permits or licenses relat1ng to the distribution
and consumption of alcoho11c beverages on the premises. The City shall have
no responsibility 1n this regard.
Alcohol Use Permit must be in the possession of the applicant throughout the
act1vity.
No alcoho11c beverage shall be served to any minor person under 21 years of
age. InJuries caused to any person as a result of alcoholic beverages being
served to or consumed on the City's prem1ses, or arising off the City prem1ses,
or as a result of alcohol be1ng ava1lable on the City premises shall be the
sole responsibi11ty of the organ1zat10n, its sponsor and adult representative.
City employees shall be assigned to be present at all programs and/or activities.
The C1ty employee shall have complete author1ty to request changes in activities
or cessation of activities; groups using the fac11ity shall comply w1th these
requests or 1nstructions. The cost of th1s supervision shall be borne by the
applicant sponsoring the activity.
When, 1n the op1nion of the Police Chief, act1v1ty conditions warrant the presence
of one or more security personnel, the cost of this service shall be borne
by the app11cant sponsor1ng the act1vity.
Serving of any alcoho11c beverages must end th1rty minutes before the following
exit time:
1. North Seal Beach Commun1ty Center - 11:30 p.m.
2. Marina Community Center - 10:00 p.m.
3. Seal Beach Senior Center - 10:00 p.m.
All hard 11quor must be d1stributed over a bar into ind1vidual servings.
punch, beer, and champagne must be consumed from ind1v1dual conta1ners.

The alcoholic beverage permittee shall remove all beverages from the premises
immediately following the approved function.
Applicants may be required to deposit $250 to insure proper cleanup and to
cover breakage, loss or damage. The applicant shall be liable for and required
to pay the full cost of all breakage, damage or loss (over and above deposited
funds) regardless of the amount. If damage occurs which is less than the amount
of deposit, the difference shall be refunded w1th a copy of the inv01ce for
damages.
All depos1ts will be refunded 1f proper cleanup is completed and no breakage
or damage has occurred. Proper cleanup shall be determined by community center
staff on duty.
The C1ty may require the applicant to carry an insurance policy nam1ng the
C1ty as add1t10nally insured when deemed necessary by the Director of Recreation
in the amounts recommended by the C1ty Manager.
Evidence of required permt1s, licenses, or insurance must be prov1ded to the
Recreat10n Department five working days prior to the scheduled event.

WHEREAS, COUNTY AKD CITY previously entered into a Cooperation Agree~ent.

WHEREAS, the CITY has submitted to the COUNTY an application for fund~ng of
a project hereinafter described, and

with the U.S. Department of H~".tng and Urban Development (hereinafter designated as
HUD) to fund said project u",:"r t1.e Housing and Community Development Act of 1974
(Public Law 94-383) as amended, (hl-ceindfter referred to as ACT), and
WHEREAS, the COU::T': 1.as establ1shed a Home Improvement Program and has
entered into individual 3gr~e=er.ts to administer said program with HUD, California
State Department of Housing and Community Development and a local lending institution,
and
WHEREAS, the CITY ".1:; reauested C0l1NTY to implement the CITY's Housing and

NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties that the
following provisions listed as well as all applicable Federal, State and County laws
and regulations including the attached SPECIAL PROVISIONS, identified as EXHIBIT "A",
are part of this Contract.
1. The COUNTY will implement the Housing Rehabilitation Project described
herein as project, to provide low-interest loans, deferred payment loans, or grants
for home improvement of privately owned properties primarily in the CITY's target
area and spot housing rehabilitation within the City's boundaries (see attached map
Exhibit "B"), in accordance with the COUNTY's Home Improvel'lent Program (see
Exhibit "c" of this Contract) as approved and amended from time to time by the Board
of Supervisors. The project is to primarily benefit low- and moderate-income fa~ilies.
2. The total project funds svailable for loans or loan subsidies and
administrative costs hereinafter provided for in Section 3 of this Contract will not
exceed $50,000.00 (Fifty Thousand Dollars and no/100). It is agreed by all parties
that all funds shall be expended prior to December 31, 1983.
3. The CITY agrees to pay administrative charges for costs incurred by
COUNTY staff which shall not exceed 20% of the total project funding amount stated
in Section 2 of this Contract.
4. The CITY agrees to advertise the program and to provide outreach efforts
in the community on an ongoing basis to promote loans or loan subsidies from available
funds. The CITY agrees to implement project for Community Development purposes as
defined by applicable HUD provisions to ensure maximum benefit of project to low- and
moderate-income persons. In the event that all funds for this project are not
expended by December 31, 1983, this Contract may be terminated at the discretion
of the COUNTY.
5. The CITY agrees to provide appropriate office space to the COUNTY, in-
cluding use of a desk and a telephone.
6. Whenever applicable, funds may also be used to administer the City's

7. Neither COUNTY nor any officer nor employee thereof shall be responsible
for any damage or liability occurring by reason of any action or omission of CITY or
its agents, associates, contractors, subcontractors, materialmen, laborers, or any
other persons, firms, or corporations furnishing or supplying work service, materials,
or supplies in connection with CITY's performance of this Contract and from any and
all claims and losses accruing or resulting to any persons, firm or corporation for
personal injuries or property damage resulting from or as a consequence of, CITY's
performance of this Contract under or in connection with any work, authority or
12 jurisdiction delegated to CITY under this Contract. It is also understood and agreed
13 that, pursuant to California Government Code Section 895.4, CITY shall fully indemnify,
14 defend and hold COUNTY harmless from any liability imposed for injury (as defined by
15 California Government Code Section 810.8) occurring by reason of any action or omis-
16 sion of CITY under or in connection with any work, authority or jurisdiction delegated
17 to CITY under this Contract. CITY shall act in an independent capacity and not as
18 officers, employees or agents of COUNTY.
