A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SEAL BEACH AUTHORIZING CERTAIN
EMERGENCY WORK TO BE DONE ADJACENT TO
SURFS IDE COLONY WITHOUT ADVERTISING FOR
BIDS AltD MAKING CERTAIN FINDINGS IN
CONNECTION THEREWITH
THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY
FINDS, RESOLVES AND ORDERS AS FOLLOWS:
Section 1. The beach fronting the area of the City
of Seal Beach known as Surfs ide Colony has been rapidly
eroding and is continuing to erode at an alarming rate.
Such erosion has resulted in an extreme peril and danger
to persons and property adjacent to the subject beach. A
written report, dated August 17, 1982, prepared by the
City's consultants, Moffatt & Nichol, Engineers, concluded
that "if sand is not placed on the beach very soon, loss of
structures is imminent." Subsequently, on August 18, 1982,
high tide conditions created an immediate threat to life
and property along the subject beach. The risk that under-
ground utilities, including water and sewer lines, would be
severed presented a public health threat.
Section 2. On August 18, 1982, the City Manager,
pursuant to his authority as Director of Emergency Services,
declared the existence of a local emergency. With the
assistance of the County of Orange, sand was moved onto
the subject beach to provide a temporary buffer between the
houses along the beach and the surf. On August 30, 1982,
the City Council by Resolution No. 3205 confirmed the
existence of a local emergency. On September 2, 1982, the
C~ty Council found and determined tha~ the local emergency
continued to exist.
Section 3. The foregoing peril and danger to the
public health, safety and welfare may be temporarily abated
by the immediate placement of additional sand on the subject
beach. There is not adequate time for the City to follow its
established bidding procedure for public works as the threat
to life and property in the area of the City of Seal Beach
known as Surfside Colony continues to exist. Since the place-
ment of additional sand on the sUbject beach is of urgent
necessity for the preservation of life, health, and property,
the City Council, pursuant to Section 1010 of the Official

Charter of the City of Seal Beach, hereby authorizes the City
of Seal Beach to enter into contracts for the movement of
sand onto the subject beach and the performance of appurtenant
work without advertising for bids or otherwise complying with
any applicable bidding requirements provided that the cost of
such work does not exceed $100,000.00.
