HomeMy WebLinkAboutCC Res 7374 2023-02-13 RESOLUTION 7374 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL DECLARING CERTAIN CITY-OWNED REAL PROPERTY TO BE SURPLUS PURSUANT TO GOVERNMENT CODE SECTION 54220, ET SEQ., FINDING THAT SUCH DECLARATION IS EXEMPT FROM ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AND DIRECTING STAFF TO TAKE RELATED ACTIONS WHEREAS, the City of Seal Beach is the owner in fee simple of that certain real property located at 4197 Ironwood Avenue, Seal Beach, CA (Assessor Parcel Number 217-191- 09) as described in Exhibit A attached hereto ("Property"); and, WHEREAS, the Property is approximately 5,200 square feet in size, and is currently improved with a single family residence, and is not used by the City for municipal purposes nor according to a written plan adopted by the City Council for City work or operations; and, WHEREAS, the Surplus Land Act, Government Code Sections 54220-54234, defines surplus property as land owned by any local agency that is not necessary for the agency's use and requires that the City follow certain procedures prior to engaging in negotiations to sell land; and, WHEREAS, the City has determined that the Property is not suitable for the City's use; and, WHEREAS, the City Council desires to declare that the Property is surplus land and proceed with disposition pursuant to Government Code Sections 54220 et seq. NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: Section 1. The City Council of the City of Seal Beach hereby declares that the Property and any rights, title, and interest therein, is "surplus land" pursuant to Government Code Section 54221(b). The basis for this declaration is that the City cannot financially afford to utilize the Property for a City purpose, that continuing maintenance of the Property would require a significant expenditure of City funds, and the site is not included in any adopted written work plan. Section 2. This Resolution is exempt from the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA") as designation of this Property as "surplus land" does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378. Adoption of the Resolution does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, because the action merely designates for disposition an improved single family residential lot in a single family residential zone. Section 3. The Council hereby directs the City Manager or authorized designee to do all things necessary to effectuate the purposes of this Resolution, including preparation and distribution a Notice of Availability ("NoA") to the entities designated in Government Code Section 54222 as required by applicable law. Section 4. The City Manager or authorized designee are hereby authorized, jointly and severally, to do all things which they may deem necessary or proper to effectuate the purposes of this Resolution, and any such actions previously taken are hereby ratified and confirmed. Such actions include negotiating in good faith in accordance with the requirements of the Act with any of the Designated Entities that submit a written notice of interest to purchase or lease the Properties in compliance with applicable law. Section 5. The City Clerk shall certify to the adoption of this resolution and shall cause this resolution and her certification to be entered in the permanent records of the City. Except therefrom all minerals, oil, gas and other hydrocarbon substances lying below a depth of 500 feet below the surface of said land, without the right of surface entry above the depth of 500 feet from the surface, as reserved in deeds of record.
