A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
DECLARING THAT THE SEAL BEACH PIER EMERGENCY PIER
REPAIR (CIP EM2023) IS EXEMPT FROM PUBLIC BIDDING ON
THE BASIS THAT THE WORK IS OF URGENT NECESSITY TO
PROTECT PUBLIC PROPERTY; AWARDING AND
AUTHORIZING THE CITY MANAGER TO EXECUTE A
PROFESSIONAL SERVICES AGREEMENT WITH ANSER
ADVISORY MANAGEMENT, LLC; AWARDING AND
AUTHORIZING THE CITY MANAGER TO EXECUTE A PUBLIC
WORKS AGREEMENT WITH JILK HEAVY CONSTRUCTION,
INC.; AND APPROVING BUDGET AMENDMENT BA #23-08-01
TO ALLOCATE $1,600,960
WHEREAS, on January 4, 2023, Governor Newsom proclaimed a state of
emergency throughout California to support the ongoing response to winter
storms; and,
WHEREAS, on January 5, 2023 and continuing thereafter, the Seal Beach Pier
("Pier") was damaged due to the heavy winter storms and extreme high surf
conditions; and,
WHEREAS, the Director of Public Works determined that as a result of the Pier
damage, there was an imminent need for the City to make repairs, and the Director
of Public Works thereupon declared an emergency finding the Seal Beach Pier
Emergency Repairs ("Project") was of urgent necessity for the preservation of
property, and that there would not be sufficient time for public bidding in order to
carry out the work; and,
WHEREAS, the City Manager/Director of Emergency Services has declared a
Local Emergency on January 17, 2023 which has been ratified by the City Council;
and,
WHEREAS, the City desires to retain a consultant to provide project management
services, and a contractor to perform emergency repair services for the Project;
and,
WHEREAS, on January 17, 2023, Anser Advisory Management, LLC (Anser)
submitted a proposal to provide professional project management services for the
Project; and,
WHEREAS, on January 20, 2023, Jilk Heavy Construction, Inc. (Jilk) submitted a
cost proposal to perform emergency repair work for the Project; and,
WHEREAS, Anser and Jilk are qualified firms to perform the Project; and,
WHEREAS, the City's Charter Sections 107 and 1010 authorize the City to
dispense with public bidding as necessary for the preservation of property, and
Seal Beach Municipal Chapter 3.25 also exempts emergency projects from bidding
requirements.
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE, FIND AND
DETERMINE AS FOLLOWS:
SECTION 1. Based on the recitals set forth above, the City Council hereby
declares that the Seal Beach Pier Emergency Repair (CIP EM2023)
is necessary for the preservation of property of the City, and the City
Council has ratified the local declarations of emergency.
SECTION 2. The City Council hereby authorizes the City Manager to execute a
professional services agreement with Anser Advisory Management,
LLC to provide professional project management services for the
Seal Beach Pier Emergency Repair (CIP EM2301), pursuant to Seal
Beach Municipal Code 3.20.025 (C), for a total not-to-exceed amount
of $217,336.
SECTION 3. The City Council hereby authorizes the City Manager to execute a
public works agreement with Jilk Heavy Construction, Inc., without
advertising for bids, for a total not-to-exceed amount of $1,083,624.
SECTION 4. The City Council hereby authorizes the City Manager to approve
payments in for additional work requests in connection with the
Project in the cumulative not-to-exceed amount of $200,000.
SECTION 5. The City Council hereby authorizes the City Manager to approve
payments for inspection and testing in connection with the Project in
the cumulative not-to-exceed amount of $100,000.
SECTION 6. The City Council hereby approves Budget Amendment #BA 23-08-
01 allocating $1,600,960 to account number EM2023ex-301-101, as
follows:

SECTION 6. The City Clerk shall certify to the passage and adoption of this
resolution.
PASSED, APPROVED and ADOPTED by the Seal Beach City Council at a
regular meeting held on the 13th day of February, 2023 by the following vote:
