RESOLUTION NO. 3/10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, APPROVING THE
DESTRUCTION OF CERTAIN RECORDINGS OF TELEPHONE
AND RADIO COMMUNICATIONS PURSUANT TO SECTION
34090.6 OF THE GOVERNMENT CODE OF THE STATE
OF CALIFORNIA.
WHEREAS, the Chief of Police has submitted a request for authority to
destroy certain recordings of telephone and radio communica-
tions; and
WHEREAS, said request has been approved by the City Attorney, and is
recommended for approval by the City Manager, and is in
accordance with the procedures and requirements of the City
of Seal Beach and Section 34090.6 of the California Government
Code; and
WHEREAS, said request is to destroy the original recordings which are
more than 100 days old and are made in the routine daily taping
and recording of telephone communications to and from the Police
Department and all radio communications relating to the operations
of such departments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal
Beach, that the Chief of Police is hereby authorized to destroy the tape
recordings described in the foregoing paragraph to wit:
1. All tape recordings over 100 days old of:
a. Daily telephone communications
b. Daily radio communications
2. No reproductions shall be required prior to destruction,
except as specified below.
3. The recordings specified in paragraph 1 of this resolution
do not include any documents relating to citizen complaints
or investigations in response to citizen complaints relating
to members of the Police Department nor to internal investiga-
tion file5 unless a reproduction of the original has been
made on a suitable magnetic device.
4. The City Council finds that the City Attorney has given
his written consent to the destruction of the recordings
described in paragraph 1 of this resolution, and the Chief
of Police is authorized to destroy the recordings described
in paragraph 1 of this resolution.
5. This resolution shall be effective as of July 1, 1982 and
remain in full force and effect applying to all named re-
cordings reaching the requisite age until rescinded._
