HomeMy WebLinkAboutCC Res 7381 2023-02-27 RESOLUTION 7381 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL DECLARING THE RESULT OF THE CITY COUNCIL DISTRICTS THREE AND FIVE MUNICIPAL RUN-OFF ELECTION CONDUCTED BY AN ALL MAILED BALLOT ON JANUARY 31, 2023 WHEREAS, a Run-Off Election for the Seal Beach City Council Districts Three and Five was conducted by an all mailed ballot in the City of Seal Beach, California on Tuesday, January 31, 2023, as called and required by law; and, WHEREAS, as provided in the City Charter and Municipal Code, the City Council ordered that the Run-Off election would be conducted entirely by an all mailed ballot, and notice of the election was given in time, form and manner as provided by law. In all respects the election was held and conducted, and the votes were cast, received, and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Charter of the City of Seal Beach and the Elections Code of the State of California for the holding of elections in charter cities; and, WHEREAS, the Orange County Registrar of Voters (Election Department) canvassed the returns of the election and has certified the results to this City Council, the results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: SECTION 1. The whole number of all mailed ballots cast in the precincts and in the City were 4462. SECTION 2. The name of the person elected at the run-off election for Member of the City Council from District Three is Lisa Landau; and from District Five, Nathan Steele. SECTION 3. The number of votes received in Districts Three and Five for each candidate in the run-off election are as listed in Exhibit "A" attached. SECTION 4. The City Council does declare and determine that Lisa Landau has been elected as a Member of the Seal Beach City Council from District Three for a full term; and, Nathan Steele has been elected as a Member of the Seal Beach City Council from District Five for a full term. SECTION 5. The City Clerk shall enter in the records of the City Council of the City, a statement of the results of the run-off election, showing: (1) The whole number of ballots cast in the Districts: and, (2) The name of the persons voted for; and, (3) For what office the persons were voted for; and, (4) The total number of votes cast in the run-off election; and, (5) The total number of votes given to each person. SECTION 6. The City Clerk shall immediately make and deliver to the person so- elected a Certificate of Election signed by the City Clerk and authenticated, and that each person elected shall be administered the Oath of Office as prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. The persons elected shall then be inducted into their respective office to which they have been elected. SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
