A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
RECITING THE FACT OF THE GENERAL MUNICIPAL
ELECTION HELD ON NOVEMBER 8, 2022 DECLARING THE
RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Seal Beach, California, on Tuesday, November 8, 2022, as required by law; and,
WHEREAS, notice of the election was given in time, form and manner as
provided by law; that voting precincts were properly established; that election
officers were appointed and that in all respects the election was held and
conducted and the votes were cast, received and canvassed and the returns
made and declared in time, form and manner as required by the provisions of the
Elections Code of the State of California for the holding of elections in charter
cities; and,
WHEREAS, the Orange County Registrar of Voters canvassed the returns of the
election and has certified the results to this City Council, the results are received,
attached, and made a part hereof as "Exhibit A".
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
SECTION 1. The whole number of Vote -By -Mail Ballots cast in the City was
2025; the whole number of Election Day Vote Center Ballots cast in the City was
556; for a total of 2581 ballots cast in the City.
SECTION 2. The names of persons voted for at the election for Member of the
City Council are as follows:
District One: District Three: District Five:

Gregg Barton Lisa Landau Mariann Klinger
Christopher DeSanto Fred Macksoud Michael J. McGrorty

SECTION 3. There were no measurers voted upon at the election.
SECTION 4. The number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective
offices for which the persons were candidates as listed in Exhibit "A" attached.
SECTION 5. The City Council does declare and determine that:
a. Joe Kalmick was elected as Member of the City Council L
from Councilmanic District One for the full term of four years;
and,
b. As a result of the election, a majority (50% plus 1) of voters voting
on Councilmanic District Three was not voted for a candidate;
therefore, pursuant to Seal Beach Charter § 502 and 509, on
Tuesday, January 31, 2023, a mailed ballot Run -Off Election shall
be held for Councilmanic District Three and the names on the ballot
shall be the following two candidates receiving the highest votes
are Stephanie Wade and Lisa Landau; and,
C. As a result of the election, a majority (50% plus 1) of voters voting
on Councilmanic District Five was not voted for a candidate;
therefore, pursuant to Seal Beach Charter § 502 and 509, on
Tuesday, January 31, 2023, a mailed Run -Off Election shall be held
for Councilmanic District Five and the names on the ballot shall be
the following two candidates receiving the highest votes are Nathan
Steele and Mariann Klinger.
SECTION 6. The City Council authorizes the Registrar of Voters to conduct the
mailed run-off election on Tuesday, January 31, 2023 and canvass the results,
pursuant to applicable provisions of the City Charter, Municipal Code and State
law, including (without limitation) providing the following election services:
a. Mail a ballot and County Voter Information Guide to all active
registered voters residing in City Council Districts 3 and 5
commencing the week of January 3, 2023, including any overseas
and military voters by December 17, 2022 — 45 days before
Election Day; and,
b. No Vote Centers for in-person voting would be operated; and,
C. Provide the following ballot drop-off locations: (1) City Clerk's office
during regular business hours Monday -Friday 8am-5pm and from
7am-8pm on Election Day; and, (2) Leisure World Seal Beach
ballot drop box available 24/7 for residents of the community; and,
(3) Mary Wilson Branch Library ballot drop box available 24/7; and,
(4) Registrar of Voters' office during regular business hours
Monday through Friday 8am-5pm, and from 7am-8pm on Election
Day; and, (5) Registrar of Voters' ballot drop box available 24/7 in
front of the office located at 1300 South Grand Avenue, Building C,
Santa Ana CA; and,

d. Issuance of a second (replacement) ballot for voters or their
authorized representative and Conditional Voter Registration and
issuance of a provision ballot from January 17, 2023, through
Election Day will be provided to voters at the Registrar of Voters
in Santa Ana only; and,
Ballots will be timely cast if postmarked by January 31, 2023 and
received from the U.S. Postal Service by February 3, 2023.
SECTION 7. The City shall reimburse the Registrar of Voters for all services,
supplies and equipment to be provided for the municipal Run Off Election.
SECTION 8. The City Clerk shall enter on the records of the City Council of the
City, a statement of the result of the election, showing: (1) The whole number of
ballots cast in the City; (2) The names of the persons voted for; (3) For what
office each person was voted for; (4) The number of votes given at each precinct
to each person; (5) The total number of votes given to each person.
SECTION 9. That the City Clerk shall immediately make and deliver to each of
the persons so elected a Certificate of Election signed by the City Clerk and
authenticated; that the City Clerk shall also administer to each person elected the
Oath of Office prescribed in the Constitution of the State of California and shall
have them subscribe to it and file it in the office of the City Clerk. Each and all of
the persons so elected shall then be inducted into the respective office to which
they have been elected.
SECTION 10. The City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

regular meeting held on the 12th day of December 2022 by the following vote:
