RESOLUTION NO. 3223 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AUTHORIZING CERTAI~ EMERGENCY W0RK TO BE DONE ADJACENT TO SURFS IDE COLONY WITHOUT ADVERTISING FOR BIDS, AND MAKING CERTAIN FINDINGS IN CONNECTION TFEREWITH THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY FINDS, RESOLVES AND ORDERS AS FOLLOWS: Section l. On September 2, 1982, the City Council adopted Resolution No. 3208 which authorized the expenditure of up to $lOO,OOO to prevent or abate beach erosion in the area of the city known as Surfside Colony. On October 25, 1982, the City Council appropriated the sum of $2l7,000 from the City's Plant and Equipment Fund to pay for the construction of an emergency riprap. Based upon the report of the City's consultants, Moffitt & Nichol, Engineers, the City Council found that such work is required to prevent the perils and dangers described in said Resolution No. 3208. Section 2. The City Council hereby adopts the find- ings set forth in Resolution No. 3208 of the City council of the City of Seal Beach. The City Council further finds that impending high tides and winter storms make the immediate construction of an emergency riprap essential to the protection of life and property along the subject beach. Therefore, there is not adequate time for the City to follow its established bidding procedure for public works as the threat to life and property in the area of the City of Seal Beach known as Surfside Colony continues to exist. Since the construction of the emergency riprap on the subject beach is of urgent necessity for the preservation of life, health, and property, the City Council pursuant to Section lOlO of the Official Charter of the City of Seal Beach, hereby authorizes the City of Seal Beach to enter into a contract for the construction of an emergency riprap and appurtenant work without advertising for bids or otherwise complying with any applicable bidding requirements provided that the cost of such work does not exceed $2l7,OOO.
